Book excerpt: In July 2007 following the findings of the coroner in the inquests in the tragic deaths of Gareth Myatt and Adam Rickwood, the Ministry of Justice and the Department for Children, Schools and Families commissioned an independent review into the use of restraint in Young Offender Institutions (YOIs); Secure Training Centres (STCs) and Secure Children's Homes (SCHs). The chairs of the review, Peter Smallridge and Andrew Williamson reported their recommendations on 20 June 2008. They made 58 recommendations including the identification of the following key issues: the need for greater clarity and consistency in the use of restraint; the need for two systems of constraint, one for YOIs and one for STCs and accreditation of the methods in use; the need for a review of legislation and guidance on the use of restraint against six principles that focus on preventing the risk of harm; that there should be a new mandatory Acceditation Scheme; that a Restraint Management Board should be established. The Government is accepting almost all of the recommendations and this report presents the Government's response to the independent review.

Book excerpt: This paper presents the Government's response to the North Report on Drink and Drug Driving and the Transport Committee's report on Sir Peter North's recommendations. It outlines measure the Government intends to introduce. The prescribed alcohol limit for driving will not be changed, with the focus instead on improving enforcement and education to tackle the drink and drug drivers who put lives at risk. Other measures on drink driving include: revocation of the right for people whose evidential breath test result is less than 40% over the limit to opt for a blood test (the 'statutory option') - the breath testing equipment used in police stations is now very accurate and technically sophisticated so a blood sample is not needed to confirm the breath test; a more robust drink drive rehabilitation scheme; closing a loophole used by high risk offenders to delay their medical examinations; streamlining the procedure for testing drink drivers in hospital. On drug driving the Government will: approve preliminary drug-testing equipment - initially for use in police stations, and at the roadside as soon as possible; allow custody nurses to advise the police whether or not a suspected driver has a condition that may be due to a drug, removing the need to call out police doctors and so speed up the testing process; examine the case for a new specific drug driving offence - alongside the existing one - which would remove the need for the police to prove impairment on a case-by-case basis where a specified drug has been detected.

Book excerpt: The Freedom of Information Act 2000 came into force in January 2005, providing a general right of access to information held by public authorities in the UK. The current charging scheme for handling FOI requests is £600 for central government and £450 for other public authorities, based on a set rate of £25 per hour for officials' time. Where the estimated cost is below the limit, the information is provided free of charge, but when the limit is exceeded, the public authority can either provide the information for a charge or refuse to provide the information on grounds of lack of cost-effectiveness. This document sets out the Government's reply to the Committee's report (HCP 415, session 2006-07; ISBN 9780215034724) on the Governments proposals to change this system, which seek to include reading time, consideration and consultation time in the calculation of time spent towards the appropriate limit to aggregate non-similar requests made by any person or persons apparently acting together.

Book excerpt: This is the Committee's second annual report monitoring the Government's response to human rights judgments in the European Court of Human Rights. The Committee criticises the Government for its failure to respond to many of its recommendations in its previous report (17th report session 2006-07, HL 128/HC 728, ISBN 9780104011065). The Committee believes the Government should take a consistent and transparent approach across departments to the way in which it responds to declarations of incompatibility and judgments fro the European Court, with the Ministry of Justice co-ordinating the response to adverse judgments. This report also examines a number of issues arising from outstanding judgments: access to artificial insemination for prisoners and their partners; controlling membership of trade union; prisoners' voting rights; investigations into cases involving the use of lethal force; security of tenure for gypsies and travellers, and the corporal punishment of children.

This book was released on 2011-12-19 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: In its final report the Independent Commission on Banking (ICB) recommended a package of measures, consisting of ring-fencing vital banking services and increasing banks' loss-absorbency. The Government strongly supports the ICB's objectives and dual approach. The Government agrees that vital banking services - in particular, the taking of retail deposits - should only be provided by 'ring-fenced' banks', and that these banks should be prohibited from undertaking certain investment banking activities. On increased loss-absorbency, also supported are the ICB recommendations for higher equity requirements for large ring-fenced banks, a minimum leverage ratio, loss-absorbing debt, insured depositor preference and higher levels of loss-absorbing capacity for banks that are difficult to resolve. With regards to the principle that systemically important banks hold a minimum about of loss-absorbing capacity on a group-wide basis, however, the requirement should not apply to non-UK operations where it can be shown that those operations to do not pose a risk to UK financial stability. The Government also believes that depositor preference needs further analysis and consultation. On competition, the Government also strongly supports all the ICB recommendations. The Government estimates the aggregate private costs to UK banks at £3.5bn - £8bn, producing a gross reduction in GDP of £0.8bn - £1.8bn. Against these costs though should be set the potentially much larger benefits with the ICB's recommendations yielding an estimated incremental economic benefit of £9.5bn per annum. Significantly too the Government wants to see relevant legislation completed by the end of this Parliament in May 2015 as opposed to the ICBs recommended 2019
