Book Synopsis Criminal Justice Policy Making by : Barbara Stolz
Download or read book Criminal Justice Policy Making written by Barbara Stolz and published by Praeger. This book was released on 2002 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: The how and why of criminal justice policy making is frequently overlooked in criminal justice texts. Stolz fills that gap with this reader, which introduces students to the study of criminal justice policy making at the federal level by drawing on the discipline of political science. Each chapter includes • academic and government publications that acquaint the reader with federal criminal justice policy-making structures and processes • criminal justice policy-making issues related to each branch of government • several political science frameworks, used to explain how governmental structures and processes affect criminal justice policy Stolz begins with an introduction to the background of federal criminal justice policy making. She then moves to the three branches of the federal government involved in the process. In addition, a chapter on non-decision making, where policy makers do not consider certain alternative policies, is included. Each chapter begins with a careful introduction by the editor and concludes with recommendations for further reading, including important electronic resources for further consideration. The selections in this work include academic and government publications and speeches that help to shed light on this important area of criminal justice studies. This unique volume provides the tools for analyzing how criminal justice policy is made.

Book excerpt: "The report identifies seven hallmarks of a developmental approach to juvenile justice to guide system reform: accountability without criminalization, alternatives to justice system involvement, individualized response based on needs and risks, confinement only when necessary for public safety, genuine commitment to fairness, sensitivity to disparate treatment, and family engagement. Implementing Juvenile Justice Reform outlines how these hallmarks should be incorporated into policies and practices within OJJDP, as well as in actions extended to state, local, and tribal jurisdictions to achieve the goals of the juvenile justice system through a developmentally informed approach."--Publisher's description.

Book Synopsis The Politics of Federal Prosecution by : Christina L. Boyd
Download or read book The Politics of Federal Prosecution written by Christina L. Boyd and published by Oxford University Press. This book was released on 2021-01-01 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: Federal prosecutors have immense power and discretion to decide when to bring criminal charges, what plea bargains to offer, and how to implement the federal government's legal priorities in their districts. While U.S. Attorneys take pains to emphasize their independence, we know relatively little about the extent to which politics colors federal prosecutorial staffing and decision making. The Politics of Federal Prosecution draws upon a wealth of data from 1990s to the present to examine the interplay of political factors and federal prosecution. First, the authors find that congressional and presidential politics affect who becomes federal prosecutors and how long those individuals serve. Second, the book demonstrates that signals of presidential and congressional preferences, along with local priorities, affect key prosecutorial decisions: whether to bring prosecutions, how to approach plea bargaining negotiations, and when to utilize criminal asset forfeiture to cripple criminal activities. In short, the book demonstrates that politics affects the behavior of U.S. Attorneys at nearly every stage of their service.

Book excerpt: Intended for federal, state, and local policymakers in the area of criminal justice research and development, this report includes guidelines for improvement of the quality, relevance, and utilization of research results. In order to cover these issues, part two of this report focuses respectively on the needs of research and development policymakers who fund criminal justice research and development, researchers who conduct research and development, and practitioners who put research and development results into use. Guidelines and principles are proposed which should assist policymakers at all levels of government. However, some topics tend to be addressed more to the federal level, where major research and development decisions are often made. The first chapter of this part presents a detailed discussion of institutional support for criminal justice research and development. It describes the federal role in supporting this effort, focusing on who the agencies are, the extent of their involvement, and how the principal agencies are organized to manage their research and development programs. Recommendations regarding the research and development management activities of criminal justice funding agencies are included. Several important issues in the conduct of criminal justice research and development are examined in the second chapter. Among the topics discussed are constraints on research, ethical issues, research designs and methodologies, prerequisites for sound planning and project selection, ways of maintaining the confidentiality of data, and ways of making data more easily available for research and statistical purposes. The final chapter of this section discusses research and development utilization practices and the assumptions underlying current policies in this area. A criticism of these policies and recommendations for new strategies is presented. The final part of this report provides an analysis of the kinds of problems often encountered in research and development. Three general types of criminal justice research and development are discussed: technology (e.g., hardware) research, research on problems of criminal justice organizations (e.g., arrest, prosecution, sentencing, and parole), and research on new criminal justice problems. For each type of research and development, the relevant issues and recommendations are discussed. Most of these, however, still related to either the support or conduct of research and development. The report also attempts to provide concrete illustrative examples by raising the relevant issues in the context of crime prevention at commercial and residential sites (technology research), sentencing (research on problems of criminal justice organizations), and problems of the victim (research on new criminal justice problems).

Book Synopsis The Criminal Justice System: Its Functions and Personnel by : George T. Felkenes
Download or read book The Criminal Justice System: Its Functions and Personnel written by George T. Felkenes and published by . This book was released on 1974 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a study of the duties, functions, qualifications, selection processes, and potential for advancement associated with law enforcement, courts, and correctional personnel. The specific roles and the personnel that comprise the operating criminal justice system are identified and analyzed in this study. Detailing not only duties and functions, but also qualifications, selection processes, and even potential for advancement, the work forms an unusual perspective of the field for students of law enforcement, police science, criminal law, criminology, and corrections. The study details over fifty-five distinct professions within the criminal justice system, and discusses the qualifications required and the tasks performed by each. A major section of the book is its examination of the prosecutorial function - the powers and duties, the major concepts and criticisms of the role of the prosecutor, and the multi-faceted role of the defense attorney, including his duties and professional responsibilities, as well as the function of court appointed counsels and public defenders. Law enforcement is viewed at every level from municipal through federal agencies, with a focus on police legal advisors, criminalists, and the numerous other individuals who comprise the total law enforcement complex. The function of the court is presented through the roles of the various court officers - judges, juries, grand juries, bailiffs, clerks, and reporters. Each is discussed in terms of qualifications, duties, and function in the mechanics of the courtroom procedure. A final section covers the corrections system - the custodial and institutional personnel, as well as the juvenile, probation and parole officers who work with offenders in the community.
