FirstGroup is a UK-based transport company with bus, tram and rail operations across the UK and North America and currently operates four passenger rail franchises in the UK (First Great Western, First Great Western Link, First Trans Pennine Express and First ScotRail, along with a non-franchise "open access" rail service (Hull Trains), and will also operate the Thameslink/Great Northern franchise from 1 April 2006. The new franchise will run for seven years from 1 April 2006, and was awarded to FirstGroup by the Department of Transport on 22 December 2005. The Commission has decided that substantial lessening of competition (SLC) will not result from the merger, either for the alternative public transport services available for their "point-to-point journeys" or to the wider network markets.

Book excerpt: It is thirteen years since the Railways Act 1993 started the process of privatising British Rail, replacing it with one company owning and managing the infrastructure, an open-access system for freight services and a series of twenty-five passenger franchises let to private companies for a specified period of time. This period has seen almost continuous change, and there is now a new 'triumvirate' framework with the Department for Transport, the Office of Rail Regulation and Network Rail in place, with the third generation of franchises in the process of being let and the number being reduced to nineteen. The Committee's report examines the current franchising system, focusing on the coherence of its objectives, the effectiveness of the process for awarding franchises and the management of franchise agreements, and whether more competition and vertical integration is needed. Findings include that the current system represents a policy muddle which lacks a coherent framework for the development of good services and delivery of value for money for passengers and taxpayers. The only way the Government can increase capacity and improve services for the long-term is to drop the dogmatic pursuit of competition in its decision-making as to what the private and public sectors can and should do in future. The Government's forthcoming long-term strategy for the railways will need to address these issues, and to set out a structure and a strategy capable of securing quality passenger rail services to meet demand over the next half a century.

Book excerpt: In this report (released online in 2010), the Competition Commission (CC) has permitted FirstGroup to vary undertakings it gave when it took over the Scottish rail franchise in 2004. The changes will allow FirstGroup to withdraw seven loss-making bus routes and modify a further eight covered by the undertakings in Glasgow and Edinburgh. Of the services being withdrawn, five are in Edinburgh and two in Glasgow; all the routes being modified are in Glasgow. The CC has also refused permission for FirstGroup to modify one other route in Glasgow. The CC has allowed the changes having been satisfied that there is no reasonable prospect of the routes becoming profitable. The CC has found that FirstGroup's proposals have not been made for the purpose of switching passengers from bus to rail services, which was the concern identified in 2004. The changes will not therefore undermine the purpose of the original undertakings. Alternative bus services are available on the parts of routes concerned -many of these services are operated by FirstGroup and will remain controlled by the undertakings.

The book focuses particularly on the work of the Strategic Rail Authority (SRA), and considers the role of individuals --John Prescott, Stephen Byers, Alistair Darling, Sir Alastair Morton, and Richard Bowker--and events--the Hatfield accident (2000), the demise of Railtrack (2001-2), and the funding crisis of 2003-4--in the shaping of emerging policy. The book was commissioned by the SRA, and written with access to government files. Dr. Gourvish argues that the establishment of the SRA as a Non-Departmental Public Board proved largely unsuccessful. It produced tensions with the industry's existing institutions--Railtrack/Network Rail, the operating companies and the economic regulator. There were some gains from the experiment, notably the rescue of the West Coast Main Line project. However, it remains to be seen whether by winding up the SRA and taking responsibility for strategy and funding back into its own hands the Department for Transport has resolved the problem of managing a fragmented industry. This important book is essential reading for those concerned with, and interested in, railway policy, both in the UK and elsewhere in the world.
