Book excerpt: Recent leading cases have demonstrated the urgent need to modernize the learning on breach of trust, which has lagged behind the flourishing scholarship on the creation of trusts. Since breach of trust or fiduciary duty occupies the centre of the legal stage, it comes as a surprise that, although one or two novelists have chosen 'Breach of Trust' as the title to their book, no lawyer has so far thought it necessary to produce a specialized work on the subject. To fill the gap, this book, written by a team of leading trust lawyers from a number of common law jurisdictions, investigates all the principal aspects of the subject. The nature of the trustee's duties and of the liability for breach is closely examined, and all available defences and excuses are reviewed. Two substantial chapters consider the consequences of assisting a breach or receiving trust property from a trustee acting in breach. The book closes with a critical overview of the entire topic. CONTENTS: 1 Robert Chambers 'Liability for Breach'; 2 Joshua Getzler 'The Duty of Care'; 3 Edwin Simpson 'The Conflict of Interest'; 4 David Fox 'Overreaching'; 5 Lionel Smith 'Property Transferred in Breach'; 6 Charles Mitchell 'Assistance'; 7 Peter Birks 'Receipt'; 8 James Penner 'Exemption clauses'; 9 John Lowry and Rod Edmunds 'Honest and Reasonable Breach' ; 10 Jennifer Payne 'Consent'; 11 William Swadling 'Limitation'; 12 Gary Watt 'Laches, Estoppel and Election'; 13 David Hayton 'An Overview'.

Download or read book World Development Report 2019 written by World Bank and published by World Bank Publications. This book was released on 2018-10-31 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: Work is constantly reshaped by technological progress. New ways of production are adopted, markets expand, and societies evolve. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Book excerpt: During the first two-thirds of the 20th century the themes of sectorial structure and compared performance prevail in Italian economic historiography. In contrast, in the last part of the century attention is focused on the behavior of single economic actors and their micro-economic strategies. This book intends to act as a bridge between the two approaches, and reconstructs the secular journey of Italian industrial enterprise through an original study.

Book Synopsis Evidence-Based Public Health by : Ross C. Brownson
Download or read book Evidence-Based Public Health written by Ross C. Brownson and published by Oxford University Press. This book was released on 2010-12-03 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are at least three ways in which a public health program or policy may not reach stated goals for success: 1) Choosing an intervention approach whose effectiveness is not established in the scientific literature; 2) Selecting a potentially effective program or policy yet achieving only weak, incomplete implementation or "reach," thereby failing to attain objectives; 3) Conducting an inadequate or incorrect evaluation that results in a lack of generalizable knowledge on the effectiveness of a program or policy; and 4) Paying inadequate attention to adapting an intervention to the population and context of interest To enhance evidence-based practice, this book addresses all four possibilities and attempts to provide practical guidance on how to choose, carry out, and evaluate evidence-based programs and policies in public health settings. It also begins to address a fifth, overarching need for a highly trained public health workforce. This book deals not only with finding and using scientific evidence, but also with implementation and evaluation of interventions that generate new evidence on effectiveness. Because all these topics are broad and require multi-disciplinary skills and perspectives, each chapter covers the basic issues and provides multiple examples to illustrate important concepts. In addition, each chapter provides links to the diverse literature and selected websites for readers wanting more detailed information. An indispensable volume for professionals, students, and researchers in the public health sciences and preventative medicine, this new and updated edition of Evidence-Based Public Health aims to bridge research and evidence with policies and the practice of public health.

Book Synopsis Multinational Enterprises, Foreign Direct Investment and Growth in Africa by : Bernard Michael Gilroy
Download or read book Multinational Enterprises, Foreign Direct Investment and Growth in Africa written by Bernard Michael Gilroy and published by Springer Science & Business Media. This book was released on 2006-03-30 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: How can Africa, the world’s most lagging region, benefit from globalisation and achieve sustained economic growth? Africa needs greater investment by Multinational Enterprises (MNEs) to improve competitiveness and generate more growth through positive spill-over effects. Despite the fact that Africa’s returns on investment averaged 29% since 1990, Africa has gained merely 1% of global Foreign Direct Investment (FDI) flows. The challenge for African countries is how to be a more desirable destination for FDI. The study integrates three currents of economic research, namely from the literature on (endogenous) economic growth, convergence and regional integration, the explanations for Africa’s poor growth and the growing understanding of the role of MNEs in a global economy. The empirical side of the book is based on an econometric study of the determinants of FDI in Africa as well as a detailed firm-level survey conducted in 2000.

Book Synopsis (Re)writing History in Byzantium by : Panagiotis Manafis
Download or read book (Re)writing History in Byzantium written by Panagiotis Manafis and published by Routledge Research in Byzantine Studies. This book was released on 2021-12-13 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scholars have recently begun to study collections of Byzantine historical excerpts as autonomous pieces of literature. This book focuses on a series of minor collections that have received little or no scholarly attention, including the Epitome of the Seventh Century, the Excerpta Anonymi (tenth century), the Excerpta Salmasiana (eighth to eleventh centuries), and the Excerpta Planudea (thirteenth century). Three aspects of these texts are analysed in detail: their method of redaction, their literary structure, and their cultural and political function. Combining codicological, literary, and political analyses, this study contributes to a better understanding of the intertwining of knowledge and power, and suggests that these collections of historical excerpts should be seen as a Byzantine way of rewriting history. Download or read book Anaesthesia written by Joseph Rupreht and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 676 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thesiologist, were not included. Perhaps the next symposium will have a paper on his many contributions. Even though his dates are not quite modem (1813-1858), his accomplishments were, especially his book On Chloroform and Other Anaesthetics (1858), the first comprehensive textbook on anaesthesia [2]. There has been a real renaissance of interest in the history of anaesthesia. Among those responsible for this rebirth, besides Dr. Rupreht and Dr. Erdmann, are Dr. Selma Calmes and Dr. Rod Calverley, now on the Board of the new American society, the Anesthesia History Association. It held its inaugural meeting in Atlanta, Georgia, during the annual meeting of the American Society of Anesthesiologists, on 9 October 1983. The meeting was well attended, and the evening was profitable and delightful. Mention should also be made of the accomplishments of the nurse anaesthetists [3]. They are many in number, and generally they work under the direction of a physician anaesthesiologist. Although modem anaesthesia was Ameriea's first great medieal diseovery, it soon traversed the globe and found worldwide acceptance. The British, for example, have made many coeval and historie contributions. Besides Dr. Duncum one thinks of Prof. T. Cecil Gray, who pioneered the British use ofeurare [4], andDr. J. Alfred Lee, whowas a pioneerin the use ofspin~l anaesthesia and is currently working on the fifth edition of a textbook on spinal analgesia [7]. Dr.

Book Synopsis The Power to Arrest by : Robin S. Engel
Download or read book The Power to Arrest written by Robin S. Engel and published by Springer. This book was released on 2019-07-06 with total page 163 pages. Available in PDF, EPUB and Kindle. Book excerpt: This insightful volume examines key research questions concerning police decision to arrest as well as police-led diversion. The authors critically evaluate the tentative answers that empirical evidence provides to those questions, and suggest areas for future inquiry. Nearly seven decades of empirical study have provided extensive knowledge regarding police use of arrest. However, this research highlights important gaps in our understanding of factors that shape police decision-making and what is required to alter current police practice. Reviewing this research base, this brief takes stock of what is known empirically about all aspects related to the use of arrests, providing important insights on the knowledge needed to make evidence-based policy decisions moving forward. With the potential to better impact policy and programs for alternatives to arrest, this brief will appeal to researchers and practitioners in evidence-based policing and police decision-making, as well as those interested in alternatives to arrest and related fields such as public policy.
