Excerpt: ...the recovery of a mining title, or for damages to any such title, shall be affected by the fact that the paramount title to the land on which such mines lie is in the United States, but each case shall be adjudged by the law of possession." The only other two instances before the general law of 1866, where Congress recognized possessory rights or rules of miners, or granted a fee in mineral lands, were local in their character and application; one was section 2 of the Act of May 5, 1866, (14 U. S. Stat. at Large, 43), concerning boundaries of the State of Nevada; and the other was the Act of Juy 25, 1866, (14 U. S. Stat. at Large, 242), commonly known as the Sutro Tunnel Act. INTRODUCTION OF LODE LAW OF l866. On May 28, 1866, Senator Conness, chairman of the committee on mines and mining in the United States Senate, reported back to that body Senate bill No. 257, entitled "An Act to regulate the occupation of mineral lands, and to extend the right of pre-emption thereto," and recommended the passage of a substitute. In his report, he took strong grounds against all measures for the sale of the mines to the highest bidders and for the taxation of those engaged in working them. He claimed that it was the first duty of Congress to set at rest all doubts and apprehensions affecting mining property by the promulgation of a policy which should give full and complete protection to all existing possessory rights upon liberal conditions, with full and complete legal guarantees, and which should provide the most generous conditions looking toward further explorations and developments. He especially commends the features of the bill recognizing the rules and regulations of the miners: "Another feature of the bill recommended," says the report, "is, ...

Book excerpt: Excerpt from California Mining Statutes Annotated The Bureau of Mines since its establishment has been collecting and publishing the laws relating to mining. The purpose of such publication is to point out the laws and regulations best adapted to increase safety and efficiency in the mineral industry of the United States and to aid legislative bodies in framing uniform mining laws. In 1915 the bureau published, in two volumes, Bulletin 94, United States Mining Statutes Annotated. That bulletin includes every section of the United States Revised Statutes and every statute enacted by Congress relating. To mines and mining. Fol lowing each section and statute, abstracts of decisions of all courts and executive officers construing such sections or statutes were collected and arranged with appropriate title lines and headings in logical order. The bulletin thus shows the status of every Federal mining law by pointing out the defects and uncertainties that were eliminated by the courts and the aid of the courts in the practical application of the mining statutes. The bulletin was published in the hope that it would serve as a guide in the location of claims and in the determination of mining rights and assist the miner in adopting measures that would insure greater safety and efficiency in mining operations. The purpose of the bureau is to follow Bulletin 94 with others that will contain complete collections of the mining statutes of the sev eral States with appropriate and explanatory annotations consist ing of abstracts of the decisions of the State courts, construing and otherwise illuminating such State statutes. These State bulletins will be published successively, either as individual State bulletins or by groups of States, with a view to uniformity in size, and all in style and manner similar to Bulletin 94. The magnitude of the work and the time necessarily involved in collecting the statutes and abstracting the decisions prevent the work being issued as a single publication. The plan adopted will result in giving preference to some States, but as a major part of all of the preparation of the work has been performed, the successive volumes will follow without great delay. Book excerpt: Excerpt from A Manual of American Mining Law This latest work on American mining law, by Mr. Ricketts, brings everything on the subject up to date, as to State and Federal legislation, the decisions of the courts, and the rulings of the Departments. On reading the advance sheets one is at once struck by the conciseness in which the facts are presented. There has been no attempt whatever toward elaboration or argument. The author gives what he considers the proper construction of the law and in each case cites the authorities. There is there fore nothing to confuse the layman, while at the same time the book is of great value for reference to those of the legal profession. Under each general heading are numbered and titled paragraphs, exceedingly brief but showing the authority and its source. No arrangement could well be handier for reference to the prospector, miner, mine manager or lawyer. It is to be noted that both the first book on American mining law and the latest one on the same subject are by Californian authors, practicing attorneys in the city of San Francisco, where both books were published.
