Book Synopsis In Search of the Perfect Citizen? by : Sergio Carrera
Download or read book In Search of the Perfect Citizen? written by Sergio Carrera and published by BRILL. This book was released on 2009-05-11 with total page 548 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

Book Synopsis Reinventing the Republic by : Catherine Raissiguier
Download or read book Reinventing the Republic written by Catherine Raissiguier and published by Stanford University Press. This book was released on 2010-06-03 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: Early one morning in 1996, the sanctuary of a Parisian church was suddenly disrupted by a police raid. A group of undocumented immigrant families had taken refuge in the church under threat of deportation due to the French state's increasingly restrictive immigration policies. Rather than disperse and hide, these sans-papiers—people literally without papers— came together to bring to light the deep contradictions in the French state's immigration policies and practices. Reinventing the Republic chronicles the struggle of the sans-papiers to become rights-bearing citizens, and links different social movements to reveal the many ways in which concepts of citizenship and nationality intersect with debates over gender, sexuality, and immigration. Drawing on in-depth interviews and a variety of texts, this disquieting book provides new insights into how exclusion and discrimination operate and influence each other in the world today.

Book Synopsis REGINE - Regularisations in Europe by : Martin Baldwin-Edwards
Download or read book REGINE - Regularisations in Europe written by Martin Baldwin-Edwards and published by Amsterdam University Press. This book was released on 2009 with total page 576 pages. Available in PDF, EPUB and Kindle. Book excerpt: REGINE is a research project on regularisation practices in the European Union. The aim of the project is to provide a thorough mapping of practices relating to the regularisation of third country nationals illegally resident in EU Member States. Two additional non-EU countries - Switzerland and the US - will also be covered to gain insights in regularisation practices and the impact of regularisations elsewhere. In examining regularisation practices, the project also investigates the relationship of regularisation policies to the overall migration policy framework, including to protection issues and refugee policies. Moreover, the project examines the political position of different stakeholders towards regularisation policies on the national level. Finally, the project examines potential options for policies on regularisation on the European level, incorporating Member States as well as other stakeholders' views on possible instruments on the European level.
Book Synopsis The Right to Seek Refugee Status in the European Union by : Sylvie Da Lomba
Download or read book The Right to Seek Refugee Status in the European Union written by Sylvie Da Lomba and published by Intersentia nv. This book was released on 2004 with total page 338 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book measures EC/EU asylum initiatives against international refugee and human rights standards and makes law reform proposals to ensure compliance with international standards. It identifies four areas of concern: the interpretation of the 1951 Convention definition of a refugee; access to asylum procedures; the establishment of fair and effective procedures; and the asylum seekers' status pending the determination of their asylum claims. The author argues that any departure from international standards by the EU and its Member States risks undermining the right to seek refugee status and protection as a humanitarian concept. The author also considers Member states' laws and practices, with special emphasis on the United Kingdom and France. This inclusion reflects the mutual influence that national and European measures exercise on one another and reveals existing discrepancies and tensions between national laws and practices. The author urges the European Union to remain true to its commitment to the Treaty of Amsterdam and its humanitarian tradition and vision.

Book Synopsis Everyday Resistance by : Bruno Frère
Download or read book Everyday Resistance written by Bruno Frère and published by Springer Nature. This book was released on 2019-10-04 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book studies those who, in various domains of life, are resisting the increasingly harsh day-to-day pressures of “late capitalism,” centering mainly on French examples. Far from the global euphoria of the sixties and seventies, everyday people are trying to loosen the grip of injustice in very concrete ways: people experiencing homelessness try to occupy and live in empty buildings; collectives of small farmers and consumers avoid long (and costly) commercial supply chains to defend their common interests; students and teachers organize to prevent the expulsion of undocumented migrants; and activists in the free software movement fight for the “common ownership” of software and of the Internet. Through civil disobedience in the midst of daily life, people are trying to resist, work against, and change laws that protect the interests of firms and corporations considered socially or ecologically unfair.
Book Synopsis Pathways and Consequences of Legal Irregularity by : Erik R. Vickstrom
Download or read book Pathways and Consequences of Legal Irregularity written by Erik R. Vickstrom and published by Springer. This book was released on 2019-04-10 with total page 233 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book provides a unique study of the complexities and consequences of irregular legal status of Senegalese migrants in Europe. It employs sophisticated quantitative methods to analyze unique life-history data to produce policy-relevant conclusions. Using the MAFE dataset as empirical evidence, the book focuses on the legal paths of Senegalese migrants in three different European countries. It shows how multiple contexts of reception produce pathways into irregular legal status and how the resulting complex configurations of irregular status shape migrants’ economic integration into their host societies as well as their ongoing participation in the development of their sending societies. The book thereby increases our understanding of the functioning of African migration systems and the corresponding inclusion patterns in Europe. As such this book will be of interest to scholars working in migration studies, policy makers, and legal professionals.

Book Synopsis Illiberal Liberal States by : Elspeth Guild
Download or read book Illiberal Liberal States written by Elspeth Guild and published by Routledge. This book was released on 2016-05-13 with total page 436 pages. Available in PDF, EPUB and Kindle. Book excerpt: Understanding the dynamics of the illiberal practices of liberal states is increasingly important in Europe today. This book examines the changing relationship between immigration, citizenship and integration at the European and national arenas. It studies some of the main effects and questions the comprehensiveness of the exchange and coordination of public responses to the inclusion of third country nationals in Europe, as well as their compatibility with a common European immigration policy driven by a rights-based approach and the respect of the principles of fair and equal treatment of third country nationals. The volume reviews key national experiences of immigration and citizenship laws, the use of integration and the 'moving of ideas' between national arenas. The framing of integration in immigration and citizenship law and the ways in which policy convergence is being achieved through the EU framework on integration raises a number of conceptual dilemmas and a set of definitional premises in need of reflection and consideration.
Book Synopsis Fair Immigration Proceedings in Europe by : Pieter Boeles
Download or read book Fair Immigration Proceedings in Europe written by Pieter Boeles and published by Martinus Nijhoff Publishers. This book was released on 2023-08-14 with total page 528 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fair Immigration Proceedings in Europe deals with international minimum standards for effective and fair immigration proceedings which apply for the region of the European Union. It is the first study to analyze systematically the impact of a wide range of relevant treaties under the UN, the Council of Europe and the European Union on the quality of national immigration proceedings. As a result, a coherent picture has come to the surface, which, despite several lacunae, gives a surprising view of the acquis of binding obligations on EU Member States in this field. Special attention is given to the greater conventions like the Refugee Convention of Geneva, the International Covenant on Civil and Political Rights, the European Convention on Human Rights and the EC Treaty. Because of its systematic structure, the book is readily accessible for quick consultation. It constitutes an important tool for litigation practice and legislation for civil servants, judges, attorneys and researchers. It will also be of interest to academics because of its analysis of the interaction between minimum norms and equal treatment norms when implemented in municipal law.
