But the threat of the Soviet sphere is rapidly being superseded by state-sponsored terrorism; nuclear, chemical, biological, and missile proliferation; and other critical security factors. This volume provides a policy outline and specific steps for an urgently needed revamping of U.S. and multilateral export controls. It presents the latest information on these and many other pressing issues: The successes and failures of U.S. export controls, including a look at U.S. laws, regulations, and export licensing; U.S. participation in international agencies; and the role of industry. The effects of export controls on industry. The growing threat of "proliferation" technologies. World events make this volume indispensable to policymakers, government security agencies, technology exporters, and faculty and students of international affairs.

Book excerpt: Excerpt from Extend Export Control Act of 1949: Hearing Before Subcommittee No. 1 of the Committee on Banking and Currency, House of Representatives; Eighty-Sixth Congress, Second Session on H. R. 10550; March 1, 1960 At present, you will note we are applying export controls only for necessary national security and foreign policy purposes. Since we were here 2 years ago, we have ceased controlling exports for short supply reasons because there are no important commodities leaving the country in such quantities as to cause any serious shortages to the domestic economy. We believe, however, that this type of control authority should nevertheless be retained in the act as recommended because experience shows that our domestic supply of a commodity can change suddenly. We, therefore, make it a practice to watch carefully any commodities that appear to exhibit such tendencies SO that we may always be prepared to institute such controls when circumstances so warrant. For example, we have recently under taken to obtain reports of shipments of aluminum scrap as they Occur, to make sure that excessive amounts of this commodity, so important to our domestic industry, do not leave the country. As I have said, the main uses of export controls at the present time and for the foreseeable future are to carry out the national security and foreign policy Objectives of the act. This type of regulation has. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: International trade plays an enormous role in economic growth and prosperity. This activity can also be used to transfer military equipment, knowledge, and technology to hostile governments and transnational terrorist and criminal organizations seeking to attack and destroy their enemies. The U.S. and other countries have used economic sanctions such as export controls to try to restrict and eliminate the transfer of weapons and financial assets to these governments and organizations. This work examines how the U.S. has attempted to restrict the export of national security sensitive equipment, finance, knowledge, and technology since World War II with varying degrees of success and failure. It also examines how multiple U.S. Government agencies, nongovernmental organizations, and international government organizations seek to influence U.S. international trade, foreign, and security policies while concluding that some export controls are essential for promoting and defending U.S. national security interests.

Book excerpt: Export control laws and regulations are the legal framework for countries around the globe to ensure world peace and stability and their importance in international trade is growing. The reasons behind this growth lie in the evolution of technology, the fact that increasing amounts of goods/services are subject to controls (such goods/services representing a very large segment of world trade), and the increasing threat linked to terrorism. Consequently, export control laws and regulations have become extremely important for those involved in the international trade of goods/services with a direct or even indirect military use. Export control laws and regulations are complex, difficult to understand, and constantly evolving. Infringements can lead to very serious sanctions (civil, administrative, or criminal), and, not to be minimized, the risk of serious damage to the corporate image of one or more parties to a questionable transaction. Yann Aubin and Arnault Idiart are involved in such issues on a day-to-day basis in their respective capacities as lawyer and export compliance officer within the European Aeronautics Defence and Space Company (EADS). They have gathered contributions from expert practitioners (EADS and Thales as well as Hogan and Hartson LLP) and university scholars (Paris 11 Law School/Institute of Space and Telecommunications Law (IDEST) faculty and advanced students) to make the Export Control Handbook as useful as possible. The Export Control Handbook provides a practical examination of the export/import control regimes of defense and dual use goods and services of a number of selected jurisdictions around the world (China; European Union; France; Germany; India; Italy; Japan; Russian Federation; Spain; United Kingdom; United States). The Handbook contains a very useful appendix including, among other things, compliance procedures and standard country-specific application (or related) forms. The aim of each country-specific chapter of the Handbook is to provide actionable information designed to guide foreign entities wishing to undertake production in the jurisdiction (e.g., through a local subcontractor or a local subsidiary (which could be a joint venture) in order to subsequently export that product anywhere in the world. The Export Control Handbook is invaluable to any international trade professional (lawyer, compliance officer, etc.) or entity with a need to know the specific requirements to be followed in the jurisdiction in question for the efficient and legally compliant import or export of controlled military or dual-use goods or services.

Book excerpt: Excerpt from Issues in Export Control: Hearing Before the Subcommittee on International Economic Policy and Trade of the Committee on International Relations, House of Representatives, One Hundred Fourth Congress, First Session, January 25, 1995 I would note that machine tools continue to be the most tightly controlled products on the us. Control list, and indeed they are one of the last issues to be resolved in list making for the post-cocom regime. It is critical that this be resolved in the near future, be cause Of the incident that I have recounted reveals there is already a widespread perception and potential markets, particularly China, that the United States Government is more stringent than its former cocom allies. It is therefore very much in our interest to create a clear set Of parameters that would govern trade among advanced western na tions. Unilateralism and the residual perception of unilateralism is extremely damaging to us. Trade and security interests. I would note that we need to have, as you do, an indexation provision with in the new legislation, because there has been bitter experience of us. Manufacturers in not getting updates Of the control list. This went on for 17 years with the us. Machine tool industry, and similarly with telecommunications and with semiconductor production equipment. SO there is a feeling that there ought to be an indexation provision, along the lines that you have included in your legislation. I think that is critical. Mr. Lewis will address the question Of interagency relations, so I won't cover that. Let me just say, however, that I didn't under stand why we got into a conflict over dispute resolution in the last Congress, which actually led to the final gridlock that killed the bill. It is Obvious that there can be a sensible system worked out, and it is - I understand the administration is working on that issue that is probably what the President was referring to when he said that his administration is working on the bureaucratic issues at the present time.
