The Government has still not dealt with earlier reports' conclusions about the Court of Justice of the European Union (CJEU) and its jurisdiction. What is more, the Government's general approach to the CJEU is not consistent with its decision to opt back into many other post-Lisbon police and criminal justice measures. The Government also needs to work flexibly with the European Commission in order to avoid any gaps in the application of the measures the UK will seek to rejoin. For example, we must ensure that rejoining the European Arrest Warrant is water-tight well in advance of the opt-out taking effect, to prevent problems for our criminal justice system. The report also recommends that the Government conduct a review of the impact of the opt-out decision three years after it has taken effect, and report its conclusions to Parliament

This book explores these changes to counter-terrorism laws and policies in the UK and Canada in order to demonstrate that despite the force of international legal instruments, including the heavily scrutinized UN Security Council Resolution 1373, the evolution of counter-terrorism policies in different jurisdictions is best analyzed and understood as a product of local institutional structures and cultures. The book compares legal and political structures and cultures within Canada and the United Kingdom. This is likely to involve dealing with the consequences of traumatic events in a foreign language in the context of a very different legal system.Until recently the EU has done little to protect the rights of defendants and victims caught up in crime with a cross-border dimension. However the Lisbon Treaty has opened the way for this to be put right and two Roadmaps of planned legislation are now in place, for defendants and for victims.In this Report the Committee looks at the early Roadmap proposals and examines the potential benefit that they can possibly bring. Also examined is the disadvantage of potential disruption to diverse and sensitive national criminal law systems.There is significant benefit to be gained from EU legislation setting minimum rights for defendants and victims, particularly for British citizens travelling within the EU. However, those minimum rights must be firmly grounded in international law norms, to minimise the risk of disrupting the UK criminal law systems.Although the Commission is looking towards a more expansive EU criminal law policy The Committee considers that the Roadmap legislation should be put in place and its impact assessed before moving forward any further. It encourages the Government to take a positive approach in principle to exercising the UK opt-in to Roadmap legislation

The block opt-out covers 130 EU police and criminal justice measures which had been adopted prior to 1 December 2009, the date of the entry into force of the Lisbon Treaty. The Committee has also set out: (i) That there are many problems with the European Arrest Warrant, in its existing form, in particular that it is on a system of mutual recognition of legal systems which in reality vary significantly; (ii) The Committee welcomes and supports the Government's reform package for the arrest warrant; (iii) The Committee recommends separate votes on the arrest warrant to the rest of the opt-in package at an early stage to provide a parliamentary mandate for the Government's negotiations.; (iv) The Committee concludes that if the Government proceeds with the opt-in as proposed, it will not result in any repatriation of powers. Indeed, the increased jurisdiction of the European Court of Justice may result in a net flow of powers in the opposite direction.

Book excerpt: This is the 29th report of the European Union Committee from the 2007-08 session (HLP 183, ISBN 9780104013700) and looks at Europol (the European Police Office) and its efforts in coordinating the fight against serious and organised crime. Europol began in 1999 and will, by 2010 be established as an agency of the EU. The Council Decision bringing about this change in its constitution has made some amendments to its powers, working methods and governance, but in the Committee's view represents a missed opportunity. The Committee finds it is a matter of concern that four-fifths of the information exchanged by national liaison officers stationed at Europol is exchanged without actually going through Europol and is therefore not added to Europol's database. Member States are reluctant to share sensitive information. The Committee believes that Member States should station at Europol only officers and officials with a high security clearance. A success for Europol has been the analysis of information to help investigate particular caregories of crime and following the UK's influence in focusing on organised crime in particular. The Committee believes that other Member States need to be persuaded on the importance of planning for future threats. The Committee also believes that the existing structure for the governance and management of Europol could be enhanced by clarifying the respective duties of the Director and Management Board. Further, the Committee states that if the Treaty of Lisbon came into force, accountability of Europol to the European Parliament and national parliaments would improve.
