Book excerpt: Access to health care abroad and patient mobility have generated active debate since judgments of the Court of Justice of the European Communities (ECJ) overruled the pertinent regulations, which made reimbursement by the social security system of medical services provided in another Member conditional on prior authorisation. In view of the Court these provisions infringed the principles of free movement of goods and services, which were held to apply to national social security systems. The rulings affected the balance between the economic freedoms enshrined in the Treaty which govern the internal market and the basic principles of social protection ensuring access to health care organised on a national level. The patients welcomed the Courtņs approach as a social improvement and a positive advance in the process of creating an internal market in health care. However, the Member States considered the rulings as encroaching on their prerogative of organising their protection and health systems in accordance with their own choices, operating rules and criteria for access to treatment and controls on the quality of care. Most of the governments also felt that unrestricted access to health care abroad would endanger the financial stability and planning requirements necessary for maintenance of essential health care services national territory. Up till now, the Member States do not share common interpretation of the jurisprudence and do not draw the same conclusions with regard to the right of patients to seek reimbursement for treatment abroad therefore cross-border mobility of patients is currently negligible. Since the issue is now attracting much attention, especially in countries where patients are confronted with waiting lists and other difficulties with access to specialised medical care further guidance is needed. This paper will present the major issues relating to the free movement of patients in the EU and assess the justificatory arguments put forward by the Member States. Moreover, it will consider whether the new legislative reform and simplification of the coordination Regulation and proposal of the Directive on Services in the Internal Market will bring better solution and more legal certainty into the issue of patient mobility.

EU member States independently develop their own health systems, based on the goals they wish to pursue, without really considering consistency with European Community (EC) law. The impact of European integration is, in turn, mainly indirect and has emerged from European Court of Justice (ECJ) rulings. These rulings have arisen either from considerations in other sectors or through the process of addressing particular issues within single cases, leaving major issues of applicability unresolved. The evolving issue of free movement of patients is instructive. While not completely outlawing the use of a prior authorization system, recent ECJ rulings have radically restricted member States' discretion to determine their own policies by requiring that their decisions be necessary, proportional and based on objective and non-discriminatory criteria. By linking EEC Regulation 1408/71, on which cover for healthcare abroad has been traditionally based, with the free provision of services, the ECJ seems to have created difficulties and important uncertainties for the system of coordination of social security schemes.

Yet, it has also been criticized for engaging in judicial activism, restricting national regulatory autonomy, and taking away the powers of Member State institutions. In recent years, the Court appears to afford greater deference to domestic actors in free movement cases. Europe's Passive Virtues explores the scope of and reasons for this phenomenon. It enquires into the decision-making latitude given to the Member States through two doctrines: the margin of appreciation and decentralized judicial review. At the heart of the book lies an original empirical study of the European Court's free movement jurisprudence from 1974 to 2013. The analysis examines how frequently and under which circumstances the Court defers to national authorities. The results suggest that free movement law has substantially changed over the past four decades. The Court is leaving a growing range of decisions in the hands of national law-makers and judges, a trend that affects the level of scrutiny applied to Member State action, the division of powers between the European and national judiciary, and ultimately the nature of the internal market. The book argues that these new-found 'passive virtues' are linked to a series of broader political, constitutional, and institutional developments that have taken place in the EU.
