Book excerpt: In this report the Treasury Committee calls on the Financial Services Agency (FSA) to delay implementing new rules on the provision of financial advice for 12 months to allow advisers more time to comply. The Committee backed plans to ban commission on advised sales and impose higher professional standards on independent financial advisers, subject to flexibility on a case-by-case basis, but were concerned that a substantial exodus of experienced advisers from the market could harm consumer choice. The FSA's Retail Distribution Review (RDR) is a major reform of the regulation of retail investment advice and is due to come into force on 1 January 2013. It will require advisors to have qualifications equivalent to a Certificate in Higher Education and remove the system of commission paid to advisors and replace it with Consumer Agreed Remuneration. The committee believes a delay of 12 months in the implementation of the RDR will reduce the number of Independent Financial Advisors leaving the market - thus maintaining choice and competition for consumers. The MPs also call on the FSA to provide some flexibility for advisers on a case by case basis. The FSA is to be replaced by the proposed Financial Conduct Authority (FCA). This Treasury Committee believes that this provides an opportunity to examine the accountability mechanisms that will apply under the new system of financial regulation and will instigate an inquiry on this in due course

The RDR was launched in 2007 with the underlying aim to improve retail distribution through market-led solutions supported by regulation where necessary. The RDR targeted at three main problem areas: Labeling of advisory service (independent/restricted), Remuneration (including ban on commissions) and Professionalism (minimum qualification and maintaining of knowledge). The article describes the initial situation in the UK investment market, main problems identified by the Financial Services Authority, main building blocks of both the RDR and Thoresen Review of Generic Financial Advice, implementation of the RDR and its European legal dimension. The article further analyses the impacts of the RDR implementation using qualitative analysis. Particular attention is paid to the advice gap as one of the consequences. The article also discusses the possibility of RDR implementation in the Czech financial market. This article reflects state of affairs as per the end of March 2014.

Book excerpt: Current policy is that new duties will be staged in between 2012 and 2016, requiring all employers to designate a pension scheme into which all of their employees, aged between 22 and state pension age, should be automatically enrolled, so long as they are earning above an annual earnings threshold (the Pensions Act 2008 sets this at £5,035, equivalent to £5,732 in today's terms). Upon automatic enrolment, a minimum of eight per cent of earnings within a band would be contributed to the pension, with at least three per cent coming from the employer. This policy is designed to maximise private pension saving by individuals without imposing compulsion. The right to opt out will remain. This review looks at the scope of automatic enrolment and whether a new national pension scheme (National Employment Savings Trust or NEST) needs to be put in place for it to work. One of the most significant recommendations that it makes is that people should only be automatically enrolled once they reach the income tax threshold (which will increase to £7.475 in 2011) but that contributions should be on earnings in excess of the National Insurance earnings threshold (£5,715 in today's prices). There should be no changes to age thresholds and automatic enrolment duties should apply to all employers, regardless of size, as now. Employers should be given three months before auto-enrolment to ease the burden on companies. If staff choose to enrol before the three month period then companies will have to make contributions
