Book excerpt: Helps towards delivering construction projects on time by enabling better client-contractor communication. This publication will help towards delivering construction projects on time by enabling better client-contractor communication. The new contract allows the employer, usually with the assistance of the contractor, to set a clear target for the cost of the civil engineering works to be carried out, in order to avoid projects overrunning on cost and deadline. ICE's latest contract also encourages the contractor to be more closely involved in the project at an early stage, such as project design, and provides an incentive for the employer and contractor to share profit or loss if the costs differ from the original estimation. To utilise the Target Cost Version effectively, a more open style of control and management is required which will permit an early and joint approach to the identification and management of risks. This is intended to lead to better channels of communication at an early stage between client and contractor. The Target Cost version - the latest member of the ICE Conditions of Contract family - has been produced due to industry demand.

Available in PDF, EPUB and Kindle. Book excerpt: An Archaeological Investigation is usually undertaken to provide information: - In response to a proposed development which could cause damage to archaeological remains. - As part of the planning process (within the framework of appropriate national planning policy guidance notes) and/or development plan policy. - As part of an Environmental Impact Assessment. - Inconnection with management plans and mitigation strategies of private, local and national or international bodies. - Outside the planning process (e.g infrastructure projects, ecclesiastical developemtn, coastal erosion, agriculture, forestry and countryside management, works by public utilities and statutory undertakers) Where the Investigation finds Archaeological Remains they are recorded, analysed and interpreted and the findings disseminated as appropriate. These Conditions of Contract, the first of its kind, regulate the business relationship between the Employer and the specialist Archaeological Contractor during the course of an Arcaeological Investigation. The Contract retains a pattern traditional in civil engineering contracts, with an investigation commissioned by an Employer (Landowners, developers etc.), designed or approved by an Engineer and carried out by a specialist Archaeological Contractor, only that the term 'Consultant' is used instead of 'Engineer'. Its advantages include: - Providing parties to the Contract with and "advanced warning" of circumstances that may give rise to additional costs or delay or which may warrant a significant change tothe scope of the Investigation. - Enabling the niminisation of additional cost and/or delay as well as potential for dispute. - Minimising the incidence of disputes and resolving those that may arise in aspeedy and non-confrontational manner. On that basis that many archaeological contracts will fall within the provisions of Part 2 of the Housing Grants, Construction and Regeneration Act 1996, this Contract has been drafted to comply with the legislation with the intention that the variouw Statutory 'Schemes for Construction Contracts' should not apply.

Available in PDF, EPUB and Kindle. Book excerpt: Contracts for Infrastructure Projects: An International Guide provides a guide to the law relating to construction contracts for infrastructure projects; it is intended for the use of engineers and other professionals who are involved in the negotiation and administration of construction contracts, to enable them to understand the risks involved, and how to minimise them. The principles of construction law outlined in this book apply to small construction contracts as well as very large contracts for which the contract sum may be in the billions of dollars. The focus of the book is on construction contracts entered into by commercial organisations operating in a business environment. Contract law generally assumes that such parties are of equal bargaining power and puts relatively few fetters on their ability to agree on the terms of their bargain. However, where legislation impacts on the execution of construction projects or the operation of construction contracts it may be of major importance in protecting the rights of weaker parties or third parties. It is assumed that the users of this book will be familiar with the general concepts of tendering and contracting for engineering and construction projects but may not have any formal knowledge of the law. To the extent possible, the emphasis is on general principles of contract law that are widely accepted in many jurisdictions. Examples are drawn from case law in a number of common law jurisdictions, as well as from civil codes.

Topics covered include types of contract in civil engineering, general conditions of contract, insurances, and tender procedures. The powers, duties, and functions of the engineer and his representative are also considered. This book is comprised of 14 chapters and begins with an overview of the philosophy underlying the contract system in civil engineering, followed by a discussion on the promotion of civil engineering works. The reader is then introduced to types of civil engineering contracts; contract risk and contract responsibility; the application of contract documents; and general conditions of contract. The remaining chapters focus on contract specifications; bill of quantities and methods of measurement; principles and types of insurance; procedures for competitive bids or tenders; cost estimates, methods of pricing, and rate fixing; and claims on civil engineering contracts. The final chapter is devoted to arbitration and related procedure for the settlement of contract disputes. This monograph will be useful to practicing civil engineers who are involved with contract administration and to younger engineers who are aspiring to obtain professional qualifications.

Book excerpt: Although the legal principles involved in construction contracts and their management and administration are an aspect of general contract law, the practical and commercial complexities of the construction industry have increasingly made this a specialist field. Recognizing this, Construction Contracts is a fully revised edition of the UK’s leading textbook on the law governing this area. Brought up to date with recent cases and developments in the law as it stands at July 2000, this new edition: takes full account of the effects of the Housing Grants, Construction and Regeneration Act 1996, the Arbitration Act 1996, the Contracts (Rights of Third Parties) Act 1999 and the changes in the legal system brought about by the Woolf reforms includes extended coverage of financial protection, construction insurance and tendering controls, as well as the Construction (Design and Management) Regulations has been revised to take account of changes to the common standard-form contracts, particularly the New Engineering Contract and the GC/Works family of contracts. Retaining the same basic approach as its successful predecessors, this important text introduces the general principles that underlie contracts in construction, illustrating them by reference to the most important standard forms currently in use.

Book excerpt: The ICE Conditions continues to be the dominant form of contract for civil engineering, despite the growing importance of the New Engineering Contract. The Seventh Edition of the ICE Conditions, published in 1999, introduced a number of changes, including: incorporating some of the concepts of the Latham Report amending certain provisions of the Sixth Edition which had attracted criticism rectifying conspicuous omissions from the text of earlier editions of the contract correcting small errors and faults from the previous edition modernising certain provisions and terms Brian Eggleston, whose previous book on the ICE Conditions was described as 'likely to become the authoritative reference source for the Sixth Edition', examines the contract clause by clause from a practical and legal viewpoint. There is extensive coverage of case law. Written by an experienced civil engineer and recognized authority on construction contracts, this book is an essential guide.
