Book excerpt: The object of the research work is the analysis of the multilevel protection of the human right to water and the current degree of implementation that it has received in international, European, and national law, comparing the Italian and German contexts from the constitutional law perspective. Given the absence of an express recognition of the human right to water, another research question concerns the examination of the mechanisms of multilevel protection of human rights, assessing whether the relationships between the different levels of protection can contribute to the realisation of this fundamental human right. The research analyses the main sources of law and jurisprudence of each examined context, to understand the legal basis for the recognition of the human right to water, considering both the necessary protection of environmental aspects, as well as social and economic ones, fundamental for its full realisation. The analysis of normative and jurisprudential sources is supported by the examination of the most relevant doctrine.

Available in PDF, EPUB and Kindle. Book excerpt: First book to consider citizens playing a role in the science-policy interface to help formulate durable responses to sustainability challenges Discusses all aspects to enhance the connectivity of actors in the sustainable water management field, with three pilot case studies showing how citizens and stakeholders can be engaged early and effectively in the river basins and coastal waters planning processes Provides tips and recommendations for the transferability of the approach in different coastal areas of Europe and beyond. Sustainable Water Ecosystems Management in Europe examines the anthropogenic deterioration of water ecosystems, in particular in coastal areas. It proposes a new approach to enhance connectivity between research and policy-making. The book exploits the concept of integrated adaptive ecosystem management, by engaging scientists, policy makers and the public (the latter including both stakeholders and lay citizens/water users) in comparable case studies. Emphasis is given to the role of the public to enlarge the concept of organisational learning to the wider concept of social learning. The EC 7th Research Framework Program funded project AWARE engaged a panel of randomly selected citizens living in three different coastal areas of Europe – in a pilot experience of knowledge brokerage with water scientists and decision makers focused on coastal waters quality. Results and lessons learned from the project are summarized in this volume, and recommendations are made for this pilot’s replication and transferability to different coastal areas and sustainable water management tasks - and beyond to other sustainability research and policy issues. This book is a must-read for water managers and policy makers looking to effectively organize citizen and stakeholder participation in river basin and coastal water planning, as required by the EU Water Framework Directive. Sustainable Water Ecosystems Management in Europe provides useful recommendations for organising effective participation of citizens in the science and policy dialogue, promoting a collective awareness of the plans and actions needed to protect the water environment and ensure sustainable use of water resources. Book excerpt: In Transboundary Water Cooperation in Europe, Götz Reichert analyzes the multidimensional regime for the protection and management of European transboundary freshwater resources that is composed of international water law, the water law of the European Union, and domestic water legislation. Accordingly, qualitative and quantitative aspects regarding surface waters and groundwater are to be managed in an integrated manner to achieve “good water status” of rivers, lakes and aquifers. To this end, “international river basin management plans” provided for by the EU Water Framework Directive are developed by international river commissions for Europe’s major transboundary river basins. Götz Reichert analyzes the various dimensions of the regime including their legal interlinkages and considers the question of whether it is successful in achieving its ambitious goals.

Book excerpt: The European Communities adopted the Nitrates Directive on 12 December 1991 with the objective of reducing water pollution caused or induced by nitrates from agricultural sources and preventing further such pollution. It requires member states to designate as Nitrate Vulnerable Zones areas of land that drain into polluted waters and to set up action programmes in these zones. Nitrate pollution can also increase eutrophication, reduce biodiversity and affect the recreational value of water. The Department for Environment, Food and Rural Affairs (Defra) estimates that the cost of treating nitrates in drinking water between 2005 and 2010 will be £288 million in capital expenditure and £6 million a year in operating costs. Defra issued a consultation document on the Directive in 2007, and its proposed changes reflect the fact that the European Commission does not think the Directive was properly implemented in England. The proposals would have a significant impact on some 195,500 farmers in the affected areas, requiring them to alter practices for storing and spreading livestock manure and for applying chemical fertiliser. The Committee finds insufficient evidence to assess how effective the current action programme has been in reducing nitrate pollution in England. It welcomes some of Defra's proposals but has concerns about others. The proposed new action plan will place a considerable financial burden on livestock and dairy farmers, and Defra should make representations to the Treasury on the need for support in the form of tax relief for the construction of slurry storage facilities.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers the first comprehensive treatment of multi-level water governance, developing a conceptual and analytical framework that captures the complexity of real water governance systems while also introducing different approaches to comparative analysis. Applications illustrate how the ostensibly conflicting goals of deriving general principles and of taking context-specific factors into account can be reconciled. Specific emphasis is given to governance reform, adaptive and transformative capacity and multi-level societal learning. The sustainable management of global water resources is one of the most pressing environmental challenges of the 21st century. Many problems and barriers to improvement can be attributed to failures in governance rather than the resource base itself. At the same time our understanding of complex water governance systems largely remains limited and fragmented. The book offers an invaluable resource for all researchers working on water governance topics and for practitioners dealing with water governance challenges alike.

Book excerpt: This volume deals with the law governing the administrative implementation of European Union public policy. Much of this law is specific to individual policy sectors. The volume provides a study of such specialized admininstrative law for more than twenty sectors. This cross-sectoral approach allows for detailed comparisons of EU administration in diverse policy fields. It identifies situations where legal structures and approaches may be unnecessarily duplicated, thus indicating where a comprehensive, general system could be advantageous for both Union law and policy achievement. The comparative nature of the study also draws attention to policy fields which have proven to be testing grounds for approaches adopted subsequently in other areas. In addition, the work highlights the distinctive, highly networked, and strongly cooperative character of EU administration, as a reflection of, and a foundation for, the operative nature of the European Union as a whole.

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to legislation and practice concerning the environment in Denmark. A general introduction covers geographic considerations, political, social and cultural aspects of environmental study, the sources and principles of environmental law, environmental legislation, and the role of public authorities. The main body of the book deals first with laws aimed directly at protecting the environment from pollution in specific areas such as air, water, waste, soil, noise, and radiation. Then, a section on nature and conservation management covers protection of natural and cultural resources such as monuments, landscapes, parks and reserves, wildlife, agriculture, forests, fish, subsoil, and minerals. Further treatment includes the application of zoning and land-use planning, rules on liability, and administrative and judicial remedies to environmental issues. There is also an analysis of the impact of international and regional legislation and treaties on environmental regulation. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for environmental lawyers handling cases affecting Denmark. Academics and researchers, as well as business investors and the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative environmental law and policy.

Book excerpt: This book is an outcome from the International Expo 'Water and Sustainable Development' held in Zaragoza (Spain) in 2008. Support from the Spanish Ministry of Environment, Caja Rioja, Government of Aragon, and the World Bank is acknowledged. 'Few resources will play a more important role in shaping our economic future, or face more daunting challenges, than water. This internationally acclaimed team of experts has produced a first-rate volume that is full of intriguing, practical ideas for meeting those challenges in a rich variety of institutional settings.' Tom Tietenberg, Mitchell Family Professor of Economics, Emeritus, Colby College, USA 'This volume brings together two critical but interrelated dimensions of water challenge, i.e. water pollution, particularly from non-point sources, and water conservation. The editors are well known experts on the subject as are the contributors.' R. Maria Saleth, International Water Management Institute, Sri Lanka and Associate Editor, Water Policy 'The profound contribution of this volume is that it brings together various economic concepts and policy dilemmas regarding water shortages, non-point source pollution, efficiency of water use and irrigation technology. Recommended reading for anyone working in the area of water management.' Henk Folmer, University of Groningen and Wageningen University, The Netherlands As countries face deteriorating water and environmental quality as well as water shortages, pollution control and the efficiency of water use become of paramount importance. Agriculture is one of the main non-point polluters of water bodies and irrigation for agriculture is one of the main consumers of water. While it is very hard to regulate pollution from agriculture, attempts have been made via economic and command and control instruments, and also through investments in technologies and ecosystems recovery. Coping with non-point pollution takes the form of both policy intervention and technology development. Likewise it is recognized that irrigation efficiency varies across countries, influenced by both technology and supporting adoption policies. Countries that lead in irrigation technology and supporting policies have certain traits in common. They face very high scarcity and are pushed to find innovative solutions, both technical and policy related. The recent multibillion investments in irrigation technologies in Spain, and similar proposals in Australia, for example, highlight the potential of irrigation technologies to cope with scarcity and water quality degradation. This book reviews all of the above issues, presents experiences in selected countries, and assesses the degree of success of alternative policies for coping with non-point water pollution and improving irrigation efficiency.

Book excerpt: This report aims to support the development of a sound economic regulatory system for the water supply and sanitation (WSS) sector in the Republic of Moldova (hereafter “Moldova”). The prevailing policy framework calls for drastic developments in WSS to modernise and optimise WSS systems and improve operational efficiency (non-revenue water, staff-output ratios etc.) – in line with domestic and international commitments (including the Association Agreement with the European Union, the Sustainable Development Goals, the Paris Agreement and the national WSS strategy).
