Specifically, FW 44 modifies the Gulf of Maine (GOM) cod and pollock trip limits implemented in Amendment 16; provides the Administrator, Northeast Region, NMFS (Regional Administrator) authority to implement inseason trip limits and/or differential day-at-sea (DAS) counting for any groundfish stock in order to prevent catch from exceeding the Annual Catch Limit (ACL); and specifies Overfishing Levels (OFLs), Acceptable Biological Catch levels (ABCs), and ACLs for all 20 groundfish stocks in the FMP for FY 2010 through 2012, as well as the Total Allowable Catches (TACs) for transboundary Georges Bank (GB) stocks. Pursuant to current Regional Administrator authority under the FMP, this action also allocates zero trips to the Closed Area II (CA II) Yellowtail Flounder Special Access Program (SAP); limits the Eastern U.S./Canada Haddock SAP to the use of Category A DAS for common pool vessels; delays the opening of the Eastern U.S./Canada Area for trawl vessels; and implements a GB yellowtail flounder trip limit of 2,500 lb (1,125 kg). Finally, this rule makes technical corrections to Amendment 16 regulations. This literature review offers a survey of mitigation measures and techniques that have been developed and tested around the world, aiming to address both the incidental catch of highly mobile species – specifically, cetaceans, seabirds, sharks and rays, and sea turtles – and depredation caused by dolphins. Based on research detailed in over 300 documents, including peer-reviewed publications, reports from international organizations and papers available on the internet, most of the mitigation techniques illustrated are still under development, with only a few already adopted through legislation. The selected mitigation measures are grouped by main types of fishing gear – gillnets and trammel nets, longlines and lines, trawls, purse seines, traps and pots – and further subdivided according to which of the four main groups of vulnerable species – cetaceans, seabirds, sharks and rays, or sea turtles – they are designed to protect. Preventive and curative approaches covering both technical measures (gear modifications, strategies, as well as acoustic, visual, magnetic and chemosensory deterrents) and management measures are described.

Book excerpt: "This document provides technical assistance for description, identification, conservation, and enhancement of EFH, and is designed to aid Fishery Management Councils (Councils) in implementing the EFH requirements of section 303 and 305 of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act, 16 U.S.C. 1801 et seq.). This manual also describes how NMFS, acting on behalf of the Secretary of Commerce (Secretary), will implement its EFH requirements under the Magnuson-Stevens Act. Additionally, the manual will implement its EFH requirements under the Magnuson-Stevens Act. Additionally, the manual elaborates on the procedures for the statutorily required consultations for Federal actions that may adversely affect EFH and recommendations made to any state agency for any actions undertaken that may adversely affect EFH. Finally, it is intended to be updated regularly, e.g., as new and innovation methods become available in habitat identification and mapping. This effort supports Congress' intent that habitat considerations receive increased attention for the conservation and management of marine fishery resources (sec 2(a)(9) of the Magnuson-Stevens Act).
