In addition to his important public and organizational roles (as president of the British and International Psychoanalytic Associations), Jones made significant contributions to psychoanalytic theory. When the Nazis invaded Vienna, he saved much of the assets and archives of psychoanalysis, at great personal risk, and made the arrangements for Freud to come to London. In his introduction, Mervyn Jones presents a sometimes surprising portrait of a thoroughly conventional man in what was then an unconventional profession. He describes tensions and conflicts among the early Freudians, and situates Freudianism with other theories that laid claim to scientific truth in the late nineteenth century. Free Associations presents an evocative picture of Wales and London at the turn of the century, and describes the developing profession of psychoanalysis. It is a dramatic story of success and failure, and of a young man and how he responded to the new, strange ideas of Freud. Book excerpt: First Amendment rights are hailed as the hallmark of the US constitutional system, protecting religious liberty, freedom of speech, freedom of the press, and freedom of association. But among these rights, freedom of association holds a tenuous position, as demonstrated in the 2010 Supreme Court ruling in Christian Legal Society v. Martinez, which upheld a public university’s policy requiring groups seeking official recognition to accept all students regardless of their status or beliefs. This demotion of freedom of association has broad ramifications for the constitutional status of voluntary associations in civil society, Luke C. Sheahan suggests. His book offers a cogent explanation of how this came about, why it matters, and what might be done about it. Sheahan’s argument centers upon what he calls the “First Amendment Dichotomy” in the Court’s theoretical framework: an understanding of the state and the individual as the two analytically exclusive units of constitutional analysis. Why Associations Matter traces this dichotomy through Supreme Court jurisprudence culminating in Martinez, revealing a pattern of free association treated only as an individual right of expressive association derived from the Speech Clause alone. Sheahan then draws on the political sociology of Robert Nisbet to make a case for recognizing the social importance of associations and institutions that cannot be reduced to their individual members or subsumed into the state for purposes of constitutional analysis. Translating the sociological qualities of associations into jurisprudential categories, Why Associations Matter provides practical advice for protecting freedom of association through the judiciary and the legislature—and guaranteeing this fundamental right its proper place in American society.

Their approaches are as various as one would expect. One is concerned with the bonds that hold associations together, and another with the tendency for the private to become public. One sees associations as interferences with democratic political processes, while another is more impressed by their positive values. Still another shows that the way in which they operate in the political process depends not only on the kind of association but also upon the political context within which they operate. Pennock and Chapman say that the theorist's job is to speculate and to interpret the facts as he sees them. It is also the theorist's job to suggest hypotheses for testing: to point to lines of inquiry that should be pursued. One cannot read the essays in this volume, without having his eyes opened--or opened wider--both to the paucity of information about the political features of voluntary associations and to the wide variety of aspects from which the subject needs to be approached. The kinds of questions that need to be examined can be grouped in categories. The first focuses on the individual: What kinds of memberships does he have? Even more, what is the effect upon him of membership in each kind of association? The second examines internal composition and workings of organizations. The third focuses on the state as a whole and the effect of organized groups upon it, the political processes of the associational structure of the society, and modes of behavior of these associations. Organized groups play an intermediate role in the polity. At the same time, the state, and those charged at any particular time with the performance of its functions, must look primarily to new associations within it to secure compliance with its law and for guidance in shaping those laws.
