While demographic trends seem to suggest that family structures and attitudes within the European Union are converging and that member states are facing similar social problems, their policy responses are very different. This book examines the differences between these national responses and that of the EU as contained in the social chapter. It analyses the key concepts underlying the formulation of family policy and illustrates it with the latest data much of it hitherto unpublished.

Book excerpt: The Present and Future of European Family Law explores the essence of European family law – and what its future may be. It compares and analyses existing laws and court decisions, identifies trends in legislation and jurisprudence, and also forecasts (and in some cases proposes) future developments. It establishes that while there is, at present, no comprehensive European family law, elements of an ‘institutional European family law’ have been created through decisions by the European Court on Human Rights and by the Court of Justice of the European Union as well as other EU instruments. At the same time an ‘organic European family law’ is beginning to emerge. The laws in many European jurisdictions have developed similarly and have ‘grown together’, not only as a result of the aforementioned institutional pressures, but also as a result of societal developments, and comparable reactions to medical and societal advances and changes. Hence there already is a body of institutional and organic European family law, and it will continue to grow. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

The expert members of the CEFL have drafted national reports on the basis of a detailed questionnaire. These national reports, together with the relevant legal provisions, are available on CEFL's web site (www.law.uu.nl/priv/cefl). This book integrates all the given answers in order to provide an overview and a straightforward simultaneous comparison of the different solutions chosen within the national systems. On the basis of this reliable and comprehensive comparative material the CEFL will be able to draft Principles of European Family Law regarding Parental Responsibilities.

Book excerpt: The Principles of European Family Law - drafted by the Commission on European Family Law (CEFL) - contain models which may be used for the harmonization of family law in Europe. This book contains the Principles regarding property relations between spouses. In these Principles, the CEFL has developed an all-inclusive set of rules for two matrimonial property regimes: the participation in acquisitions and the community of acquisitions. Both regimes have been put on an equal footing. Each matrimonial property regime, whether it functions as a default or as an optional regime, is strongly connected with the rights and duties of the spouses and the possibility for them to make a marital property agreement. These issues have also been addressed by including two common chapters on the general rights and duties of spouses and on marital property agreements, which are to be applied regardless of which of the regimes applies. Available in PDF, EPUB and Kindle. Book excerpt: The Impact of Institutions and Organisations on European Family Law looks at the impact that institutions and organisations have had, and continue to have, on European family law. In many ways the chapters in this volume provide the easiest explanation for the existence of a European family law. While there is no European body that could actually legislate definitively on family law – even the European Union has no such mandate – there are still some obvious institutions that have a very direct impact on European family law. These can be divided into two groups; namely those that have a direct impact, such as the European Court of Human Rights and the European Union, and those that have an indirect impact, such as the Commission on European Family Law (CEFL), the Council of Europe and the International Commission on Civil Status (ICCL/CIEC) as well as the private international law instruments of the Hague Conference (HCCH) and the EU. Together, with religion, all of these institutions are contributing to the creation of a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

Book excerpt: At present, our knowledge of the current state of solidarity between parents and their adult children in Europe is limited. Insight into contemporary intergenerational solidarity is not only important for the well-being of individuals but is also of great interest to policy makers. Patterns of intergenerational solidarity are not only affected by social policies and services but also reveal a number of important social policy issues and dilemmas. Will encouraging labour force participation among women and older workers mean they have less time to care for their dependents? Should formal care services be further expanded to relieve the burden faced by family members with the risk that they start to replace informal care? This report aims to contribute to this insight by providing a more differentiated picture of the strength, nature and direction of solidarity between parents and their adult children, its variation among European countries and its determinants. Our findings indicate that parent-child ties are quite strong. The majority of Europeans aged 50 and over live in close proximity and are in frequent contact with at least one of the children. Moreover, strong family care obligations still exist and a substantial amount of support is being exchanged between parents and their non-co resident children. Interesting differences, however, emerge between individuals and countries. While fathers are more inclined to assist their children financially, mothers have more frequent contact and exchange more help in kind with their children. Being religious and having a large family have a positive impact on several dimensions of intergenerational solidarity. Parental divorce and a better socioeconomic position of parents and children, on the other hand, lead to a weakening of parent-child ties in many respects. Contrary to common belief, employed children show solidarity with their parents as much as those without a paid job. Differences in the nature of intergenerational solidarity between the European countries tend to follow the general division into an individualistic north and a familistic south.

Book excerpt: The Changing Concept of 'Family' and Challenges for Domestic Family Law explores the changing concept of 'family', with the current social, political, medical and scientific challenges for domestic family law discussed in over 20 European jurisdictions. National reports describe the current law and legal development for 'horizontal' (the law of relationships between adults such as marriage, divorce, cohabitation, same-sex relationships), 'vertical' (the law governing the relationships between adults and children, such as parentage including artificial reproductive techniques and surrogacy, parental responsibility and adoption) and 'individual' (the law of names and recognition of gender identity) family law. They show that, while considerable legal and societal diversity still exists within Europe, family law, in many areas, is developing along similar lines, with a convergence towards a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: Will the European Union have its ¿single family - a ¿European family - as it will have a single currency? This is the question at the origin of this book. Studies of family behavior and the organization of private life among European citizens, as well as of family member social status (children in relation to adults/parents, women in relation to men), and of social functions of the family, for example social reproduction, reveal so much convergence among European families that the reality of a ¿European family seems inevitable, and more so if one looks at foreign studies done - in Australia, the United States or Japan - of the family in Europe. However, studies of the different judicial and public policy laws in the different European Union member countries lead one to refine this first impression. The family does not have the same legal meaning in all places, and the ways in which it is defined by law and public policy continue to differ strongly, due in particular to historical factors, cultural traditions, and conceptions of the role of the State. In order for the family to be part of the construction of a European citizenship, the pluralistic nature of its political definitions will have to be recognized. Putting the family into the context of evolving European integration has never been done before. It was made possible in this study thanks to the joint efforts of two editors with long experience in social science studies of the family and as expert advisors to the European Commission, and by the work of the best international specialists in the field. This is a book intended for specialists working in the social sciences, for social and government policy-makers in the fields of family and social policy, and for all those interested in European integration.

The interventions written by both experienced family experts as well as young researchers cover those fields of family law that are closely related to the activities of the CEFL: (1) divorce and maintenance between former spouses, (2) parental responsibilities, (3) informal long-term relationships and (4) the revised Brussels II Regulation. Furthermore, the opening two contributions deal not only with essential aspects of the harmonisation process of family law in Europe but also with the CEFL's working method.
