Book excerpt: With a foreword by New York Times bestselling author and former confidante of Donald J. Trump, Michael Cohen, the official report of materials supporting the first-ever second impeachment of a President of the United States—complete with US Constitution included. In 2019, Donald Trump became only the third US President to be impeached by the House of Representatives on charges of abuse of power and obstruction of congress. In January 2021, he became the first President in American history to be impeached for a second time. Though no sitting president was ever convicted, will Trump be the first there, too? Still in the midst of the coronavirus pandemic, which the president has also been accused of handling poorly, and an ongoing refusal to concede his loss to rival candidate Joe Biden, Donald Trump is said to have provoked his followers to storm the US Capitol in Washington, DC, resulting in a shocking protest-turned-violent in an effort to stop the official Electoral count in certifying Biden's victory. The unprecedented event led to the deaths of at least five people, as well as the President being banned from all major social media, including Twitter, Facebook, Instagram, and more, due to risk of inciting more violence. This groundbreaking report—released by the House Judiciary Committee, chaired by Jerrold Nadler—covers Trump's conduct leading up to January 6, 2021, the attack on the capitol, his response to the insurrection, and provides a compelling argument as to why there is an immediate need to consider impeachment despite Trump having only seven days left in office.

Book excerpt: The Constitution grants the House of Representatives the "sole Power of Impeachment," not merely as a safeguard for the nation between elections, but also in cases where the removal of the President is urgent and necessary to preserve the security of the constitutional order. The House must invoke this power now to impeach President Trump for inciting an insurrection on January 6, 2021. President Trump engaged in high Crimes and Misdemeanors when he urged his supporters to storm the United States Capitol Building and then failed to stop the ensuing violence. His actions marked the culmination of an extensive and unprecedented effort to overturn the results of the presidential election. As alleged in the Article of Impeachment and described in this report, President Trump has acted in a manner grossly incompatible with self-governance and the rule of law. His continued hold on the Office of the Presidency, even for only a few more days, represents a clear and present danger to the United States.

Book excerpt: House Judiciary Committee Chairman Jerrold Nadler released a majority staff report for the impeachment of President Donald J. Trump. The report details the history, purpose and meaning of the Constitution’s Impeachment Clause, and establishes that President Trump’s conduct as set forth in the Article of Impeachment satisfies the standard for high Crimes and Misdemeanors. The majority staff of the House Judiciary Committee have prepared today’s report for the use of the House Rules Committee to accompany H. RES. 24, Impeaching Donald John Trump, President of the United States, For High Crimes and Misdemeanors. "President Trump has falsely asserted he won the 2020 presidential election and repeatedly sought to overturn the results of the election. As his efforts failed again and again, President Trump continued a parallel course of conduct that foreseeably resulted in the imminent lawless actions of his supporters, who attacked the Capitol and the Congress. This course of conduct, viewed within the context of his past actions and other attempts to subvert the presidential election, demonstrate that President Trump remains a clear and present danger to the Constitution and our democracy. The House must reject this outrageous attempt to overturn the election and this incitement of violence by a sitting president against his own government. President Trump committed a high Crime and Misdemeanor against the Nation by inciting an insurrection at the Capitol in an attempt to overturn the results of the 2020 Presidential Election. The facts establish that he is unfit to remain in office a single day longer and warrant the immediate impeachment of President Trump

Available in PDF, EPUB and Kindle. Book excerpt: This book argues that the Constitution has a dual nature. The first aspect, on which legal scholars have focused, is the degree to which the Constitution acts as a binding set of rules that can be neutrally interpreted and externally enforced by the courts against government actors. This is the process of constitutional interpretation. But according to Keith Whittington, the Constitution also permeates politics itself, to guide and constrain political actors in the very process of making public policy. In so doing, it is also dependent on political actors, both to formulate authoritative constitutional requirements and to enforce those fundamental settlements in the future. Whittington characterizes this process, by which constitutional meaning is shaped within politics at the same time that politics is shaped by the Constitution, as one of construction as opposed to interpretation. Whittington goes on to argue that ambiguities in the constitutional text and changes in the political situation push political actors to construct their own constitutional understanding. The construction of constitutional meaning is a necessary part of the political process and a regular part of our nation's history, how a democracy lives with a written constitution. The Constitution both binds and empowers government officials. Whittington develops his argument through intensive analysis of four important cases: the impeachments of Justice Samuel Chase and President Andrew Johnson, the nullification crisis, and reforms of presidential-congressional relations during the Nixon presidency.

Book excerpt: The complete riveting transcript of the historic case against the president for igniting the January 6 siege of the Capitol Prosecution of an Insurrection is the complete, riveting transcript of the historic case against President Donald J. Trump for igniting the January 6 siege of the Capitol. Following the norm-shattering attempt by his followers to disrupt the peaceful transfer of power, the second impeachment trial of the president seared a new lexicon into our collective consciousness and marked a watershed moment in American history. The case, presented to the Senate by impeachment managers from the House, marked a bravura performance by members of Congress who were themselves the targets of the rioters incited by the president only days earlier. Citizens disturbed by the events of January 2021 and Republican attempts to rewrite history will find in these pages the most authoritative record of one of our democracy’s darkest hours, including: • The official articles of impeachment against the president for incitement of an insurrection • The response of President Trump to the articles of impeachment, on behalf of the House defense lawyers • The complete trial transcript, including the full text of the arguments made by the House representatives and the full text of the president’s defense • Headshots from the trial of all nine House impeachment managers in action, including lead manager Representative Jamie Raskin, as well as all three House defense lawyers • Photographs, timelines, and screenshots of tweets entered as evidence, as well as stills from the videos presented Prosecution of an Insurrection preserves for posterity an episode that ranks with the McCarthy hearings, Watergate, and the Iran-Contra investigation for its importance in American political history.

Book excerpt: "Read this book and learn how best to protect our democracy." --Tom Steyer, founder of Need To Impeach The reasons Donald Trump must be impeached — as per the Founding Fathers — and what you can do to help make that happen Three veteran constitutional attorneys say there’s no way around it: The Constitution demands that Donald Trump must be impeached. And in clear language using compelling logic rooted firmly in the Constitution, they detail why the time to start is now—not in the indefinite future after criminal investigations have ended. In fact, much of Trump’s impeachable conduct lies outside the scope of ongoing federal criminal investigations. Citing charges such as accepting illegal payments from foreign governments, using government agencies to persecute political enemies, obstructing justice, abusing the pardon power, and the undermining freedom of the press, they provide the factual and legal basis for eight articles of impeachment. In short, they argue, abuses threatening our constitutional democracy should be dealt with by the remedy that the Constitution provides for a lawless, authoritarian president: impeachment. And an informed citizenry should be part of the process. After all, they say, impeachment is not a constitutional crisis — impeachment is the cure for a constitutional crisis.
