Book excerpt: If one counts the production of constitutional documents alone, the nineteenth century can lay claim to being a 'constitutional age'; one in which the generation and reception of constitutional texts served as a centre of gravity around which law and politics consistently revolved. This volume critically re-examines the role of constitutionalism in that period, in order to counter established teleological narratives that imply a consistent development from absolutism towards inclusive, participatory democracy. Various aspects of constitutional histories within and outside of Europe are examined from a comparative, transnational, and multidisciplinary historical perspective, organized around five key themes. The first part looks at constitutions as anti-revolutionary devices, and addresses state building, monarchical constitutionalism, and restorations. The second part takes up constitutions and the justification of new social inequalities, focusing on women's suffrage, human rights, and property. The third part uses individual country studies to take on questions of how constitutions served to promote nationalism. The use of constitutions as instruments of imperialism is covered in the fourth part, and the final part examines the ways that constitutions function simultaneously as legal and political texts. These themes reflect a certain scepticism regarding any easy relationship between stated constitutional ideals and enacted constitutional practices. Taken together, they also function as a general working hypothesis about the role of constitutions in the establishment and maintenance of a domestically and internationally imbalanced status quo, of which we are the present-day inheritors. More particularly, this volume addresses the question of the extent to which nineteenth-century constitutionalism may have set the stage for new forms of domination and discrimination, rather than inaugurating a period of 'progress' and increasing equality.

Book excerpt: In Divided Houses, Caroline Ford examines how the so-called feminization of religion in France from the French Revolution to the First World War contributed to the formation of a distinctive secular (laïc) republican political culture in France. She also reveals the effect of women's close association with religion on their civil and social status, which gave rise in France to heated debates about the limits of female agency, women's property rights, and women's role in the family and in society. She argues that religious women were often far more than the passive instruments of a male ecclesiastical hierarchy. In showing that these women could dispose of their bodies, souls, and properties in ways that were unimaginable to their secular counterparts, Ford's book obliges one to rethink the categories of tradition and modernity that have structured most thinking about this subject.Ford's book is centered on a set of microhistories and causes célèbres whose narratives are fascinating in and of themselves. They include conflicts within religious orders, the cults of some latter-day female saints, and riveting legal disputes involving women who converted to Catholicism. It was a remarkable "hotspot" in the historical timeline, when doctors and scientists pioneered a staggering number of fields—from forensic investigation to evolutionary biology—and their innovations captivated the public imagination. During the 1790s and beyond, medicine left the somber halls of universities, hospitals, and learned societies and became profoundly politicized, inspiring a whole panoply of different—often bizarre and shocking—subcultures. Quinlan reconstructs the ethos of the time and its labyrinthine underworld, traversing the intersection between medicine and pornography in the works of the Marquis de Sade, efforts to create a "natural history of women," the proliferation of sex manuals and books on family hygiene, anatomical projects to sculpt antique bodies, the rage for physiognomic self-help books that taught readers to identify social and political "types" in post-revolutionary Paris, the use of physiological medicine as a literary genre, and the "mesmerist renaissance" with its charged debates over animal magnetism and somnambulism. In creating this reconstruction, Quinlan argues that the place and authority of medicine evolved, at least in part, out of an attempt to redress the acute sense of dislocation produced by the Revolution.
