Book excerpt: The Criminal Justice System is complex and to operate effectively relies on numerous interdependencies between the different bodies involved. There are weaknesses in the System which have persisted for far too long and which cause delay and inefficiency, and serve to undermine public confidence. One example is the failure to ensure the right information is available in case files, where the quality has consistently worsened; another is that a quarter of trials are cancelled or delayed because of late decisions by one or more of the agencies involved. The Home Office, Ministry of Justice and Crown Prosecution Service have made some efforts to improve, but progress in addressing the key problems remains disappointingly slow. Crime has fallen but the Departments gave little evidence linking this improvement to their actions, and while both crime and police officer numbers are down, prison numbers have remained static over the same period. The Departments' efforts to improve efficiency are taking place against a background of reduced resources and staffing, and a prison population twice as high as 20 years ago. The Departments are struggling to: improve the smooth passage of criminal cases through the System; achieve greater collaboration and efficiency between criminal justice organisations at local level; and improve the use of new technology for sharing information.

Book excerpt: This Public Accounts Committee report examines the Education Funding Agency and Department for Education 2012-13 financial statements. Since it was set up in April 2012, the Education Funding Agency (the Agency) has succeeded in getting money to education providers on time. In 2012-13, the Agency distributed £51 billion of capital and revenue funding for 10 million learners to local authorities, academies, academy trusts, further education institutions, sixth-form colleges and other types of education providers. Between 2012-13 and 2015-16, the Agency expects that the number of all education providers it funds will increase by around 50% to almost 12,000, of which nearly 7,000 will be academies. At the same time, the Agency plans to reduce its administration costs by 15%, a huge challenge. It should improve efficiency, transparency and accountability in the education sector, especially in respect of the growing number of academies, but lacks the systems and data it needs. The Agency has not yet achieved an acceptable level of compliance with its reporting requirements and the Committee finds it is too reactive and does not spot risks or intervene in schools quickly enough. Not enough is known about conflicts of interest in academies and the risk they pose to the proper use of public money, not The Agency has no way of knowing whether academy chief executives and trustees are 'fit-and-proper persons', and there are flaws in the methodology used to consolidate the accounts of academies, as well as data quality issues, which undermine accountability.

It draws out the areas where progress has been made and where their successors might wish to press in future. The Committee has assiduously followed the taxpayer's pound wherever it was spent. Since 2010 they held 276 evidence sessions and published 244 unanimous reports to hold government to account for its performance. 88% of their recommendations were accepted by departments. In many cases they successfully secured substantial changes, for example with the once secret tax avoidance industry. They secured consensus from government and from industry that private providers of public services do have a duty of care to the taxpayer, and in pushing the protection of whistleblowers further up the agenda of all government departments. By drawing attention to mistakes in the Department for Transport's procurement of the West Coast Mainline, more recent procurements for Crossrail, Thameslink and Intercity Express have all benefited from more expert advice and a more appropriate level of challenge from senior staff. After discovery in 2012-13 that 63% of calls to government call centres were to higher rate telephone numbers, the Government accepted our recommendation that telephone lines serving vulnerable and low income groups never be charged above the geographic rate and that 03 numbers should be available for all government telephone lines. They also secured a commitment to close large mental health hospitals.

This book focuses on the patterns of use and non use of rulings from foreign domestic courts in human rights cases before the UK Supreme Court. Results are drawn from quantitative and qualitative research, presenting data from the first eight years of Supreme Court activity. The evidence includes interviews with active and former members of the senior judiciary, as well as a focus group including some of the Supreme Court Judicial Assistants. It is argued that foreign jurisprudence is more intimately woven into the fabric of judicial reasoning, and serves a wider range of functions, than the term 'persuasive authority' might imply. Foreign jurisprudence is used mainly as a heuristic device, providing judges with a fresh analytical lens. Foreign jurisprudence is also important when interpreting a common legislative scheme, supporting dialogue between the Supreme Court and supranational courts such as the European Court of Human Rights. The perspectives offered by foreign jurisprudence can also support a stronger conception of domestic human rights. In these ways, this book addresses a broader political question about the source of human rights in the UK.
