Book excerpt: Analyzing globalization and the increasing tension it has caused between the goals of free trade and environmental protection, International Trade and the Protection of the Environment provides a comprehensive and detailed legal analysis, both at the national and international level of what looks set to become the new legal order of the twenty-first century. This book asks the questions does the treatment of ‘measures tantamount to expropriation’ have the capacity to lead to a ‘regulatory chill’ on environmental protection and what are the possibilities for claims before the UK courts that are based on alleged violations of international law? To answer them the author offers: an informed and critical commentary on the continuing controversy on GMO products, in particular on the recent WTO award in the EC-Biotech dispute a comparison of the treatment of the expropriation under NAFTA and bilateral investment treaties with position under article one of the first protocol of the European convention on human rights an analysis of the human rights dimension to claims for environmental damage against multi-national corporations, focusing particularly on claims in the US under the Alien Trot Claims Act 1789 Incisive and current, this text is a valuable tool for postgraduate law students studying international and commercial law.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides an up-to-date critical analysis of the integration of environmental policies into US free trade agreements. The work focuses on the evolution of the design of environmental policies and analyzes their effectiveness. Starting with the North American Free Trade Agreement (NAFTA) leading to the Trans-Pacific Partnership (TPP), the book examines the history of policy integration. In doing so, it provides an overview of the major trade-related environmental policies and presents empirical research on their effectiveness, a discussion of the continued demand for policy integration in light of the effectiveness, and recommendations for addressing shortcomings. The main objective of the book is to inform the ongoing policy debate over integration of environmental policies into trade agreements. The current renegotiation of NAFTA provides an opportune time for undertaking this critical review of trade-related environmental policies. As our understanding and knowledge of the environmental policies associated with US trade agreements, in particular for NAFTA, has grown significantly over the past twenty-five years, this book provides a timely and critical update for this policy debate. Students and scholars of environmental law, trade and economics, and specifically US trade, environmental policy and law will find this book of great interest.

Available in PDF, EPUB and Kindle. Book excerpt: A comprehensive, critical analysis of the interactions between investment, trade and the environment. It examines the consequences of existing multilateral investment and trade regimes, including the WTO and the MAI for the environment, and asks how they should be reformed to protect it. In doing so, the text shows how these regimes can be greened without erecting protectionist barriers to trade that frustrate the development aspirations of poorer countries. The solution seeks to offer a way out of one of the most difficult dilemmas in international policy: how investment and trade can protect the environment without encouraging protectionism by the industrialized world.

Available in PDF, EPUB and Kindle. Book excerpt: As the demand for environmental quality is increasing and as the current GATT rules monitored by the WTO are not very suitable for environmental protection, either a new international environmental organization may be formed soon or new environmental regulations may be added to GATT. In either case, understanding of the interactions between trade and the environment will be vital. Trade and the Environment presents both the theoretical and empirical exposition of (i) the impact of trade liberalization on environmental quality; (ii) the impact of environmental regulations on international competitiveness; and (iii) strategic trade and environmental policies. An important feature of Trade and the Environment as compared to earlier books is that it brings together the reciprocal interactions between trade and the environment. It can be used as the main or complementary textbook for a course on trade and the environment.

Book excerpt: Health, safety, and environmental regulations have been traditionally perceived as distinct entities from trade policy, yet today they have become intertwined on a global scale. In this pioneering work, David Vogel integrates environmental, consumer, and trade policy, and explicitly challenges the conventional wisdom that trade liberalization and agreements to promote free trade invariably undermine national health, safety, and environmental standards. Vogel demonstrates that liberal trade policies often produce precisely the opposite effect: that of strengthening regulatory standards. The most comprehensive account of trade and regulation on a global scale, this book analyzes the regulatory dimensions of all major international and regional trade agreements and treaties, including GATT, NAFTA, the Free Trade Agreement between Canada and the United States, and the treaties that created the European Community and Union. He explores in depth some of the most important trade and regulatory conflicts, including the GATT tuna-dolphin dispute, the EC's beef hormone ban, the Danish bottle case, and the debate in the United States over the regulatory implications of both NAFTA and GATT. This timely book unravels the increasingly important and contentious relationship between trade and environmental, health, and safety standards, paying particular attention to the politics that underlie trade and regulatory linkages. Trading Up is essential reading for the business community, policymakers, environmentalists, consumer interest groups, political scientists, lawyers, and economists.

Book excerpt: Freer Trade, Sustainability, and the Primary Production Sector in the Southern European Union is the first full-scale academic work to cap ture the primary production sector policy aspects of trade liberaliza tion and sustainability with a detailed focus on a typical southern EU country, Greece. Many efforts were pooled together in making this book. In May 1996 the Department of Economics of the University of Crete organ ized an international conference on European Agriculture in the light of the recent WTO agreement and the need for sustainable develop ment. The conference was sponsored by the European Commission (DG XII, contract no ENV4-CT-96-6514), the Economic and Social Research Council (ESRC, contract no L320263049), the Hellenic Ministries for Agriculture and for the Environment, and the University of Crete. While summarizing the conclusions of the conference, sev eral speakers felt that the issues relating to the Southern EU would de serve separate coverage. The conference directors judged that cover age of the issues for a single Southern EU country might have an ad vantage, regarding detail, over a cross country analysis which would certainly be welcome at a later stage. Responding to this call, the University of Crete generously reallo cated all of its infra-structural costs covered by DG XII, ESRC, and the other sponsors above, in the form of a new grant to host a follow-up conference aiming to explore the issues for Greece.
