Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary. In the context of an effective democracy and respect for human rights mentioned in the Preamble to the European Convention on Human Rights, freedom of expression is not only important in its own right, but it also plays a central part in the protection of other rights under the Convention. Without a broad guarantee of the right to freedom of expression protected by independent and impartial courts, there is no free country, there is no democracy. This general proposition is undeniable. This handbook is a practical tool for legal professionals from Council of Europe member states who wish to strengthen their skills in applying the European Convention on Human Rights and the case law of the European Court of Human Rights in their daily work.

Book excerpt: The end of the Cold War has changed the shape of organized violence in the world and the ways in which governments and others try to set its limits. Even the concept of international conflict is broadening to include ethnic conflicts and other kinds of violence within national borders that may affect international peace and security. What is not yet clear is whether or how these changes alter the way actors on the world scene should deal with conflict: Do the old methods still work? Are there new tools that could work better? How do old and new methods relate to each other? International Conflict Resolution After the Cold War critically examines evidence on the effectiveness of a dozen approaches to managing or resolving conflict in the world to develop insights for conflict resolution practitioners. It considers recent applications of familiar conflict management strategies, such as the use of threats of force, economic sanctions, and negotiation. It presents the first systematic assessments of the usefulness of some less familiar approaches to conflict resolution, including truth commissions, "engineered" electoral systems, autonomy arrangements, and regional organizations. Book excerpt: Bohemia and Moravia, today part of the Czech Republic, was the first territory with a majority of non-German speakers occupied by Hitler’s Third Reich on the eve of the World War II. Tens of thousands of Jewish inhabitants in the so called Protectorate of Bohemia and Moravia soon felt the tragic consequences of Nazi racial politics. Not all Czechs, however, remained passive bystanders during the genocide. After the destruction of Czechoslovakia in 1938-39, Slovakia became a formally independent but fully subordinate satellite of Germany. Despite the fact it was not occupied until 1944, Slovakia paid Germany to deport its own Jewish citizens to extermination camps. About 270,000 out of the 360,000 Czech and Slovak casualties of World War II were victims of the Holocaust. Despite these statistics, the Holocaust vanished almost entirely from post-war Czechoslovak, and later Czech and Slovak, historical cultures. The communist dictatorship carried the main responsibility for this disappearance, yet the situation has not changed much since the fall of the communist regime. The main questions of this study are how and why the Holocaust was excluded from the Czech and Slovak history.
