Book excerpt: The mission of the MoD's (Ministry of Defence's) Defence Equipment and Support (DE & S) organisation is to equip and support our Armed Forces for operations now and in the future. Support to current operations in Afghanistan and Iraq has taken priority and the organisation has performed well. The Urgent Operational Requirement (UOR) system remains highly effective in enabling vital equipment to be provided quickly to the two theatres to meet rapidly changing threats, but there are concerns that UORs represent a partial failure to equip our forces for predicted expeditionary operations, and on their effects on the core budget in future years. DE & S' performance in procuring longer-term equipment declined significantly in 2007-08. The forecast costs for the 20 largest defence projects increased by £205 million and the forecast delays increased by some 100 months in the year. The improvements promised by both the long-standing application of the principles of 'smart procurement' and the more recent formation of the DE & S organisation appear not to have materialised. The FRES (Future Rapid Effect System) programme has been a fiasco, being poorly conceived and managed from the outset. The Committee condemns the failure to date to publish an updated version of the Defence Industrial Strategy and considers that its continuing absence increases the risk that the UK Defence Industrial Base will not be able to meet the future requirements of our Armed Forces. Finally, the UK's future military capability depends on the investment made today in Research and Development. Sufficient funding for defence research needs to be ring-fenced and the MoD must recognise the very high priority of research and reverse the recent cut in research spending.

The Committee welcomes various aspects of the Government response but also has some substantive comments. It also notes that publication of the Government's Green Paper has been repeatedly delayed and recommends that it be published as soon as possible. The Government's reiteration of its commitment not to detract or resile from the rights in the European Convention on Human Rights (ECHR); and its acknowledgement that there would be scope for including in a new constitutional document a range of rights and responsibilities which go beyond those in the ECHR, are welcomed. The Committee is concerned to detect some equivocation in the Government's view about the Human Rights Act, particularly following the interview given by the Secretary of State for Justice in the Daily Mail on 10 December 2008. It also remains unclear about the relationship between rights and responsibilities envisaged by the Government in a Bill of Rights. Finally, the Committee recommends that the Government should follow Australia's example and appoint an independent committee to conduct a national consultation on the whole range of options for a Bill of Rights for the UK, ahead of parliamentary consideration of the bill itself.

Protest around Parliament should be governed by the Public Order Act 1986, which should be amended to deal with the specific circumstances of Parliament; -- 4. police and protestors need to focus on improving dialogue. The police should aim for 'no surprises' policing : no surprises for the police; no surprises for protestors; and no surprises for protest targets. Protestors should also, where possible, engage with the police at an early stage in their planning, in order to facilitate peaceful protest; Tasers should never be used against peaceful protestors.

The report makes the following key recommendations: the Civil Service Commissioners should have the power to report to Parliament evidence indicating that the government was misleading Parliament or the public or the fact that the Civil Service has refused to act on a justified complaint; the Commissioners should also conduct independent investigation of breaches of confidentiality by special advisers; the leaking of information should only be a criminal matter where there is a breach of the Official Secrets Act or there is evidence of serious criminal misconduct; the Cabinet Office, Heads of Departments and the Civil Service Commissioners should do more to ensure that potential whistleblowers know how to raise concerns and have the confidence to come forward with them.

The Committee has come to appreciate the complex and diverse nature of the traditional retail markets sector. There are a number of reasons for the decline, the most significant being increased competition from supermarkets, other alternative cheap retail outlets and the internet. Nevertheless, a growing number of markets are adapting successfully to change. Local authorities and central government should care about markets, because of the multi-faceted nature of the benefits that successful markets can bring to local towns and communities. The report identifies five key benefits: economic; social (eg in encouraging social cohesion); assisting the regeneration of town centres; promoting healthy eating; and reducing environmental impacts in the retail sector. On finance and management the report notes lessons from elsewhere in Europe; identifies best practice, and recommends that councils consider using prudential borrowing, market champions at a senior level within the council, and co-operation with the private sector. The report also addresses; the challenges facing medium and small town councils seeking to keep smaller, local markets alive; the need for better promotion and recruitment and training for existing traders and market managers; the strategic role of central government.

This gives rise to around 17 per cent of global greenhouse gas emissions, greater than global emissions from transport. Addressing deforestation is as essential as decarbonising electricity or transport if the world is to avoid dangerous climate change. A failure to act on deforestation could double the cost of avoiding dangerous climate change to 2030. Deforestation is caused by a range of factors, many of which are exacerbated by a growing global population and increasing consumption. Halting deforestation requires: (a) support for rainforest nations to help them manage their development so that it does not allow continued deforestation; (b) management of the demand for commodities whose production encourages deforestation; and (c) the introduction of a mechanism to pay developing countries for maintaining, and in due course recreating, their forests. The UK needs to act in all three areas if its policies on deforestation are to be successful. Ignoring any one undermines the effectiveness and durability of action in the other areas. As part of this work the Government must: remove subsidies that contribute to deforestation, such as biofuels policy; develop sustainability standards for agricultural commodities; implement and enforce government timber procurement; and, seek an EU-wide ban on illegal timber imports combined with robust sanctions. Illegal timber imports are still a fact of life within the UK timber trade. The economic, environmental and development case for immediate action on deforestation is clear. But success is possible only if the international community works together effectively.

New runways at Heathrow and Stansted airports are two of the key airport development proposals. If all the White Paper-supported airport development proposals came to fruition, current Government forecasts predict that the number of passengers passing through UK airports will increase from 241 million passengers a year in 2007 to 455 million passengers a year in 2030. This UK growth matches air traffic predictions for the whole continent. Eurocontrol, the European Organisation for the Safety of Air Navigation, predicts that European air traffic will double by 2020. If rising demand for air travel is to be met effectively through additional airport capacity, a corresponding increase in airspace capacity must be realised. However, a country's airspace, the portion of atmosphere above its territory and territorial waters, controlled by that country is a finite resource. UK airspace, particularly in the South East of England, is already some of the busiest and most complex to manage in the world. This will almost certainly require improvements in the efficiency of the UK air traffic management system.The Committee's inquiry aims to look at how to meet these challenges. Its findings are aimed at those organisations responsible for airspace-related decisions in the UK: the CAA, NATS, and the Department for Transport. Passenger numbers and freight demand globally have declined in 2008 and in the first months of 2009. In its conclusions and recommendations the Committee covered the management of airspace, strategy, change and co-ordination in airspace management, environmental impacts of airspace changes and European developments.

Whitehall has lost a focus on the devolution settlement and too often has displayed poor knowledge and understanding of the specificities of the Welsh settlement. The Civil Service needs more consistent training and clear department-by-department focus on retaining devolution knowledge and understanding. The Welsh Assembly Government should have the confidence to interact with Whitehall and to promote areas of good practice. The Cabinet Secretary and the Permanent Secretary to the Welsh Assembly Government should give evidence annually to the Welsh Affairs Committee. Finally, reform of the Barnett Formula is required. The current financial settlement does not appear sustainable and a new arrangement needs to be built on an agreed and enduring basis which is demonstrably fair and sensitive to the particular circumstances of Wales.

The Committee believes that there is indeed a demand in Wales for comprehensive social housing legislation for Wales, to include the regulation of social housing providers and reform of tenure law. It concludes that the current Order is a logical extension of the current devolution settlement and, with minor technical changes outlined in this Report, is content that it should proceed. The Committee reiterates its continuing concerns about the naming of LCOs. There is now a number of draft or proposed Orders with similar titles. The recommendation is that LCOs should be given a simple title which conveys the actual subject of the Order to the general reader.
