Im Zentrum der Untersuchungen steht dabei John Stuart Mills 1859 publizierter Essay "Über die Freiheit", in dem die bürgerliche oder soziale Freiheit thematisiert wird. Weil Mill schon in seiner Einleitung zu dem Schluss kommt, dass diese Freiheit nur dann gewährleistet werden kann, wenn der Mensch ein gewisses Maß an Verantwortung gegenüber seinen Mitmenschen übernimmt, soll insbesondere der Frage nachgegangen werden, in welcher Beziehung Freiheit und Verantwortung zueinander stehen. Dabei wird auch nachvollzogen, von welcher Freiheit bei Mill überhaupt die Rede ist und ob Mills Auffassung von Verantwortung das oben beschriebene Dilemma lösen könnte. Zuerst soll darin das Interesse auf die Entstehung des Textes gestützt werden. John Stuart Mill lebte in einer Zeit, die vor allem für ihre Umbrüche im philosophischen Denken bekannt ist. Um aufzeigen zu können, wie seine Gedanken von den Umständen dieser Zeit, aber auch von seinen Vordenkern geprägt wurden, sollen die Einflüsse auf seinen Essay "Über die Freiheit" an erster Stelle erläutert werden. Darauf aufbauend wird darauf verwiesen, wie die Begriffe Freiheit und Verantwortung bei Mill eingeführt werden. Denn diese bilden die Basis für den weiteren Gang der vorliegenden Untersuchung. Der nächste Abschnitt der Arbeit widmet sich der Freiheit des Individuums in der Gesellschaft. Um überhaupt aufzeigen zu können, wann ein Mensch frei ist oder nicht, muss der Begriff der Freiheit zunächst genauer untersucht werden. The function of the human brain is still a mystery. Until recently, only post-mortem tissue was available for a structural examination of the brain. Consequently, the examination results could only reflect the state at the end of life. However, in order to better understand the development and function of the human brain, dynamic and functional investigations of different human brain cells are necessary. This is where brain organoids, artificially grown in vitro miniature brains, provide the opportunity for more flexible research scenarios. At the same time, however, the use of brain organoids in research and therapy raises the question of how these new entities are to be treated from an ethical and legal point of view. Against this background, this volume aims at clarifying the normative implications of the use of brain organoids in research and therapy. The ethical reflections on the status of brain organoids, informed consent, human-to-animal chimeras and neuro-enhancement are mirrored by corresponding legal analyses. The ethical and legal assessments are preceded by an introduction to the scientific and medical background of the brain organoid technology. A final chapter will be devoted to the issue of whether international harmonization of normative standards for brain organoid research and therapy is feasible and advisable.
