Book excerpt: Has South Korea accomplished democratic consolidation since the Constitution was revised in 1987? Whereas political freedom has improved, the NSL is generally pointed out as the main obstacle to full freedom but it is not the only one to guarantee respect for human rights. Since full respect for human rights is not guaranteed, democratic consolidation has not been achieved. This book analyzes the issue based on the state of human rights that are an important part of democracy. The starting points are the 1948 UN Universal Declaration of Human Rights, the 1987 South Korean Constitution and the 2001 National Human Rights Commission (NHRC) Act which are empirically tested. Definitions of democratic consolidation are applied. The study first investiga- tes legislation and human rights institutions, including the National Security Law (NSL), the Con-stitutional Court, the NHRC, adherence to international human rights law and the Universal Periodic Review. Then the impact of inter-Korean relations on human rights are reviewed based on the NSL, dispatches of leaflets across the border and conscientious objectors. Finally, freedom of expression, assembly and association, including the state of sexual minorities, trials of ex-presidents, death penalty, human trafficking and torture are studied.

The contributors explore the transformation of Korean social movements from the democracy campaigns of the 1970s and 1980s to the rise of civil society struggles after 1987. South Korea was ruled by successive authoritarian regimes from 1948 to 1987 when the government decided to re-establish direct presidential elections. The book contends that the transition to a democratic government was motivated, in part, by the pressure from social movement groups that fought the state to bring about such democracy. After the transition, however, the movement groups found themselves in a qualitatively different political context which in turn galvanized the evolution of the social movement sector. Including an impressive array of case studies ranging from the women's movement, to environmental NGOs, and from cultural production to law, the contributors to this book enrich our understanding of the democratization process in Korea, and show that the social movement sector remains an important player in Korean politics today. As Hyun Ok Park demonstrates, rather than territorial integration and family union, the capitalist unconscious drives the current unification, imagining the capitalist integration of the Korean peninsula and the Korean diaspora as a new democratic moment. Based on extensive archival and ethnographic research in South Korea and China, The Capitalist Unconscious shows how the hegemonic democratic politics of the post-Cold War era (reparation, peace, and human rights) have consigned the rights of migrant laborers—protagonists of transnational Korea—to identity politics, constitutionalism, and cosmopolitanism. Park reveals the riveting capitalist logic of these politics, which underpins legal and policy debates, social activism, and media spectacle. The Mothers were female family members of political dissidents of varying backgrounds and ages—college students, political and religious leaders, writers, and factory workers. Women who initially had very little in common developed a bond as the days of their families’ detentions accumulated and their ordeals continued. This led them to form a quasi-organization prayer meeting group in the 1970s, which eventually developed into permanent Mothers’ organizations in the mid-1980s. The Mothers in this book include both the early- and late-comers to the movement, as the membership has undergone many changes since its inception in the 1970s. While the individual Mothers are the primary focus, this book explores beyond their individual concerns and activities. It discusses various methods the individual Mothers employed to promote their causes and attempts to study how the activities of the organizations founded by the inexperienced Mothers have affected the process of Korea’s democratization and how they remain active decades later.
