Book Synopsis Resource Nationalism in International Investment Law by : Sangwani Patrick Ng’ambi
Download or read book Resource Nationalism in International Investment Law written by Sangwani Patrick Ng’ambi and published by Routledge. This book was released on 2015-11-06 with total page 202 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foreign direct investment in the natural resource industries is fostered through the signing of concession agreements between the host State and the investor. However, such concessions are susceptible to alteration by the host State, meaning that many investors now require the insertion of stabilization clauses. These are provisions that require the host State to agree that they will not take any administrative or legislative action that would adversely affect the rights of the investor. Arguing that it is necessary to have some form of flexibility in concession agreements while still offering protection of the legitimate expectations of the investor, Resource Nationalism in International Investment Law proposes the insertion of renegotiation clauses in order to foster flexible relationships between the investor and the host State. Such clauses bind the parties to renegotiate the terms of the contract, in good faith, when prevailing circumstances change. However these clauses can also prove problematic for both State and investor due to their rigidity. Using Zambia as a case study, it highlights the limitations of the efficient breach theory to emphasise the need for contractual flexibility.

Book Synopsis Minerals, Energy, and Economic Development in China by : James P. Dorian
Download or read book Minerals, Energy, and Economic Development in China written by James P. Dorian and published by Oxford University Press, USA. This book was released on 1994 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: China possesses one of the world's largest mining industries, and since 1949 the production of minerals and energy has played a critical role in its economic development. This is the only comprehensive source of information on China's mining sector available today. It presents a wealth of descriptive material, provides a detailed economic analysis of the industry and its role in China's industrialization process. James Dorian examines the history, practices, organizational structure, performance criteria, and constraints of the mining industry, than broadens his study to look at the interaction of the mining industry with other sectors of the Chinese economy. He argues that the growth of the mining industry in China has been instrumental to the nation's economic expansion, and analyzes its possible future after the recent industrial reforms.
Book Synopsis The Politics of Oil in Indonesia by : Khong Cho Oon
Download or read book The Politics of Oil in Indonesia written by Khong Cho Oon and published by Cambridge University Press. This book was released on 1986-07-03 with total page 266 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the relationship between foreign companies and government within the Indonesian oil industry. It is concerned in particular to identify those factors which determine the balance between central regulation and untrammelled company activity, in order to evaluate the choices which the government has to make in the creation of its policies. Given the extent of foreign investment in the mineral extractive industries of many of the less-developed countries, such policies are of major importance. From his study of the operation of Indonesian oil contracts, Dr Khong concludes that the formal terms of an agreement may well give a misleading impression of the actual allocation of the benefits from petroleum extraction. The common perception that a basic shift in favour of host governments has occurred is shown to be largely misplaced, whatever relative advances they may have achieved.
