Book excerpt: This book analyses the status and prospects of the global governance of Access Benefit Sharing (ABS) in the aftermath of 2010’s Nagoya Protocol to the Convention on Biological Diversity (CBD). The CBD’s initial 1992 framework of global ABS governance established the objective of sharing the benefits arising from the use of genetic resources fairly between countries and communities. Since then, ABS has been a contested issue in international politics – not least due to the failure of effective implementation of the original CBD framework. The Nagoya Protocol therefore aims to improve and enhance this framework. Compared to the slow rate of progress on climate change, it has been considered a major achievement of global environmental governance, but it has also been coined a ‘masterpiece of ambiguity’. This book analyses the role of a variety of actors in the emergence of the Nagoya Protocol and provides an up-to-date assessment of the core features of the architecture of global ABS governance. This book offers a central resource regarding ABS governance for those working on and interested in global environmental governance. This is achieved by focusing on two broad themes of the wider research agenda on global environmental governance, namely architecture and agency. Furthermore, individual chapter contributions relate and link ABS governance to other prominent debates in the field, such as institutional complexes, compliance, market-based approaches, EU leadership, the role of small states, the role of non-state actors and more. Partly due to its seeming technical complexity, ABS governance has so far not been at the centre of attention of scholars and practitioners of global environmental governance. In this book, care is taken to provide an accessible account of key functional features of the governance system which enables non-specialists to gain a grasp on the main issues involved, allowing the issue of ABS governance to move centre-stage and be more fully recognised in discussions on global environmental governance.

Common wisdom holds that the earth's dwindling natural resources and increasing environmental degradation will inevitably lead to inter-state conflict, and possibly even set off “resource wars.” Many scholars and policymakers have considered the environmental roots of violent conflict and instability, but little attention has been paid to the idea that scarcity and degradation may actually play a role in fostering inter-state cooperation. Beyond Resource Wars fills this gap, offering a different perspective on the links between environmental problems and inter-state conflict. Although the contributors do not deny that resource scarcity and environmental degradation may become sources of contention, they argue that these conditions also provide the impetus for cooperation, coordination, and negotiation between states. The book examines aspects of environmental conflict and cooperation in detail, across a number of natural resources and issues including oil, water, climate change, ocean pollution, and biodiversity conservation. The contributors argue that increasing scarcity and degradation generally induce cooperation across states, but when conditions worsen (and a problem becomes too costly or a resource becomes too scarce), cooperation becomes more difficult. Similarly, low levels of scarcity may discourage cooperation because problems seem less urgent. With contributions from scholars in international relations, economics, and political science, Beyond Resource Wars offers a comprehensive and robust investigation of the links among scarcity, environmental degradation, cooperation, and conflict.

Its focus on engagement directs attention to processes instead of outcomes, which enables a more nuanced understanding of the role that China plays in global IP governance than the dichotomic categorisation of China either as a global IP rule-taker or rule-maker. This book identifies two groups of strategies that China has used in its global IP engagement: forum and agenda-related strategies and principle-related strategies. The first group concerns questions of where and how China has advanced its IP agenda, including multi-forum engagement, dissembling, and more cohesive responsive engagement. The second group consists of strategies to achieve a certain principle or manage contesting principles, including modelling and balancing. It shows that China’s deployment of engagement strategies makes its IP system similar to those of the EU and the US. Its balancing strategy has led to constructed inconsistency of its IP positions across forums.
