Available in PDF, EPUB and Kindle. Book excerpt: This book's principal aim is to critically address the institutional and substantive legal issues resulting from European enlargement, chiefly those relating to the legal foundations on which the enlarged Union is being built. The accession of new Member States creates the potential for a stronger and more powerful Europe. Realising this potential, however, will depend on the ability of the EU to develop functional and effective governance structures, both at the European level and at the level of the individual Member States. While the acquis communautaire will ensure that formal laws in the new Member States will be aligned with those of existing members, the question remains as to how effective institutions will be in implementing changes, and what effects the imposed changes will have on the legitimacy of the new legal framework. This book, containing the work of leading scholars in law and social sciences, examines the current and future legal framework for EU governance, and the role that new members will - or will not - play in the creation of that framework, paying particular attention to the specific challenges membership in the EU poses to the acceding states of Central and Eastern Europe. It is a book which will contribute to and influence debates over constitutionalism and legal harmonisation in the EU.

Book excerpt: The phenomenon of ‘agencification’ describes the EU legislator’s increasing establishment of European agencies to fulfil tasks in a variety of EU policies. The creation of these decentralised administrative entities raises a number of questions; for example, on the limits to such delegation of powers, on the agencies’ institutional development and possible classification, and on the role of comitology committees as an institutional alternative. This book examines the EU’s ‘agencification’ with regard to these questions, on the basis of and with reference to which the focus is laid on the European agencies operating in the field of financial market risk governance. This analysis not only encompasses the three European Financial Market Supervisory Authorities (the ESAs), but also takes into account the institutional change brought about by the Banking Union, more specifically the Single Supervisory Mechanism (SSM) and the Single Resolution Mechanism (SRM). While the SRM sets in place a new European agency, the Single Resolution Board (SRB), the SSM establishes and empowers a new body within the organisation of the European Central Bank (ECB), the Supervisory Board. By exploring the organisation, the tasks and the powers of these actors in financial market regulation and supervision, the book points at the current peak of the institutional development of European agencies and assesses organisation and unprecedented powers with a view to their compliance with EU law, in particular the Treaties and the respective case law of the European courts. As an evaluation of various aspects of the progressing centralisation of regulatory power on the EU level, which is exercised by an increasingly decentralised administrative apparatus, this book will be of great interest and use to students and scholars of EU law, financial law and regulation, and European politics.

Available in PDF, EPUB and Kindle. Book excerpt: For the time being, the political project of basing the European Union on a document entitled 'Constitution' has failed. The second, revised and enlarged edition of this volume retains its title nonetheless. Building on a scholarly rather than black-letter law account, it shows European constitutional law as it looks following the Treaty of Lisbon, with the EU's foundational treaties mandating the exercise of public authority, establishing a hierarchy of norms and legitimising legal acts, providing for citizenship, and granting fundamental rights. In this way the treaties shape the relations between legal orders, between public interest regulation and market economy, and between law and politics. The contributions demonstrate in detail how a constitutional approach furthers understanding of the core issues of EU law, how it offers theoretical and doctrinal insights, and how it adds critical perspective. From Reviews of the First Edition: "...should be mandatory reading for anyone who wants to get a holistic perspective of the academic debate on Europe's constitutional foundations...It is impossible to present the richness of thought contained in the 833 pages of the book in a short review." Common Market Law Review "an enduring scholarly work, which gives an English-speaking audience important, and overdue, access to the long-standing and forever-vigorous traditions of (European) constitutional law... unhesitatingly recommend[ed]." European Law Journal "...real scholarship in the profound sense of the word..." K Lenaerts, Professor of European Law, Leuven

Book excerpt: Among the prominent legal roles Claus-Dieter Ehlermann has played in his career, his leadership of the Legal Service of the European Commission is perhaps the best known. This liber amicorum appears as his term at the Appellate Body of the World Trade Organization draws to a close. In this book 30 of his colleagues offer fresh and provocative insights into many of the areas of international law on which Professor Dr Ehlermann has left his stamp. Topics include: the WTO dispute settlement system; regulation of trade barriers; the first signs of a global jurisprudence; the principle of proportionality; enforcement of competition law; and the place of human rights in European and global integration. This book's evaluations and proposals should find thought-provoking echoes in the minds of all those concerned with any of the integration processes under way in today's interdependent world

A terrific line-up that combines diverse talents from North America and Europe. Few books of this kind could live up to the billing ′definitive benchmark′, but this one certainly does′ - John Peterson, University of Edinburgh ′A most useful book that can be highly recommended. A strong analytical framework coupled with unparalleled coverage of the major issues of the political science research of the EU makes this volume a formidable tool for teaching and a significant input to new scholarly research. It is both relatively sophisticated and very accessible to graduate students and advanced researchers. The clear writing style and the richness of information presented will certainly make this book interesting for non-academic readers′ - Igor Vidacak, Institute for International Relations, Zagreb - Journal of Common Market Studies ′An admirably comprehensive source book for those interested in how the tools of political science inspire EU area studies. The editors enlist leading researchers to synthesize the state of the art in their field of expertise. The Handbook of European Union Politics will be an indispensable intellectual resource for researchers, teachers, and graduate students of the European Union′ - Liesbet Hooghe, University of North Carolina at Chapel Hill, USA ′Presents an excellent overview of political science research on the EU. It finds the right balance between establishing the state of the art and pointing the reader to theoretical diversity. Highly recommended for advanced students and scholars looking for quick and solid orientation in a fragmented field - and for new ideas for research′ - Frank Schimmelfennig, ETH Zurich, Switzerland ′This is a milestone in the study of EU politics. The authors include the most knowledgeable practitioners in the field, and collectively they provide a comprehensive and highly competent overview of the state of theory and research on EU institutions, politics and policies′ - Fritz Scharpf, Max Planck Institute for the Study of Societies, Germany The European Union (EU) poses quite profound questions for scholars and students of the social and political sciences. This benchmark handbook is designed to: - provide an authoritative state-of-the art guide to the scope of the field suitable for both established scholars and students of the EU - reflect and contribute to the debates about the nature of the field of EU studies and EU politics in particular - explore in detail the development of the many approaches to the study of EU politics. Divided into four sections, the Handbook focuses on theorizing European integration; the EU as polity; politics and policy making in the EU; and the EU and the international system. Its appeal will reside not only in its comprehensive and authoritative coverage of the field, but also in the quality of its contributors, and the diversity of theoretical and methodological approaches included. The resulting volume is a ′must have′ for all scholars and advanced students of the EU and European integration.

Book excerpt: In this important compendium, one of the leading scholars of EU law and its legal framework, reflects on his previous writings in the context of current challenges the European project is facing. More than a simple restatement, it offers an important theoretical comment at this defining time for EU law. The author offers a welcome counterbalance to what some perceive to be a surfeit of optimism when assessing the EU and its development. In so doing, Professor Joerges identifies three flaws in the current European ideology. Firstly, he points to the intellectual weakness of the “integration through law” ideology. Secondly, the book sets out the systematic neglect of “the economic” and its political dynamics. Finally, it addresses the complacency with respect to Europe's darker legacies. This is an important critical (and candid) assessment of Europe at its half century.

Available in PDF, EPUB and Kindle. Book excerpt: This book explains the emergence and functioning of three forms of governance structures within the context of the European integration and constitutionalisation process: comitology, (regulatory) agencies and the Open Method of Co-ordination. The point of departure is the insight that the intergovernmental/supranational distinction, which most theories of European integration and constitutionalisation rely on, has lost its strength. A new paradigm of EU research is therefore needed. Against this background it is suggested that the distinction between governing and governance provides a more appropriate basis for analysing the phenomenon of integration and constitutionalisation in Europe. The distinction between governing and governance allows for an understanding of the EU as a hybrid consisting of a governing dimension, characterised by legal and organisational hierarchy, and a governance dimension which operates within a network form characterised by legal and organisational heterarchy. The function of governance structures is to ensure the embeddedness of the governing dimension in the wider society. Instead of representing contradictory developments, the two dimensions are therefore mutually constitutive in the sense that more governing implies more governance and vice versa. These theoretical insights are illustrated through two detailed case studies which respectively reconstruct the operational mode of the Open Method of Coordination within EU Research & Development Policy and the regulatory system for the EU chemicals market (REACH). The book is inter-disciplinary in nature and incorporates insights from law, political science and sociology.

Available in PDF, EPUB and Kindle. Book excerpt: The book presents a theoretically informed typology of modes of governance which is tested in a careful selection of comparative country and policy studies. At the core is the question whether the European Union is destined to a network type of governance and whether and how this type of governance will be translated into the member states. The individual chapters subject the governing patterns at European and national level to empirical scrutiny. Drawing on recent research findings in different issue areas - including monetary union, social affairs, environment, genetic engineering and market liberalisation in transport, banking, energy, professional services - the contributions highlight the impact of the European activities on policy-making process in the member states.

Available in PDF, EPUB and Kindle. Book excerpt: This book sets out a novel conceptual and analytical framework to explain why risk analysis, cost-benefit analysis, and similar analytical tools have gained sizeable currency in public administrations, in comparative perspective. Situated in critical interpretive policy analysis methodology, the book systematizes and innovates respective debates in three ways. First, it develops a novel typology of actors’ appreciations of analytical tools as instrumental problem-solving, legitimacy-seeking, and power-seeking. It conceptualizes the latter two as "polity policies" with actors seeking to confirm or rework decision-making structures. Second, the book theorizes how executive fragmentation and the multiplication of coordination requirements – often treated as hindrances to substantial analytical turns in an administration – nourish actors’ ideal typical appreciations of analytical tools in distinct ways. Lastly, it scrutinizes varieties of risk analysis across three risk-heavy policy domains in Germany (including the EU) and discusses the potential of risk analysis to stabilize or transform decision-making in multi-level settings. This book will be of key interest to policy analysts and risk analysts, and scholars of European politics, comparative politics, policy studies, public administration, multi-level governance, EU studies, risk analysis, policy evaluation, and the political sociology of quantification.
