Book excerpt: For decades, Congress has enacted laws authorizing generic promotion programs for a number of farm products to increase overall demand and consumption of the agricultural product. These generic promotion programs, commonly known as "check-off" programs, are funded through the payment of mandatory assessments imposed on the amount of product that a covered party sells, produces, or imports. Some producers have opposed the use of generic advertisements and have brought First Amendment challenges in court. Generally, these parties claim that they should not be required to pay for advertisements (i.e., speech ) with which they disagree. The Supreme Court has ruled on the constitutionality of check-off programs three times in the last eight years, the most recent of which occurred in May 2005. The Court's first two attempts at addressing First Amendment challenges to checkoff programs resulted in contrasting outcomes and some confusion for lower courts. In Johanns v. Livestock Marketing Association, the Supreme Court's third and most recent decision concerning a check-off program (beef), the Court ruled that the generic advertising under the program was the government's own speech, and was therefore not susceptible to the First Amendment challenge before it. The Supreme Court's decision was based on grounds that had not been previously addressed by the Court in the earlier check-off cases and may have far-reaching effects. For example, three circuit court rulings that invalidated other check-off programs have already been vacated by the Court for reconsideration in light of Johanns. This report begins with a brief introduction to check-off programs and then describes many of the First Amendment principles that have been discussed in checkoff cases. Next is an analysis of the first two challenges that reached the Supreme Court, as well as a brief discussion of subsequent lower court decisions. This report concludes with a discussion of Johanns v. Livestock Marketing Association and its possible implications for check-off programs. This report will be updated as warranted.

Today's hearing is intended to focus on both the beef industry Long-Range Plan and proposed changes to the National Dairy Promotion and Research Board contained in Senate bill 1557 an Senate bill 1564. The subcommittee will examine how various organizations, producer members and checkoff contributors will be represented under the consolidation plan of the Beef Industry Council and the Cattlemen's Beef Board, the U.S. Meat Export Federation, and the National Cattlemen's Association. It is my understanding that the consolidation plan is aimed at making the beef industry efforts for promoting beef and research activities more efficient by reducing overhead and duplication between the four groups who share similar interests. The net effect of the consolidation is intended to provide more money for market development, industry promotion and research, instead of overhead, salaries, and staff costs. Because the plan proposes merging groups with separate missions, and some have missions related to lobbying and others are primarily concentrated on market development and research, the subcommittee is interested in determining how checkoff dollars will remain separate from lobbying activities as required by the Beef Promotion and Research Act of 1985. I remember well the creation of the Beef Checkoff Program which has turned out to be one of the most successful programs of its kind in the country. [...] The mere fact that one or more producers 'do not wish to foster' generic advertising of their product is not a sufficient reason for overriding the judgment of the majority of market participants, bureaucrats, and legislators who have concluded that such programs are beneficial."4 In the second case, the Supreme Court on June 25, 2001, ruled 6-3 that mandatory assessments for the mushroom check-of [...] The Court said that the mushroom check-off is a stand-alone program that is not part of a broader regulatory scheme, as was the peach/nectarine marketing order, and ". for all practical purposes, the advertising itself, far from being ancillary, is the principal object of the regulatory scheme. [...] The district court further ruled in the case that the generic advertising conducted under the Beef Promotion and Research Act and the ensuing Beef Order is not government speech.
