Book Synopsis Continuity and Anachronism by : P.B.M. Blaas
Download or read book Continuity and Anachronism written by P.B.M. Blaas and published by Springer Science & Business Media. This book was released on 1978-07-31 with total page 478 pages. Available in PDF, EPUB and Kindle. Book excerpt: Several ofthe themes of this study have been treated in earlier publica tions, some by means of a general analysis and some through a detailed handling of problems raised by a particular theme or historian. Both the more general theoretical treatment of the theme and the concrete historiographical treatment are, I think, indispensable aids to the proper understanding of the development of historical scholarship in nineteenth-and twentieth-century England. There are a number of problems in a concrete historiographical approach: there is first the mass of historians to be faced, and then the immense amount of historical themes dealt with in various periods. As a guideline through the tangle of themes we chose the historiography on the development of the English parliament. We can only hope that we have made a responsible choice of the historians concerned. Un fortunately it was not always possible for us to give extensive biogra phies of some of the more recent historians, as several 'papers' are still firmly in the possession of families, and a number of them mus- despite of years - still be labelled 'confidential.' The Pollard Papers in the London Institute of Historical Research thus remained inaccessible. Fortunately the lack was partly compen sated by some important material being found apart from these Papers.

Book Synopsis Shades of Indignation by : Paul Jankowski

Book excerpt: Corruption is far from disappearing, yet now it inspires resignation rather than indignation - and as such, it has lost its power to scandalize. Jankowski claims that such transformations tell a tale. The state that once aspired to pre-eminence as the sole magnet of loyalty, touchstone of probity, and guarantor of right, has yielded significant ground to the individual who is now more likely to elevate his own dignity and cry scandal on his own behalf."--Jacket.

Download or read book Dictatorship written by Carl Schmitt and published by Polity. This book was released on 2013-12-23 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: Now available in English for the first time, Dictatorship is Carl Schmitt’s most scholarly book and arguably a paradigm for his entire work. Written shortly after the Russian Revolution and the First World War, Schmitt analyses the problem of the state of emergency and the power of the Reichspräsident in declaring it. Dictatorship, Schmitt argues, is a necessary legal institution in constitutional law and has been wrongly portrayed as just the arbitrary rule of a so-called dictator. Dictatorship is an essential book for understanding the work of Carl Schmitt and a major contribution to the modern theory of a democratic, constitutional state. And despite being written in the early part of the twentieth century, it speaks with remarkable prescience to our contemporary political concerns.
Book Synopsis Reason and Fairness by : Ulrike Müßig
Download or read book Reason and Fairness written by Ulrike Müßig and published by BRILL. This book was released on 2019-07-08 with total page 676 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout Europe, the exercise of justice rests on judicial independence by impartiality. In Reason and Fairness Ulrike Müßig reveals the combination of ordinary judicial competences with procedural rationality, together with the complementarity of procedural and substantive justice, as the foundation for the ‘rule of law’ in court constitution, far earlier than the advent of liberal constitutionalism. The ECHR fair trial guarantee reads as the historically-grown consensus of the functional judicial independence. Both before historical and contemporary courts, justice is done and seen to be done by means of judgements, whose legal requirements combine the equation of ‘fair’ and ‘legal’ with that of ‘legal’ and ‘rational.’ This legal determinability of the judge’s fair attitude amounts to the specific (rational) European idea of justice.

This book is the first of a two volume set and will be useful to teachers and advanced students of political theory and medieval history. Topics discussed in this volume include law, property and lordship, political authority and community.
