Book excerpt: Excerpt from History of the Juridical Society of Edinburgh After the discourse had been read, every member in his turn was required to deliver his opinion on the subject and also on the manner in which it had been treated. The President of the day was required to be always well prepared on the subject Of discourse, and to deliver his opinion thereon after all the other members. In June 1778 the discourses were discon tinued, and in place Of them the text only was read by the members, in their order on the roll, the mem ber reading having, at the same time, right to make such remarks as Should occur to him, and the discus sion then proceeding as formerly. Book Synopsis An Historical Introduction to Modern Civil Law by : Thomas Glyn Watkin
Download or read book An Historical Introduction to Modern Civil Law written by Thomas Glyn Watkin and published by Routledge. This book was released on 2017-07-05 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: The civil law systems of continental Europe, Latin America and other parts of the world, including Japan, share a common legal heritage derived from Roman law. However, it is an inheritance which has been modified and adapted over the centuries as a result of contact with Germanic legal concepts, the work of jurists in the mediaeval universities, the growth of the canon law of the western Church, the humanist scholarship of the Renaissance and the rationalism of the natural lawyers of the seventeenth and eighteenth centuries. This volume provides a critical appreciation of modern civilian systems by examining current rules and structures in the context of their 2,500 year development. It is not a narrative history of civil law, but an historical examination of the forces and influences which have shaped the form and the content of modern codes, as well as the legislative and judicial processes by which they are created are administered.

Book Synopsis The Documentary History of the Supreme Court of the United States, 1789-1800: The justices on circuit, 1790-1794 by : Maeva Marcus
Download or read book The Documentary History of the Supreme Court of the United States, 1789-1800: The justices on circuit, 1790-1794 written by Maeva Marcus and published by Columbia University Press. This book was released on 1985 with total page 652 pages. Available in PDF, EPUB and Kindle. Book excerpt: Volume 2 details the workings of the Court's experimental practice of sending Justices around the country to serve as judges at sessions of the various federal circuit courts. The documents in this volume reveal that the justices quickly voiced bitter complaints about the demands of their circuit duties. They also questioned the propriety--and perhaps constitutionality--of assigning the same individuals to act as superior and inferior court judges. The documents in this volume also touch upon topics that figured prominently in the law and politics of the era: neutrality, the boundary between state and federal crimes, the constitutional prohibition against impairing the obligations of contracts, and the relationship between law and morality.

Download or read book Publications of the Scottish History Society, Vol. 48 written by and published by Forgotten Books. This book was released on 2017-10-12 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Publications of the Scottish History Society, Vol. 48: Justiciary Court Proceedings For a long period there were two Justiciars, one for the north, the other for the south of Scotland, the river Forth being the dividing line. Edward I., indeed, appointed eight, having made four divisions of the country, and given two to each. In Queen Mary's time, however, there was a reversion to the old plan of having only one official for both north and south. It was characteristic of our Scottish way of doing things that the office originally conferred upon an individual came to be vested in a great feudal family, and the duties nominally exercised by the representative of that family. This state of matters continued long after the institution of the Court of Justiciary, and indeed down to 1836, when, by statute, the offices of Justice General and that of Lord President of the Court of Session were united in the person of a professional and salaried judge. Book Synopsis Priests of the Law by : Thomas J. McSweeney
Download or read book Priests of the Law written by Thomas J. McSweeney and published by Oxford University Press. This book was released on 2019-11-21 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Priests of the Law tells the story of the first people in the history of the common law to think of themselves as legal professionals. In the middle decades of the thirteenth century, a group of justices working in the English royal courts spent a great deal of time thinking and writing about what it meant to be a person who worked in the law courts. This book examines the justices who wrote the treatise known as Bracton. Written and re-written between the 1220s and the 1260s, Bracton is considered one of the great treatises of the early common law and is still occasionally cited by judges and lawyers when they want to make the case that a particular rule goes back to the beginning of the common law. This book looks to Bracton less for what it can tell us about the law of the thirteenth century, however, than for what it can tell us about the judges who wrote it. The judges who wrote Bracton - Martin of Pattishall, William of Raleigh, and Henry of Bratton - were some of the first people to work full-time in England's royal courts, at a time when there was no recourse to an obvious model for the legal professional. They found one in an unexpected place: they sought to clothe themselves in the authority and prestige of the scholarly Roman-law tradition that was sweeping across Europe in the thirteenth century, modelling themselves on the jurists of Roman law who were teaching in European universities. In Bracton and other texts they produced, the justices of the royal courts worked hard to ensure that the nascent common-law tradition grew from Roman Law. Through their writing, this small group of people, working in the courts of an island realm, imagined themselves to be part of a broader European legal culture. They made the case that they were not merely servants of the king: they were priests of the law.
