Both games are strategically equivalent to the dictator game, in that one player has the unilateral ability to determine the allocation. However, that player can instead choose to share decision-making power with the other. In this way, I take a broader view of fairness than past experiments, considering both distributive justice (how much I get) and procedural justice (the rules governing how I get it). First, players often decide to empower the other player, even though there is no strategic reason to do so, implying an innate concern with procedural justice. Second, divisions in these games are much more equitable than in traditional dictator games, suggesting that a fair procedure may elicit fair distribution. Thus, past rejection of the fairness hypothesis (arguing that fairness concerns would lead to similar distributions in the ultimatum and dictator games) may be due to a failure to account for fairness as both a distributive and procedural concern.

Book excerpt: Two new bargaining games, called "Freedom to Punish (FTP)" and "Right and Choice to Punish (RAP)", are developed, analyzed and tested by means of an experimental implementation. Hypotheses about behavior are developed, discussed and tested. The central hypotheses are aimed at the importance of freedom of choice, on the difference between the FTP game and the RAP game, and on the crowding-out of intrinsic motivation. As might have been expected, fairness plays a role in both games, represented by the frequent appearances of equal splits as well as by the frequent rejections of unfair offers.In addition to that, fairness was crowded out by the new Institution of a veto power decision, confirming the importance of the institutional setting for behavior. Contrary to the few veto power sales in the RAP game, an amazingly high number of receivers refrained from veto power in the FTP game. This significant difference has clearly been attributed to the different information conditions and the existence of a bonus. This bonus can be interpreted in terms of freedom of choice, and exploits a value for the freedom to choose for the first time in experimental economics.

Fairness, inherently a type of social preference, impacts distributive decision-making. How does power shape the perceptions of fairness in economic interactions? While previous research finds that power holders tend to take more, it remains unclear whether they are driven by selfish motives to exploit weaker counterparts or act upon the belief that powerful individuals deserve more. With an innovative modified ultimatum game, we analytically and experimentally study how power interplays with fairness consideration to affect bilateral bargaining. We concentrate on behaviors by the responders, to elicit their fairness preferences in response to shifts in power. We find strong evidence that changes in power can modify what is perceived as a fair division in the modified ultimatum game, and thus influence the distributive behaviors and outcomes. However, such an effect only arises when there is common knowledge about the power distribution between the two parties prior to their decision-making. In addition, we find that, while feedback on past decisions and outcomes can help players fine-tune their choices to avoid money left on the table in bargaining, learning from experience is not required for power to take effect.

In this last game the allocator and recipient both have the same initial endowment and bargain about how to divide a certain loss. In Experiment 1 we show by means of a word completion task, that the justice concept was more salient in the negative valence UBG than in the positive valence UBG. In Experiment 2 we studied the behavior and motives of allocators. We show that allocators in the negative valence UBG allocated more to the recipient than allocators in the positive valence UBG. Additionally, the influence of self-interest and fairness fully mediated this effect. Taken together, we show that ultimatum bargaining situation about losses is not the same as bargaining about gains. We explain our results in terms of the 'Do-no-harm'-principle (Baron, 1996).
