Furthermore, the book serves to inform the congressional debate over rulemaking by analysing different ways to measure federal rulemaking activity; describes the existing requirements for cost-benefit and other types of analysis in the federal rulemaking process; and discusses options for changing the current set of analytical requirements.

The annual cost of federal regulations in the U.S. increased to more than $1.75 trillion in 2008. Had every U.S. household paid an equal share of the federal regulatory burden, each would have owed $15,586 in 2008. While all citizens and businesses pay some portion of these costs, the distribution of the burden of regulations is quite uneven. The portion of regulatory costs that falls initially on businesses was $8,086 per employee in 2008. Small businesses, defined as firms employing fewer than 20 employees, bear the largest burden of federal regulations. This report shows that as of 2008, small businesses face an annual regulatory cost of $10,585 per employee, which is 36% higher than the regulatory cost facing large firms (500+ employees). Ill.

Although not as frequently examined as congressional or presidential policy making, the process of developing and framing rules is viewed by some as central to the definition and implementation of public policy in the United States. Federal agencies issue thousands of regulations each year to achieve national goals. For the few hundred of these rules deemed to be significant, agencies are required to assess expected costs and benefits. For the subset of these rules estimated to have the greatest economic impact, agencies must also include an assessment of alternatives. This book addresses how often and to what extent significant, economically significant, and major rules include key elements for assessing or analyzing benefits and costs; and how and to what extent agencies assess the quality of the scientific, technical, and other types of data they use to consider benefits and costs. The purpose of this book is to provide Congress with an overview of the federal rulemaking process and a brief discussion of the major laws and executive orders that prescribe the procedures agencies are to apply when promulgating regulations.

The first is found in the Office of Management and Budget's 2005 report to Congress on the benefits and costs of federal regulations (OMB 2005b). OMB estimates annual benefits in 2004 to be $70 to $277 billion and costs to be $34 to $39 billion, but these estimates omit a great deal; the cost estimate, in particular, is generally acknowledged to be an underestimate. The other estimate, written by Mark Crain (Crain 2005) and sponsored by the Small Business Administration, uses a different approach and generates an estimate of $1 trillion. Crain also finds that the burden on small firms is much greater than the burden on large firms. In the final section of the paper, I also review a recent comparison, presented in the 2005 report to Congress, of ex ante and ex post estimates of the benefits and costs of individual regulations. I find the Crain report to be deeply problematic and the OMB's ex ante/ex post comparison slightly less so.
