Book excerpt: The effective operation of devolution stands the best chance of success if both the UK and Welsh governments share knowledge and understanding, concludes the Welsh Affairs Committee in this report. The Committee makes a number of recommendations to improve the relationship between Wales and Whitehall. A broad review of how intergovernmental relationships are coordinated is required. The Joint Ministerial Committee should meet on a regular basis and ministers at all levels should be alert to the consequences of policy and legislation on devolved areas. The Cabinet Office should take lead responsibility for devolution strategy in Whitehall. Whitehall has lost a focus on the devolution settlement and too often has displayed poor knowledge and understanding of the specificities of the Welsh settlement. The Civil Service needs more consistent training and clear department-by-department focus on retaining devolution knowledge and understanding. The Welsh Assembly Government should have the confidence to interact with Whitehall and to promote areas of good practice. The Cabinet Secretary and the Permanent Secretary to the Welsh Assembly Government should give evidence annually to the Welsh Affairs Committee. Finally, reform of the Barnett Formula is required. The current financial settlement does not appear sustainable and a new arrangement needs to be built on an agreed and enduring basis which is demonstrably fair and sensitive to the particular circumstances of Wales.

Annual parking accounts would allow the public to see how much local revenue is derived from the enforcement of fines, and what proportion of this come from on or off street parking charges. It's right that parking charges be determined locally, but hard to justify fines that substantially exceed penalties for more serious offences like speeding. DfT's statutory guidance should stipulate that local authorities implement a 'grace period' of 5 minutes after the expiry of paid-for time on any paid parking before enforcement officers issue a Penalty Charge Notice (PCN). The Guidance should be clarified and updated, particularly in relation to rules for loading and unloading. A 25% penalty charge discount should also be introduced for motorists who pay within 7 days of losing any appeal to a parking tribunal. Local authorities currently offer a 50% discount if motorists pay their penalty charge within 14 days, but this is not available to motorists who appeal to a tribunal. Motorists should also not have to appeal against PCNs where tribunal adjudicators have repeatedly identified a problem such as poor signage. Adjudicators should also be given powers to allow appeals where local authorities fail to follow statutory guidance concerning the use cameras. While businesses cannot be completely exempt from parking restrictions, local authorities must also ensure that the need to restrict parking and manage congestion does not stifle the ability of businesses to trade and help grow the economy

Book excerpt: Around 80% of online gambling in the UK is conducted with operators which are not licensed here. In December 2012 the Government published a very short draft Gambling (Licensing and Advertising) Bill to require overseas gambling operators to obtain a Gambling Commission licence. The overseas-based remote gambling operators generally opposed the Bill, on the grounds it was unnecessary for consumer protection, might drive consumers to cheaper unlicensed operators and was principally intended to bring overseas operators within the UK's tax regime. Much of the UK-based gambling industry, sports bodies and organisations working to combat problem gambling supported the principle of the Bill. Almost all those who gave oral or written evidence to the Committee raised the issue that the enforcement regime would have to be rigorous in order to provide any of the benefits to consumers. The Committee supports the principle that gambling should be regulated on a ’point of consumption' basis. The Committee also notes the concerns raised about taxation of the online industry. The Government stated that the ability to bring all operators serving UK consumers within the tax net is a consequence, but not the prime motivation, of the draft legislation. The Committee notes in this regard that, in setting a tax rate for remote gambling, the Treasury should bear in mind that too high a rate would be liable to drive customers and companies into the unregulated, black market.

The MPs also note that their previous recommendation on making the links between insurers and other parties involved with claims more transparent has been ignored. The absence of comprehensive statistics about road traffic accidents means that it is impossible to relate the increasing number of personal injury claims in recent years to the number of accidents. Data collection about road accidents needs to be improved help to assist detection of fraudulent personal injury claims and help highways authorities improve road safety by targeting spending on accident black-spots. The Committee also supports the proposal for an accreditation scheme for medical practitioners who provide medical reports in relation to whiplash claims. Access to justice could also be impaired by Government proposals to switch whiplash claims between £1,000 and £5,000 to the small claims court, particularly for people who do not feel confident to represent themselves against insurers who will use legal professionals to contest claims. Ways in which use of the small claims track could be combined with the routine submission of expert evidence should be considered

Book excerpt: Technologies such as GPS, vital to the financial markets as well as the military, are known to be vulnerable to the effects of space weather or the EMP resultant from a nuclear weapon exploded at altitude. It is also possible to build non-nuclear devices which can disrupt electronic systems, though so far only over a limited area. A severe space weather event is not necessarily seen as a military problem in the first instance, but it would be likely to meet the definition of an "emergency" under the Civil Contingencies Act 2004 and call for the help of the Armed Forces. The reactive posture described by the Government appears somewhat complacent. The Committee is very concerned that there appears to be no one Government Department identified to take immediate lead responsibility should there be a severe space weather event. The Government must make clear exactly where lead responsibility in relation to EMP disturbances lies both nationally and within the MoD. Defence alone cannot protect against the threat of EMP. It must be a concern of the National Security Council and civil contingency planners, with proper standards of protection developed with the vital service industries most at risk. The effects of a High Altitude Electro-Magnetic Pulse Event as a result of a nuclear weapon exploded at high altitude, would be so serious that only government action could be expected to mitigate it. Security of satellites is a matter of growing concern as our reliance upon such systems and the sheer number of satellites in orbit increase.

But much more needs to be done to protect people in their homes. The main mechanism for checking electrical work covered by Part P of the building regulations is satisfactory is certification by a qualified supervisor operating under a Government-approved competent persons scheme. As long as the qualified supervisor meets competence standards, the person carrying out the work does not necessarily have to be a qualified electrician. The report calls for competence requirements to be rolled out within five years for all those actually doing electrical work to which Part P applies. In the interim, it is recommended that there be a limit on the number of notifications that a single qualified supervisor can authorise in a year in order to ensure that they devote enough time to checking each job. The Government should aim to double public awareness of Part P within two years and aim for an awareness level similar to that of Gas Safe within five years (45%). Additionally, the report calls for more proactive enforcement against those who breach Part P.

It is the Transport Committee's fourth report on the cost of motor insurance and, while premiums are now falling, aspects of the market remain dysfunctional and have encouraged criminality to take root. Further action is still required to tackle fraud whilst protecting genuine claimants. The Government must prohibit insurers from settling whiplash claims before the claimant has undergone a medical examination. On issues of court procedure and medical panels the Committee endorses the Government's intention to require courts to strike out 'dishonest' insurance claims (e.g. those involving gross exaggeration), but cautions against hasty legislation due to the complex legal implications. The report calls for data sharing about potentially fraudulent claims between insurers and claimant solicitors to be made compulsory rather than voluntary (as currently proposed). The Government should oversee funding arrangements for the police Insurance Fraud Enforcement Department, to make sure that this unit, currently funded directly by the insurance industry, has a long-term future. Government proposals for independent medical assessments are welcomed but more work is required on implementation. The Government should press the Solicitors Regulation Authority to stop some solicitors from playing the system to maximise their income by commissioning unnecessary psychological evaluations.

Book excerpt: The Defence Committee believes that the Government will need to make some difficult decisions on prioritisation if it embarks on a future mission similar to the Libya operation now that the Strategic Defence and Security Review (SDSR) is taking effect. Although the UK was able to satisfy both operations in Libya and Afghanistan and its other standing tasks and commitments, the Libya operation was conducted before the implementation of many of the SDSR decisions on capability reductions. The Committee commends UK Armed Forces for their significant contribution to the successful conclusion of the Libya operation and comments on particular aspects and equipment used in the operation. It notes that at times the Royal Navy was unable to carry out several other important tasks owing to meeting the Libya commitment. Given the high levels of standing maritime commitments it is likely that this type of risk taking will occur more frequently as the outcomes of the SDSR are implemented. For the time being, there will continue to be a heavy reliance on US command and control functions for future NATO operations. The Committee also concerned that future NATO operations will not be possible if the US is not willing or able to provide capabilities such as unmanned aerial vehicles, intelligence and refuelling aircraft. It should be a priority for NATO to examine this over-reliance on US capabilities and assets. This challenge will be heightened by the US stated intention to shift its military, geographic and strategic focus to the Asia-Pacific region.
