Book excerpt: Home rule powers are essential parts of the American governing process, but they vary widely from state to state. This authoritative reference work examines the powers and functions of municipalities and counties that operate under home rule within each state. For example, the ability of a local municipality to raise taxes, annex land, or impose regulations is determined by their home rule powers from the states. This volume provides a reliable reference work for researchers and students - a single source that readers can trust for information about: The actions that local governments can - and cannot - pursue States where power is centralized at the capital and where it is not How home rule varies within each state by governmental function Trends in important issues such as taxes, land annexation, and citizen access. The editors organized the book in three parts: an overview of American home rule, including its history; a state-by-state description of home rule authority; and a comparative appendix that allows readers a quick reference source of powers by state. A scholar or governmental expert was selected in each state to prepare the state descriptions. Each chapter follows the same outline of content that allows easy comparison between states. In an era of power and responsibilities devolving from the national government to states and localities, the use of home rule powers has become increasingly important to the health of American government and federalism. Researchers and interested citizens will benefit from this comprehensive reference. Home Rule in America was directed by Dale Krane of the department of public administration, University of Nebraska, Omaha; Platon N. Rigos, department of government and international affairs, University of South Florida; and Melvin Hill, the Vinson Institute of Government, University of Georgia.

Book excerpt: Excerpt from State and Municipal Government in the United States In spite of the importance and interest of international and national questions of policy and in spite of the rapidly widening sphere of federal legislation and administration the life of an American citizen is affected more often by the agencies of local government than by those of the national government. Under the protection of the Federal Constitution the life and property of the citizen are governed and protected by state, not federal, laws. In his political capacity the citizen takes part in both the federal and the local government in accordance with state regulations. Acting under the state laws are the particular political units in which the citizen may reside - the county, city, or town. To the authorities of these the citizen most fre quently looks for governmental support and regulation. Yet these local bodies are distinctly subordinate to and created by the authority of the state and are supervised and regulated by it. It is the purpose of this book to discuss the organization, the distribution of powers and functions, and the operation of these agencies of local government. Other books have dealt with state government and state administration or with munici pal government and municipal administration, but this book covers both state and municipal government, treating the two as a single manifestation of local government. With this in mind the book has been divided into five parts. In Part I the federal system and the state constitutions as the fundamental basis of local government are discussed. Part II deals with the political system - the electorate in theory and in action, in primaries, in election campaigns, and in its direct action in the use of the initiative, referendum, and recall. Part III deals with state government - the different organs and the functions which these organs perform. State administration, which is rapidly being extended both directly and through the supervisory power of the state, is discussed in its various manifestations. Book excerpt: Excerpt from Municipal Home Rule: A Study in Administration The unsatisfactory character of American mu nicipal government has, within the past few years, drawn unusual attention to the problems which it presents, and which, on account of the recent extraordinary development of municipal life, are becoming at the same time more numerous and more important. But as a result of the intimate connection of municipal with general government, all concrete attempts at municipal reform must of necessity depend upon an accurate delimitation of the sphere of action, which can, with due regard to the interests of the state as a whole, be assigned to our municipal organizations. The attempt to delimit such a sphere of action is the purpose of this little work. The science of municipal gov ernment in this country is, however, in such an early stage of development, and as a result, the theories with regard to municipal reform are so various, and indeed, so conflicting, that it has been thought wise to leave the realm of theories, based on a priori reasoning, and to endeavour in the delimitation of the sphere of municipal home rule, which it has been attempted to make, to find out exactly what is, by the present American law.
