This book was released on 2018-09-06 with total page 389 pages. Available in PDF, EPUB and Kindle. Book excerpt: Comparative scholarship on judicial review has paid a lot of attention to the causal impact of politics on judicial decision-making. However, the slower-moving, macro-social process through which judicial review influences societal conceptions of the law/politics relation is less well understood. Drawing on the political science literature on institutional change, The Politico-Legal Dynamics of Judicial Review tests a typological theory of the evolution of judicial review regimes - complexes of legitimating ideas about the law/politics relation. The theory posits that such regimes tend to conform to one of four main types - democratic or authoritarian legalism, or democratic or authoritarian instrumentalism. Through case studies of Australia, India, and Zimbabwe, and a comparative chapter analyzing ten additional societies, the book then explores how actually-existing judicial review regimes transition between these types. This process of ideational development, Roux concludes, is distinct both from the everyday business of constitutional politics and from changes to the formal constitution.

This book was released on 2013-10-14 with total page 166 pages. Available in PDF, EPUB and Kindle. Book excerpt: Political transition and democratisation challenges have been noted in African countries including Angola, Burkina Faso, Kenya, Mali, and the Democratic Republic of the Congo, resulting in the African Union (AU) intervening on behalf of citizens, using tried-and-tested mechanisms of imposing a power-sharing agreement to preside over a transitional period, during which there are key changes to the constitution and the political conduct of the incumbency, and partisan institutions are weaned from seeking to perpetuate the status quo. This book focuses on Zimbabwe's military and its perceived veto power in the transition to democratisation from 2008 until 2013. The objective was to analyse, monitor and comment on the unique democratic transformational challenges faced by Zimbabwe's Government of National Unity. One of the book's key findings is that every time partisan forces carry out an operation in the name of a political party, there is a direct correlation in which the same loses its national character. This is the context of the challenge facing Zimbabwean forces when used for partisan gain and why the Southern African Development Community (SADC), in its last communique in Maputo on 15 June 2013, sought to compel a written undertaking from the generals that they would desist from playing a direct role in the politics of the country. The AU had earlier expressed its deep regret when faced with the results of serious human rights abuses that were committed with impunity.

Available in PDF, EPUB and Kindle. Book excerpt: In the past decade, states across the nation have cut higher education spending per student by more than 15 percent. Kentucky has experienced some of the largest cuts in the country, leading many to claim that higher education is in a state of crisis. In spite of this turmoil, however, Kentucky's remarkable institutions of higher education stand more capable than ever to prepare new generations for the challenges and opportunities of their time. College for the Commonwealth: A Case for Higher Education in American Democracy illustrates how colleges and universities are the sustaining lifeblood of civil society and that when these vital institutions are underfunded, both the community and economy suffer. Michael T. Benson and Hal R. Boyd examine the historical origins of higher education in America and analyze the benefits of postsecondary education through the lens of Kentucky. Presented as a practical yet persuasive look at why America needs thoughtful reinvestment in its colleges and universities, this study details how helping students can help sustain a healthy, democratic social fabric while bolstering the modern economy. Gathering examples and offering solutions for postsecondary institutions, this work serves as a call to action and a roadmap for educators, administrators, and government officials.

Available in PDF, EPUB and Kindle. Book excerpt: This book, from a top international group of scholars, explores the ways in which economic tools can be used to improve the quality of regulation in general and legislative tools in particular. As the role of law becomes increasingly important in China, the question arises of how effective regulatory and legislative tools can be developed to accompany the Chinese evolution towards a welfare state. China therefore provides a unique case study for scholars and policymakers interested in examining how regulation can play a role in promoting sustainable development. Economics and Regulation in China goes beyond traditional economic analysis of law by focusing specifically on the question of how economic tools can guide the quality of legislation. To this end, the book centres in on three areas: regulation as a tool of economic growth, competition policy and environmental policy. Not only are these three domains of great importance for China, but they are also relevant for a broad scholarship interested in the economic analysis of law. This volume contributes to discussions on how ex-ante evaluation of legislative proposals and ex-post analysis can increase the effectiveness and efficiency of regulation, using economic tools, offering insights that go beyond the particular case of China. The analysis offered by this book makes it an invaluable resource for academics and policymakers alike.

This book was released on 2015-06-19 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Human Fertilisation and Embryology Act 2008 was a major update to the UK’s laws on the use and regulation of reproductive technology and assisted reproduction. Since the enactment of the new law, the sector’s regulatory body, the Human Fertilisation and Embryology Authority (HFEA), has also consulted on various related topics including barriers to egg and sperm donation in the UK, multiple births/single embryo transfer and using IVF technology to prevent mitochondrial disease. This book critically considers recent developments in human fertilisation legislation, asking whether the 2008 Act has achieved its stated aim of being fit for purpose. Bringing together a range of international experts, the book evaluates the fresh risks and challenges emerging from both established and existing technologies and techniques in the field of human fertilisation and embryology, as well as offering valuable insights into the social and regulatory challenges that lie ahead. Key topics include problems with DIY assisted conception; the lack of reform in respect of the regulation of surrogacy arrangements; and mitochondrial DNA transfer. As a review of the status of assisted reproduction legislation, this book will be of great use and interest to students, researchers and practitioners in medical law, bioethics, medicine and child welfare.

Available in PDF, EPUB and Kindle. Book excerpt: Intercollegiate Athletics, Inc. examines the corrupting influence and damaging financial effects of big-time intercollegiate athletics, especially football and to a lesser extent basketball, on American higher education. Including historical and contemporary perspectives, the book traces the growth of intercollegiate sports from largely student-run activities supervised by faculty to the gargantuan, taxpayer-supported spectacles that now dominate many public universities. It investigates the regressive student fees that have helped subsidize big-time sports at public universities and prop up chronically unprofitable athletic departments, as well as the corrosive effects of athletics on the university’s academic enterprise. A review of the alleged salutary effects of massive sports programs, such as spurring alumni donations and student applications, reveals that such benefits are largely illusory, more myth than real. The book also pays special attention to the often prescient, if largely unsuccessful, opponents of these developments, and considers the alternatives to big-time athletics, from abolition to professionalization to club sports. Students, scholars, sports fans, and those interested in learning how big-time football and basketball have cast such an enormous—and often baleful—shadow upon American colleges and universities will profit from this provocative and engagingly written book.
