Book excerpt: A scathing look at our legal system, Fraud Upon the Court explores the important topic of fraud committed in a case by a member of the court. Mary Maxwell discusses famous trials in which she believes fraud upon the court has occurred, including the trials of Troy Davis, James Earle Ray, and various 9/11 cases, and advocates the use of a Writ of Coram Nobis to remedy the frauds. The book also explains the biological reason people believe authority and how to have a court case set aside if the judge cheated, no matter how many years ago.

It is a story of depraved, pathological minds using thuggery, weaponry, and unthinkable brutality to obtain selfish, illegal, and antisocial goals. It is a story of a uniquely American criminal conspiracy that even the mafia would envy. This is the story of the current tyrannical state of the American judicial system, how it has evolved itself into one of the most heinous, pernicious, and harmful criminal organizations in American history-and how those who comprise it-American judges-literally get away with murder. My story focuses on participants in modern American litigation, including me (Christine Morrison) and my captors and tormentors-American robed tyrants known as judges. I share the experience within this "systemic criminal enterprise" operated according to the craven desires of the "family law industry,"-yes-an industry. The industry is populated by "specialist" lawyers, judges, social workers, psychologists, cops, and their parasitic cadre of extortionists, fraudsters, and malingerers-who's business model is identical to that of the mafia-use power, influence, fear, and intimidation to deplete the core of America-it's young families-by manipulation of the machinery of American family courts. The thuggery is topped by community leaders, highly educated, well-known, and influential, yet mysteriously robed, skillfully, quiet: American judges.

Purchasers can usually download a free scanned copy of the original book (without typos) from the publisher. Not indexed. Not illustrated. 1888 edition. Excerpt: ... constructive fraud. introductory. We have seen that to certain cases falling short of (real) fraud the law has given the name 'constructive' fraud, because, in certain particulars, it treats them as if they were cases of fraud.1 Of such cases two divisions may be made, in one of which the burden of proof, instead of resting upon the plaintiff as in proper cases of fraud, rests upon the defendant; in the other the burden rests, in accordance with ordinary principles, upon the plaintiff, the offence however turning, not upon the original purpose, but upon conduct subsequent. The first division embraces transactions between parties in fiduciary, confidential, or kindred relations. chapter I. fiduciary, confidential, and kindred relations. L Fiduciary Relations. 1. The General Principle. When a party, complaining of a particular transaction, such as a gift, sale, or contract, has shown to the court the existence of a fiduciary or a confidential relation between himself and the defendant, and that the defendant occupied the position of trust or confidence therein, the law raises a suspicion or, it is often said, a presumption of fraud; a suspicion 1 Ante, pp. 10-13. or presumption, arising as matter of law,1 that the transaction brought to the notice of the court was effected through fraud or, what comes to much the same thing, undue influence by the opposite party, by reason of his occupying a position affording him peculiar opportunities for taking advantage of the complaining party. Having special facilities for committing fraud upon the party whose interests have been intrusted to him, the law, looking to the frailty of human nature, requires the party in the superior situation to show that his action has been honest and honorab

Book excerpt: This Handbook is designed to help people dealing with civil lawsuits in federal court without legal representation. Proceeding without a lawyer is called proceeding "pro se1," a Latin phrase meaning "for oneself," or sometimes "in propria persona," meaning "in his or her own person." Representing yourself in a lawsuit can be complicated, time consuming, and costly. Failing to follow court procedures can mean losing your case. For these reasons, you are urged to work with a lawyer if possible. Chapter 2 gives suggestions on finding a lawyer. Do not rely entirely on this Handbook. This Handbook provides a summary of civil lawsuit procedures, but it may not cover all procedures that may apply in your case. It also does not teach you about the laws that will control your case. Make sure you read the applicable federal and local court rules and do your own research at a law library or online to understand your case. The United States District Court for the Northern District of California has Clerk's Offices in the San Francisco, San Jose and Oakland courthouses. Clerk's Office staff can answer general questions, but they cannot give you any legal advice. For example, they cannot help you decide what to do in your lawsuit, tell you what the law means, or even advise you when documents are due. There are Legal Help Centers in the San Francisco, Oakland and San Jose courthouses where you can get free help with your lawsuit from an attorney who can help you prepare documents and give limited legal advice. This attorney will not be your lawyer and you will still be representing yourself. See Chapter 2 for more details.

Book excerpt: An Inexplicable Deformity Volume 3 This book has been painstakingly researched and written in hopes of enabling the basic humane treatment for all those incarcerated in the United States today and in the future. Mr. Tripati has specializations in Public International Law, Public Law, and European Law. WHAT IS FRAUD UPON THE COURT? Kupferman v Consolidated Research Mfg., Corp., 459 F.2d 1072, 1078 (2nd. Cir. 1972) (emphasis added) fraud upon the court "embraces only that species of fraud which does, or attempts to defile the court itself, or is a fraud perpetrated by officers of the court so that the judicial machinery cannot perform in the usual manner its impartial task of adjudging cases that are presented for adjudication......while an attorney "should represent his client with singular loyalty that loyalty obviously does not demand that he act dishonestly or fraudulently; on the contrary his loyalty to the court, as an officer thereof, demands integrity and honest dealing with the court. And when he departs from that standard in the conduct of a case he perpetrates a fraud upon the court." ." Hadges v. Yonkers Racing Corp., 48 F.3d 1320, 1325 (2d Cir.1995) (emphasis added) (quotation omitted). Thus, consistent with the First Circuit's observation that fraud on the court does not encompass "gardenvariety fraud," Geo. P. Reintjes, 71 F.3d at 48, "[p]erjury constitutes fraud on the court only in special situations, such as when an officer of the court commits the perjury." Myser v. Tangen, No. C14-0608JLR, 2015 WL 502316, at *6 (W.D. Wash. Feb. 5, 2015). When the unsuccessful party is kept away from the court by a false promise of compromise, or such conduct as prevents a real trial upon the issues involved, or any other act or omission which procures the absence of the unsuccessful party at the trial. Further, it consists of fraud by the other party to the suit which prevents the losing party either from knowing about his rights or defenses, or from having a fair opportunity to present them upon the trial. In United States v. International Telephone & Tel. Corp., 349 F. Supp. 22, 29 (D. Conn. 1972), aff'd without opinion, 410 U.S. 919, (1973), the trial court explained: "The Degree of a civilization can be judged by entering its prisons"
