I recenti interventi normativi hanno disegnato un procedimento ritualizzato e la previsione di termini perentori e di sanzioni collegate tanto alla loro violazione quanto al mancato o infruttuoso esercizio dell'azione disciplinare impongono una sempre maggiore specializzazione. I contributi della giurisprudenza di legittimità, ampiamente richiamati, hanno inciso fortemente nel delineare il procedimento nella sua conformazione attuale e nel disciplinarne alcuni istituti. I Ccnl di comparto sottoscritti sino a maggio del 2018, nella parte che qui interessa, vengono puntualmente esaminati. Il testo propone una trattazione organica della materia. Viene dapprima condotta una sintetica ricostruzione dell'evoluzione storica dell'istituto, necessaria a comprenderne la sua conformazione attuale. Si passa all'analisi di alcune violazioni di rilevanza disciplinare e delle diverse fonti da cui discendono gli obblighi da cui traggono origine. Vengono esaminate nel dettaglio le responsabilità particolari gravanti sul responsabile e sui membri dell'Ufficio procedimenti disciplinari. Sono accuratamente descritti i principi che governano il procedimento, siano essi di origine legale, giurisprudenziale o dottrinale. Si giunge alla trattazione del procedimento, esaminando dapprima gli organi, gli atti, la loro forma, i requisiti di legittimità, i termini perentori, le modalità di comunicazione, i diritti del lavoratore sottoposto al procedimento, le varie fasi dell'istruttoria, i vari tipi di provvedimenti cautelari (sospensione dal servizio obbligatoria e facoltativa; trasferimento o attribuzione ad altro incarico, collocamento forzato in aspettativa o disponibilità), la sospensione, l'estinzione e la riapertura del procedimento disciplinare, i criteri di valutazione del fatto e definizione della sanzione, l'istituto della recidiva, l'incidenza delle sentenze penali di assoluzione e di condanna. Viene poi condotta l'analisi degli effetti sul rapporto di lavoro delle pene accessorie a condanna penale come l'interdizione temporanea e perpetua dai pubblici uffici e l'estinzione del rapporto di lavoro. Sono analizzati il procedimento disciplinare accelerato e quello di origine contrattuale. Infine, viene compiuto un breve excursus sul licenziamento disciplinare. Il testo è corredato di oltre 300 note contenenti utili riferimenti giurisprudenziali.
