Book excerpt: This report considers the Fixed-term Parliaments Bill which would remove the Prime Minister's power to call an election at the time of his choosing, and sets a five year fixed term, subject to the possibility of early dissolution following a vote by the House of Commons. It examines the key issues of the Bill's principals as well as the process by which it was brought forward. The Committee takes the view that the origins and content of the Bill owe more to short-term considerations than to a mature assessment of enduring constitutional principles or sustained public demand. In the view of the majority of the Committee, the shift from a five year maximum to five year norm would inconsistent with the Government's stated aim of making the legislature more accountable; with existing constitutional practice; and with the practice of the devolved institutions and the clear majority in international legislatures. However the Committee does accept that an elected government should have a full term in which to develop their policies and take their legislative programme through Parliament. It considers a four year term should be adopted for any fixed-term arrangement at Westminster. Potential date clashes with elections to the devolved institutions should also be avoided. Some form of safety valve which would allow for an early election in circumstances such as the government losing the confidence of the Commons or where a political or economic crisis has affected the country is also necessary. The report also makes several specific recommendations for amendments for the Bill.

This book was released on 2011-07-18 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: The constitution is the foundation upon which law and government are built. Yet the United Kingdom has no agreed process for constitutional change. The Committee does not accept that the government should be able to pick and choose which processes to apply when proposing significant constitutional change. It therefore recommends in this report the adoption of a clear and consistent process. These recommendations are not intended to restrict the government's right to initiate constitutional change, but to hold ministers to account for their decisions. The Committee regard it as essential that, prior to the introduction of a bill which provides for significant constitutional change, the government considers the impact of the proposals upon the existing constitutional arrangements, subject the proposals to detailed scrutiny in the Cabinet and its committees, consult widely, publish green and white papers, and subject the bill to pre-legislative scrutiny. The Committee looks at these processes in this report, as well as considering the desirability of public engagement and building consensus. Also the importance of not rushing parliamentary scrutiny of legislation once introduced into Parliament and of conducting comprehensive post-legislative scrutiny of significant constitutional legislation once passed. Also recommended is the minister responsible for a significant constitutional bill in each House set out the processes to which a bill has been subjected in a written ministerial statement. This comprehensive package from which the government should depart only in exceptional circumstances and where there are clearly justifiable reasons for so doing. The Committee believes this approach is pragmatic and achievable, enabling the flexibility of the United Kingdom's current constitutional arrangements to be retained whilst enhancing and underpinning those arrangements

Available in PDF, EPUB and Kindle. Book excerpt: As the second chamber of the Westminster parliament, the House of Lords has a central position in British politics. But it is far less well-studied and well understood than the House of Commons. This is in part because of constant expectations that it is about to be reformed - but most Lords reform plans fail, as the Coalition government's dramatically did in 2012. Meanwhile, following a landmark change in 1999 which removed most of its hereditary members, the Lords' role in the policy process has grown. Understanding the chamber is therefore now essential to understanding politics and parliament in Britain. This book provides the first detailed portrait of the post-1999 Lords, explaining who sits in the chamber, how it operates, and crucially what policy impact it has. Its membership is shown to be more diverse and modern than many would assume, and its influence on policy to be substantial. As a 'no overall control' chamber, in which no party has a majority, it has inflicted numerous defeats on the Blair, Brown and Cameron governments, and become an important site of negotiation. It has provided a power base for the Liberal Democrats, and includes a group of almost 200 independents who now play a pivotal role. Close study of today's House of Lords demolishes some common myths about British politics, and also about how two chamber parliaments work. This book, as well as focusing on the contemporary Lords, provides a historical and comparative context for British bicameralism, asks whether the Lords can be considered 'legitimate', and describes recent reform efforts and possible future reforms.

Book excerpt: Following the passage of the Fixed-term Parliaments Act 2011, the date of the next general election has been fixed by statute for 7 May 2015. Greater certainty about the date of the next general election has created a unique opportunity to consider how best this final year can be spent, and the Committee has heard that there is scope both to enhance the quality of public policy debate, and also to better prepare for the next Parliament. Key recommendations are: that this final year be used by the Government, Parliament and political parties to consider some of the long-term issues that will need to be addressed in the next Parliament; arrangements for pre-election contacts between the Civil Service and Opposition be formalised and authorised automatically in the final year of a Parliament, and that the Cabinet Manual should be updated to that effect; that parties work to develop a consensus, before the next general election, on how party policy could most effectively be costed ahead of future general elections - this would improve both policy formation and debate ahead of a general election. Achieving this will require active engagement from the Government, parliamentarians and political parties, and the Committee hopes they will all appreciate the potential for a constructive year ahead of the next general election, and support the recommendations.

Political and Constitutional Reform Committee and published by The Stationery Office. This book was released on 2015 with total page 33 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Political and Constitutional Reform Select Committee was established in June 2010 to consider political and constitutional reform. Over the last five years the Committee has scrutinised the Government's substantial programme of political and constitutional reform - which included fixing the term of a Parliament, bringing forward proposals for recalling MPs, establishing a register of third party lobbyists and implementing Individual Electoral Registration. The establishment of a dedicated select committee to consider these matters has brought additional parliamentary scrutiny to a substantial part of the Government's programme. Should the next Government plan to take forward constitutional reform, a select committee be established to examine the Government's proposals, to keep the progress of any political and constitutional reform under regular review, and to continue the work this Committee has undertaken. The Committee has also highlighted the extent to which it has engaged the public with it's work through consultations and increased use of social media, online surveys and informal events. This public engagement is one of it's greatest innovations, and something which it encourages other committees to adopt in the future

Available in PDF, EPUB and Kindle. Book excerpt: This book considers the function of the royal prerogative in the changing landscape of the British constitution. It explains each of the prerogative powers in separate chapters. It clarifies the respective roles of government, Parliament and the courts in defining the extent of prerogative powers, and in regulating their use. It also looks at which powers should be codified in statute, which should be regulated by convention, and which could be left at large. The book is very timely in contributing to current debates. The fevered parliamentary debates over Brexit thrust the prerogative centre-stage. Recent controversies have ranged from the role of Parliament in assenting to treaties, to the prorogation and dissolution of Parliament, to the grant or withholding of royal assent to bills. In their 2019 election manifesto, the Conservative Party stated that 'After Brexit we also need to look at the broader aspects of our constitution, the relationship between the Government, Parliament and the courts; the functioning of the Royal Prerogative...'. The book covers the whole range of prerogative powers, from going to war and ratifying treaties, appointing and dismissing ministers, regulating the civil service and public appointments, to the grant of honours and pardons and the issue of passports. Its 19 chapters provide a comprehensive guide to the operation of the prerogative – past, present, and future – together with suggestions for reform.
