Book Synopsis Emergency Powers and the Courts in India and Pakistan by : Imtiaz Omar
Download or read book Emergency Powers and the Courts in India and Pakistan written by Imtiaz Omar and published by Martinus Nijhoff Publishers. This book was released on 2002-03-28 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fundamental premise of this study is that where Constitutions, such as that of India and Pakistan, articulate legal norms which limit the scope of the executive power to derogate from individual rights during states of emergency, there must likewise exist an effective control mechanism to ensure that the Executive acts within the scope of that power. Viewed from this perspective, the judicial power to interpret the Constitution imposes upon the Court the constitutional duty to provide adequate safeguards against the abuse of state power affecting individual rights. This power remains available notwithstanding the presumed or purported ouster of judicial review. The concept of judicial review as a source of control is examined in the light of the experience of Pakistan and India during periods of constitutional emergency. The divergent approaches of the Courts in these countries, in litigation concerning emergency powers and individual rights, are explained in terms of divergent views that these Courts have adopted with respect to the nature of judicial review.
Book Synopsis Judging the State by : Paula R. Newberg
Download or read book Judging the State written by Paula R. Newberg and published by Cambridge University Press. This book was released on 2002-05-16 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: The political history of Pakistan is characterised by incomplete constitution-making, a process which has placed the burden of constitutional interpretation on state instruments ranging from the bureaucracy to the military to the judiciary. In a penetrating and original study of the relationship between state and civil society in Pakistan, Paula Newberg demonstrates how the courts have influenced constitutional development and the structure of the state. By examining judicial decisions, particularly those made at times of political crisis, she considers how tensions within the judiciary, and between courts and other state institutions, have affected the ways political society views itself, and explores the consequences of these debates for the formal organisation of political power.

Book Synopsis Pakistan Enigma Political Development by : Lawrence Ziring
Download or read book Pakistan Enigma Political Development written by Lawrence Ziring and published by Routledge. This book was released on 2019-06-10 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume was conceived to serve a variety of reader categories. It should meet the needs of teachers and students engaged in the study of Pakistan; it is hoped that it will offer area specialists an enlarged perspective from which to examine their own findings; and it ought to prove useful to the general reader who wishes to keep abreast of the forces and events shaping our time. Every effort has been made to define the essential themes, to provide the pertinent data, to analyze the significant events thoroughly, and to present the material in a lucid, fast-moving manner. Overall the book should be both informative and provocative. Given my long association with Pakistan, the many years spent investigating and experiencing its development, the unique opportunities I have enjoyed for personal contact with the country's passing leadership as well as its diverse population, I have taken liberties which less-involved scholars would no doubt avoid. I make no apologies for this somewhat personalized approach, or for the pointed comments that will be found throughout the volume. The Pakistan story does not lend itself to sterile description. It is an exciting and important chronicle and it ought to be presented in a fashion that stimulates debate in addition to making available the necessary facts. I trust I have succeeded in fulfilling both objectives.

Book excerpt: This publication is designed to assist United Nations staff who provide human rights advice to States, which undertake to amend an existing constitution or write a new one. It should also be of use to States that undertake constitutional reform, including political leaders, policymakers, legislators and those entrusted to draft constitutional amendments or a new constitution. Further this publication should also facilitate advocacy efforts by civil society to ensure that human rights are properly reflected in constitutional amendments or new constitutions. Finally, this publication, along with the international human rights instruments, should not only provide a standard to measure whether constitutional amendments or a new constitution has appropriately reflected human rights and fundamental freedoms, but also assist in evaluating whether the processes used in constitutional reform are consistent with international procedural norms"--Introduction, page 1.

Available in PDF, EPUB and Kindle. Book excerpt: The United States Constitution is the oldest written constitution in the world. But what were its origins? Is it a “living” organism or, as the only alternative, a dead one? What influence, if any, has the U.S. Constitution had on Asian countries? Twenty scholars from around the world set out to pose answers to these questions. The result of their efforts is this book which looks at the U.S. Constitution from a global perspective. At times reinforcing existing knowledge, at times breaking new ground, the authors provide new insights into the role the U.S. Constitution has played in the development of governments in the two hundred years since its inception in 1787.
