Available in PDF, EPUB and Kindle. Book excerpt: Brazilian immigration policy faced some deep changes in the last few years due to the development of a new legal system regarding this matter. The previous migration law date back from the 1980s, during a totalitarian civil-military regime and, despite the rebirth of democracy in 1988, this law remained in place for almost four decades. Because of that historical moment, the past immigration policy was focused on national public security and economic development. In contrast, the current law established human rights as one of the principles and guidelines of the Brazilian migration policy. Therefore, this book debates the extent to which a shift in the immigration law in Brazil has happened, moving away from the perspective of immigrants as threats towards seeing them as subjects of rights.

Available in PDF, EPUB and Kindle. Book excerpt: This book employs methods from comparative law to analyze voluntary migration, exploring the free movement of immigrants and their freedom of settlement under Brazilian and Mercosul law, as well as under German law and the European Union’s legal framework on migration. It discusses the level of protection granted to immigrants in terms of their right to enter and stay in Brazil and Mercosul, using German legislation and the EU’s legal framework on migration for comparison. Accordingly, the book will help migration researchers to understand not only the structure and rationale of migration law in Brazil, especially after the entry into force of its recent Migration Law in 2017, but also its relation to EU and German provisions on voluntary migration. It demonstrates how the differing natures of the migration law adopted by Brazil and Germany have led to different approaches and, consequently, different levels of protection for immigrants.

Book excerpt: It amounts to a truism to say that amongst the great problems left by the Second Great War very few called for national and international planning so urgently as the problem of human migrations. During and after the conflicts a mass displacement of population was brought to be ar heavilyon the demographie situation of Western Europe. On the other hand, in the turmoil of the aftermath some western countries came to lose, one by one, their Afriean and Asiatic colonies, and were in consequence deprived of an outlet for their surplus population. The economic implications of the problem were tremendous. Where to find a remedy to such a tragie situation? I would not venture to say that large scale migrations are like ly to bring about, all by themselves, a harmonious distribution of population. It must be recognized, nevertheless, that economists and geographers alike are ready to admit that this problem, and the problem of economic pressure whieh derives therefrom, cannot be satisfactorily settled unless a weIl devised policy of regulation is set up, in order to bring all manpower available doser to the natural resources of wealth. It follows that in the present days the migration policy of any given country has to be considered in the light of international co-operation. This planetary vision of all great human problems is a welcome sign of our times.

Book Synopsis Voluntary and Forced Migration in Latin America by : Natalia Caicedo Camacho
Download or read book Voluntary and Forced Migration in Latin America written by Natalia Caicedo Camacho and published by McGill-Queen's Press - MQUP. This book was released on 2022-09-15 with total page 405 pages. Available in PDF, EPUB and Kindle. Book excerpt: Latin America provides a compelling case for the study of migration policies and laws, with several factors – including both internal and interregional migration and refugee flows, the region’s progressive approach to the management of human mobility, and several forced displacement crises of the contemporary era – offering unique insights. Despite the region’s heterogeneous migration flows and unique immigration and refugee laws, the academic literature has thus far lacked in-depth explorations of migration policy in Latin America. Voluntary and Forced Migration in Latin America presents a comparative analysis of the migration legislation of Argentina, Brazil, Chile, Colombia, Ecuador, Mexico, and Peru. For each country, the collection provides a historical overview of the evolution of migration legislation, an analysis of the migration flows and types of migrant profiles, and an examination of the country’s current immigration, asylum, and nationality legislation. The primary regional and international mechanisms that facilitate a normative approach to voluntary and forced migration, as well as to migrant and refugee rights, are also thoroughly interrogated. Situating itself in the often progressive immigration policies of Latin America, Voluntary and Forced Migration in Latin America offers alternative solutions for other countries facing migration challenges in different contexts.

Book Synopsis Racial Subordination in Latin America by : Tanya Katerí Hernández
Download or read book Racial Subordination in Latin America written by Tanya Katerí Hernández and published by Cambridge University Press. This book was released on 2013 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are approximately 150 million people of African descent in Latin America yet Afro-descendants have been consistently marginalized as undesirable elements of the society. Latin America has nevertheless long prided itself on its absence of U.S.-styled state-mandated Jim Crow racial segregation laws. This book disrupts the traditional narrative of Latin America's legally benign racial past by comprehensively examining the existence of customary laws of racial regulation and the historic complicity of Latin American states in erecting and sustaining racial hierarchies. Tanya Katerí Hernández is the first author to consider the salience of the customary law of race regulation for the contemporary development of racial equality laws across the region. Therefore, the book has a particular relevance for the contemporary U.S. racial context in which Jim Crow laws have long been abolished and a "post-racial" rhetoric undermines the commitment to racial equality laws and policies amidst a backdrop of continued inequality.
