Para ello, se analizan las diferentes teorías y concepciones del derecho constitucional, para luego examinar cada uno de los aspectos que configuran la existencia de un orden jurídico supremo denominado Constitución; de esta forma, veremos qué es un poder constituyente originario, qué aspectos lo diferencian de un poder constituyente permanente, cómo se clasifican las constituciones según las reflexiones teóricas de diversos especialistas en la materia; luego, razonaremos cuáles son los aspectos que permiten que pueda crearse una ley suprema y cómo se logra que ésta sea reconocida y aceptada en una sociedad determinada.
