Congress enacted the TVPA in 2000, which requires the Secretary of State to report annually on governments' efforts according to the act's minimum standards for the elimination of trafficking. Each year since 2001, State has published the Trafficking in Persons Report, ranking countries into one of four tiers. GAO found in 2006 that the report did not fully describe State's assessment of compliance with standards or provide complete explanations for ranking decisions. The explanatory statement accompanying the Consolidated Appropriations Act, 2014, included a provision for GAO to review the report's preparation and effectiveness. This report addresses (1) the process to develop the report, (2) the extent to which country narratives discuss minimum standards, and (3) the extent to which State assesses the report's effectiveness as a tool to address trafficking. GAO compared 220 country narratives in the 2015 and 2016 reports with the minimum standards and analyzed 82 narratives for countries that changed tier. GAO also interviewed State and other officials. "

Book excerpt: Trafficking in persons (TIP) for the purposes of exploitation is believed to be one of the most prolific areas of international criminal activity and is of significant concern to the United States and the international community. According to Department of State estimates, roughly 800,000 people are trafficked across borders each year. If trafficking within countries is included in the total world figures, official U.S. estimates indicate that some 2 to 4 million people are trafficked annually. As many as 17,500 people are believed to be trafficked into the United States each year and some have estimated that 100,000 U.S. citizen (USC) children are victims of trafficking within the United States.. Since enactment of the Victims of Trafficking and Violence Protection Act of 2000 (TVPA, P.L. 106-386), the Administration and Congress have aimed to address TIP by authorizing new programs and reauthorizing existing ones, appropriating funds, creating new criminal laws, and conducting oversight on the effectiveness and implications of U.S. anti-TIP policy. Most recently, the TVPA was reauthorized through FY2011 in the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (P.L. 110-457). Obligations for global and domestic anti- TIP programs, not including operations and law enforcement investigations, totaled approximately $103.5 million in FY2009. Activity on combating TIP may continue into the 112th Congress, particularly related to efforts to reauthorize the TVPA. Ongoing international policy issues include how to measure the effectiveness of the U.S. and international responses to TIP, including the State Department's annual TIP rankings and the use of unilateral sanctions; and how to prevent known sex offenders from engaging in child sex tourism. Domestic issues that may arise include whether there is equal treatment of all victims-both foreign nationals and U.S. citizens, as well as victims of labor and sex trafficking; and whether current law and services are adequate to deal with the emerging issue of domestic minor sex trafficking (i.e., the prostitution of children in the United States). Other issues are whether to include all forms of prostitution (i.e., children and adults) in the definition of TIP, and whether sufficient efforts are applied to addressing all forms of TIP, including not only sexual exploitation, but also forced labor and child soldiers. On June 14, 2010, the State Department issued its 10th annual, congressionally mandated report on human trafficking. In addition to outlining major trends and ongoing challenges in combating TIP, the report provides a country-by country analysis and ranking, based on what progress foreign countries have made in their efforts to prosecute traffickers, protect victims, and prevent TIP. For the first time, the United States was included as one of the ranked countries. The report categorizes countries into four tiers according to the government's efforts to combat trafficking. Those countries that do not cooperate in the fight against trafficking (Tier 3) may be subject to U.S. foreign assistance sanctions. On September 13, 2010, President Barack Obama determined that two Tier 3 countries will be sanctioned for FY2011 without exemption (Eritrea and North Korea). In addition, he determined that four Tier 3 countries will be partially sanctioned (Burma, Cuba, Iran, and Zimbabwe). The 2010 TIP report also included for the first time, a list of six countries that recruit, use, or harbor child soldiers. Inclusion on this list subjects these countries to possible U.S. assistance sanctions.

Book excerpt: Human trafficking is a transnational crime whose victims include men, women, and children and may involve violations of labor, immigration, antislavery, and other criminal laws. To ensure punishment of traffickers and protection of victims, Congress passed the Trafficking Victims Protection Act of 2000 (TVPA), which is subject to reauthorization in 2007. The Departments of Justice (DOJ) and Homeland Security (DHS) lead federal investigations and prosecutions of trafficking crimes. As requested, this report discusses (1) key activities federal agencies have undertaken to combat human trafficking crimes, (2) federal efforts to coordinate investigations and prosecutions of these crimes, and (3) how the Bureau of Justice Assistance (BJA) supported federally funded state and local human trafficking task forces. GAO reviewed strategies, reports, and other agency documents; analyzed trafficking data; and interviewed agency officials and task force members. Since the enactment of the TVPA in 2000, federal agencies have (1) investigated allegations of trafficking crimes, leading to 139 prosecutions;(2) provided training and implemented state and local initiatives to support investigations and prosecutions; and (3) established organizational structures, agency-level goals, plans, or strategies. For example, agencies have trained new and current personnel on investigating and prosecuting trafficking in persons crimes through their agency training academies and centers, provided Web-based training, and developed and disseminated guidance on case pursuance. Agencies have also sponsored outreach and training to state and local law enforcement, nongovernmental organizations, and the general public through a toll-free complaint line, newsletters, national conferences, and model legislation. Finally, some agencies have established special units or plans for carrying out their antitrafficking duties. Federal agencies have coordinated across agencies on investigations and prosecutions of trafficking crimes on a case-by-case basis, determined by individual case needs, and established relationships among law enforcement officials across agencies. For example, several federal agencies worked together to resolve a landmark trafficking case involving over 250 victims. However, DOJ and DHS officials have identified the need to advance and expand U.S. efforts to combat trafficking through more collaborative and proactive strategies to identify trafficking victims. Prior GAO work on interagency collaboration has shown that a strategic framework that includes, among other things, a common outcome, mutually reinforcing strategies, and compatible polices and procedures to operate across agency boundaries can help enhance and sustain collaboration among federal agencies dealing with issues that are national in scope and cross agency jurisdictions. To support U.S. efforts to investigate trafficking in persons, BJA has awarded grants of up to $450,000 to establish 42 state and local human trafficking law enforcement task forces. BJA has funded the development of a train-the-trainer curriculum and a national conference on human trafficking and taken further steps to respond to task force technical assistance needs. Nevertheless, task force members from the seven task forces we contacted and DOJ officials identified continued and additional assistance needs. BJA does not have a technical assistance plan for its human trafficking task force grant program. Prior GAO work has shown the need for agencies that administer grants or funding to state and local entities to implement a plan to focus technical assistance on areas of greatest need. BJA officials said they were preparing a plan to provide additional and proactive technical assistance to the task forces, but as of June 2007 had not received the necessary approvals.

Victims are often lured or abducted and forced to work in involuntary servitude. Since 2001, the U.S. government has provided about $447 million to combat global human trafficking. As GAO previously reported, estimates of the number of trafficking victims are questionable. In this report, GAO examines (1) collaboration among organizations involved in international antitrafficking efforts, (2) U.S. government monitoring of antitrafficking projects and difficulties in evaluating these projects, and (3) suggestions for strengthening monitoring and evaluation. GAO analyzed agency documents; convened an expert panel; interviewed officials; and conducted fieldwork in Indonesia, Thailand, and Mexico. GAO recommends that the Secretaries of State and Labor and the Administrator of USAID consider taking actions to (1) improve information about project impact on human trafficking and (2) address monitoring and evaluation in project design. In their comments, State agreed to implement the recommendations. While agreeing that monitoring and evaluation are important, Labor and USAID did not directly respond to GAO's recommendations.

Intelligence reports pointed to sex trafficking and forms of forced labor as some of these organizations' largest sources of profit. The first efforts to address trafficking in persons focused heavily on combating the sex trafficking of women and girls. Academic reports and news articles illustrated the effect traffickers were having on individuals and communities around the world. In 1994, the Department of State began to monitor human trafficking as part of the Department's Annual Country Reports on Human Rights Practices, focusing exclusively on sex trafficking of women and girls. As the understanding of human trafficking expanded, the U.S. government, in collaboration with NGOs, identified the need for specific legislation to address how traffickers operate and to provide the legal tools necessary to combat trafficking in persons in all its forms.This year marks a major milestone-the 20th anniversary of the TIP Report. Twenty years ago, when the United States Congress passed the TVPA mandating this report, it signaled the U.S. government's resolve to fight human trafficking and marked a pivot from indignation to positive action. Whether used to raise awareness, spark dialogue, spur action, or create a system of accountability, the TIP Report has served to reinforce global anti-trafficking norms and ideals. At a time when many governments denied the existence of human trafficking in all its forms, the TIP Report became a standard-bearer for the principles enshrined in the TVPA and the UN Trafficking in Persons Protocol (Palermo Protocol).Throughout the last two decades, and as the availability of information on human trafficking has expanded, the TIP Report has grown in both its breadth and depth of analysis. It has consistently documented the efforts of an increasing number of governments to prosecute traffickers, protect victims, and prevent human trafficking crimes. The report has drawn attention to trends and emerging issues, highlighted promising practices, and tracked the progression of important developments, such as the passage of comprehensive anti-trafficking laws and improvements in victim identification efforts.Over the years, the methodology, content, and design of the TIP Report have evolved, reflecting in many ways the broader anti-trafficking movement's progress in understanding the crime. The message at the heart of each edition, however, has been steadfast: there is no excuse for human trafficking, and governments must address it with bold action.Most of all, the TIP Report has been, and continues to be, a critical tool in bringing governments to the table and encouraging them to prioritize human trafficking. Diplomats and advocates apply pressure on governments around the world to ensure they maintain focus and hear the voices of those directly affected. Today, the vast majority of governments acknowledge the devastating effects of human trafficking, and most governments have taken steps to combat it.The introduction this year will provide a look back at the evolution of the TIP Report. The ongoing opioid crisis lies at the intersection of two public health challenges: reducing the burden of suffering from pain and containing the rising toll of the harms that can arise from the use of opioid medications. Chronic pain and opioid use disorder both represent complex human conditions affecting millions of Americans and causing untold disability and loss of function. In the context of the growing opioid problem, the U.S. Food and Drug Administration (FDA) launched an Opioids Action Plan in early 2016. As part of this plan, the FDA asked the National Academies of Sciences, Engineering, and Medicine to convene a committee to update the state of the science on pain research, care, and education and to identify actions the FDA and others can take to respond to the opioid epidemic, with a particular focus on informing FDA's development of a formal method for incorporating individual and societal considerations into its risk-benefit framework for opioid approval and monitoring.

Italy has a mature and sophisticated AML/CFT regime, with a correspondingly well-developed legal and institutional framework. Financial sector supervisors have been using a risk-based approach to varying degrees, but their supervisory tools could be improved.
