Uno degli strumenti giuridici di maggiore interesse è rappresentato dalla cd. Responsabilità estesa del produttore (del prodotto) ("Extended Producer Responsibility", EPR), una strategia volta alla regolamentazione dell'intero ciclo di vita - e di morte (end of life) - del prodotto, che coinvolge direttamente il produttore del prodotto che viene a farsi carico della gestione dei rifiuti causati dal consumo dei propri prodotti. La "REP" opera, da un lato, incentivando, alla fonte, la progettazione ecosostenibile dei prodotti; dall'altro lato, incentivando il rispetto della gerarchia dei rifiuti tra le diverse forme di trattamento, il riutilizzo, il riciclaggio e il recupero per la produzione di materia "end-of-waste", da reinserire nel ciclo economico a fini di produzione o di consumo. In questo modo la "REP" finisce per favorire lo sviluppo della "economia circolare". L'Italia si trova ora nella necessità di "misurarsi" con il dispositivo dell'art. 8 bis della direttiva 2018/851/UE e di adeguare il proprio ordinamento, e i propri sistemi di "REP", ai nuovi dettami comunitari. Il volume elabora una serie di proposte per l'imminente processo di revisione della normativa italiana. Tali proposte, trasversali a tutti i sistemi di "REP", intendono suggerire una linea operativa in sede di adeguamento dell'ordinamento nazionale alla direttiva 2018/851/UE, e non solo. Infine, il testo si sofferma sulla individuazione del ruolo che i cd. Consorzi di gestione dei rifiuti possono svolgere ai fini dell'attuazione dell'economia circolare in Italia - e della chiusura del cerchio che caratterizza il fondamento della tanto auspicata circular economy.

For example, all economic operators placing packaging onto the EU market are responsible for its proper management and recovery. It has therefore been necessary to establish a system of financial compensations between producers and waste management operators. Analysing the legal and institutional schemes of several member states and accounting for all the costs and benefits to their local authorities due to selective collection and sorting, this book provides an accurate illustration of how the EPR principle has be translated into practice. Firstly the authors examine whether the industry is paying for the net financial cost of 'preparation for recycling' activities or if the extra-costs of recycling are being recovered via the sale of sorted materials, by the consumer through higher prices or by citizens in general through higher taxes. Secondly, by monetizing the net environmental benefits attained with the recycling system, the book discusses the success and Value-for-Money (VfM) of the EU’s recycling policy. Book excerpt: Problem definition: We study how Extended Producer Responsibility (EPR) legislation implementations for durable products should differ from those for non-durable products. Academic and Practical Relevance: Certain unique characteristics of markets for durable products, which make designing EPR implementations more challenging, have not been explored to date in academia and practice. We fill this void by investigating the effect of EPR on durable goods markets. Methodology: We develop a game-theoretic model to analyze durable goods producers' secondary market strategy under EPR and analytically explore its environmental implications. Results: The implications of EPR are not straightforward for durable products. On one hand, despite being focused on recycling, EPR may lead to an unintended benefit in the form of higher reuse levels by reducing producers' secondary market interference. On the other hand, EPR can also induce or increase secondary market interference by producers. This diminishes environmental goals such as reducing new production and increasing reuse levels, two key environmental goals with higher priority than increasing recycling. Policy Implications: We offer insights for how the environmental effectiveness of EPR for durable products can be improved by appropriately choosing its implementation parameters. We show that implementation approaches that may be considered successful for non-durable products (e.g., packaging or end-of-life batteries), may not be suitable for durable products such as electronics. For example, more stringent collection targets and infrastructure requirements can backfire in EPR implementations for durable products.
