A wide range of economic activity is subject to the laws of more than one state, yet there is little provision for resolving situations where states impose contradictory requirements. This paper is particularly concerned with four areas of difficulty: extraterritorial anti-trust enforcement; overlapping regulatory claims; economic regulation for political aims; and different approaches to adjudication.
Book Synopsis Export Controls as Instruments of Foreign Policy by : Homer E. Moyer
Download or read book Export Controls as Instruments of Foreign Policy written by Homer E. Moyer and published by University Press of America. This book was released on 1988 with total page 504 pages. Available in PDF, EPUB and Kindle. Book excerpt: Export controls have become an increasingly important foreign policy tool. The authors of this important new work focus on how the United States used export controls during the seizure of American hostages in Iran, the Soviet invasion of Afghanistan, and the declaration of martial law in Poland. They address the legal issues related to the use of export controls as well as the broader policy issues. Because export controls are often viewed as an effective middle course between military action and diplomacy, the authors foresee their increased use. Much of this book appeared, in a slightly different form, in the journal Law and Policy in International Business.

Book Synopsis Defining the Extraterritorial Reach of American Export Controls by : Kenneth W. Abbott
Download or read book Defining the Extraterritorial Reach of American Export Controls written by Kenneth W. Abbott and published by . This book was released on 2009 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the United States began systematically to restrict exports in peacetime for national security and foreign policy purposes, foreign opposition to the extraterritorial reach of American export controls has been rife. The Reagan Administration's efforts to delay completion of the Soviet Union's natural gas pipeline to Western Europe raised foreign concern over American claims of extraterritorial jurisdiction to new heights. The jurisdictional reach of the pipeline sanctions was in several respects unprecedented. The foreign response was similarly unprecedented: both the British and French governments acted to block the application of the American controls, while other European governments openly urged that the controls be defied. Given the underlying realities of the international economy and the "dynamic of escalation" that some observers have discerned, there is every reason to fear that similar confrontations will be played out in the future. This article argues that the current period of relative calm in trans-Atlantic political relations provides an unusual opportunity to seek at least partial resolution of a jurisdictional controversy that has split the United States and its major trading partners for over thirty years. The article does not attempt to analyze the principles and precedents of international law on the reach of national jurisdiction. Rather, it argues for a practical solution to the dispute, centering on international negotiations. In particular, the article suggests that Congress could be an effective catalyst of such a dispute resolution process and outlines a course of action that Congress might follow to perform this function.

This book was released on 2023-09-20 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is based on an international conference at the University of Tokyo on CoCom and its related export control system'. Despite the changes in the overall political climate, such as the new thinking' in Soviet foreign policy, it seems that CoCom will continue to function for some years. Although the scope of control has been narrowed, the control itself has been tightened. All the old problems which caused conflicts within and outside CoCom still exist. The United States is still exercising export controls in an extra-territorial way via its extensive re-export control system. The 1988 Omnibus Trade and Competitiveness Act remains unaltered, notwithstanding its controversial nature. This book is a major contribution to the discussion of current legal and political issues concerning export controls, a discussion which has gained greatly in importance as a result of the Gulf crisis.

But the threat of the Soviet sphere is rapidly being superseded by state-sponsored terrorism; nuclear, chemical, biological, and missile proliferation; and other critical security factors. This volume provides a policy outline and specific steps for an urgently needed revamping of U.S. and multilateral export controls. It presents the latest information on these and many other pressing issues: The successes and failures of U.S. export controls, including a look at U.S. laws, regulations, and export licensing; U.S. participation in international agencies; and the role of industry. The effects of export controls on industry. The growing threat of "proliferation" technologies. World events make this volume indispensable to policymakers, government security agencies, technology exporters, and faculty and students of international affairs.
