Book excerpt: The Dept. of Homeland Security's (DHS's) U.S. Immigration and Customs Enforcement (ICE) is responsible for an effective worksite enforcement strategy to protect critical infrastructure, target employers who violate employment laws, and protect employment opportunities for the Nation's lawful workforce. In 2009, ICE revised its worksite enforcement strategy to prioritize identifying employers who knowingly hire illegal workers, arresting and removing illegal workers, and using all available civil and administrative tools to penalize and deter illegal employment. From FY 2009 through 2012, Congress allocated about $531 million to fund and implement ICE's worksite enforcement strategy. Over that same period, ICE's Homeland Security Investigations directorate conducted about 9,140 administrative inspections and issued about $31.2 million in civil fines to employers. This report determined whether ICE is meeting the requirements of the Immigration Reform and Control Act of 1986 through the administrative inspection process for its worksite enforcement strategy. Figures. This is a print on demand report.

Book excerpt: The opportunity for employment is one of the most important magnets attracting illegal immigrants to the United States. The Immigration Reform and Control Act (IRCA) of 1986 established an employment eligibility verification process and a sanctions program for fining employers for noncompliance. Few modifications have been made to the verification process and sanctions program since 1986, and immigration experts state that a more reliable verification process and a strengthened worksite enforcement capacity are needed to help deter illegal immigration. This testimony is based on GAO's August 2005 report on the employment verification process and worksite enforcement efforts. In this testimony, GAO provides observations on (1) the current employment verification process and (2) U.S. Immigration and Customs Enforcement's (ICE) priorities and resources for the worksite enforcement program and the challenges it faces in implementing that program.

Available in PDF, EPUB and Kindle. Book excerpt: Who controls American immigration policy? The biggest immigration controversies of the last decade have all involved policies produced by the President policies such as President Obama's decision to protect Dreamers from deportation and President Trump's proclamation banning immigrants from several majority-Muslim nations. While critics of these policies have been separated by a vast ideological chasm, their broadsides have embodied the same widely shared belief: that Congress, not the President, ought to dictate who may come to the United States and who will be forced to leave. This belief is a myth. In The President and Immigration Law, Adam B. Cox and Cristina M. Rodríguez chronicle the untold story of how, over the course of two centuries, the President became our immigration policymaker-in-chief. Diving deep into the history of American immigration policy from founding-era disputes over deporting sympathizers with France to contemporary debates about asylum-seekers at the Southern border they show how migration crises, real or imagined, have empowered presidents. Far more importantly, they also uncover how the Executive's ordinary power to decide when to enforce the law, and against whom, has become an extraordinarily powerful vehicle for making immigration policy. This pathbreaking account helps us understand how the United States ?has come to run an enormous shadow immigration system-one in which nearly half of all noncitizens in the country are living in violation of the law. It also provides a blueprint for reform, one that accepts rather than laments the role the President plays in shaping the national community, while also outlining strategies to curb the abuse of law enforcement authority in immigration and beyond.

Book excerpt: This report describes for the first time the totality and evolution since the mid-1980s of the current-day immigration enforcement machinery. The report's key findings demonstrate that the nation has reached an historical turning point in meeting long-standing immigration enforcement challenges. The question is no longer whether the government is willing and able to enforce the nation's immigration laws, but how enforcement resources and mandates can best be mobilized to control illegal immigration and ensure the integrity of the nation's immigration laws and traditions.

Although the United States has witnessed a sharp drop in illegal border crossings in the past decade alongside an enormous increase in government activities to prevent illegal immigration, there remains little understanding of the role enforcement has played. Better data and analyses to assist lawmakers in crafting more successful policies and to support administration officials in implementing these policies are long overdue.
