Book excerpt: During the last two decades researchers in the field of experimental law and economics have made significant contributions to our knowledge of human behaviour and its interaction with legal and regulatory environments. This collection of previously published papers examines the use of laboratory experiments to test and develop these theories about how people behave, including their responses to legal rules. An important resource for judges, policymakers and scholars alike, the articles presented are drawn from diverse disciplines such as economics, law and psychology. The editors' comprehensive introduction provides expert analysis and insightful discussion of new directions in the field. Also included is an extended bibliography of additional articles to further aid readers' study.

Available in PDF, EPUB and Kindle. Book excerpt: Only recently have philosophers and psychologists begun to consider empirical research methods to inform questions and debates in legal philosophy. With the field ripe for further experimental inquiry, this collection explores the most topical empirical developments and anticipates future research directions. Bringing together legal scholars, psychologists, and philosophers, chapters address questions such as: Do people share a stable set of intuitions about what the law is? What are common perceptions about causation, intentionality, and culpability, and are they consistent with the corresponding legal concepts? To what extent can experimental research methods advance theoretical debates in legal philosophy about the nature of law? With fascinating implications for legal philosophy, ethics, and moral psychology, Advances in Experimental Philosophy of Law sets the agenda for the emerging field of experimental jurisprudence and will be of interest to both researchers and practitioners alike.

Traditional law instruction, lecturing and memorizing have become a fading fashion, with legal clinics increasingly cropping up. These allow law students to practice while studying and to contribute to social justice as part of the educational process. Students no longer accept one-way interaction from their professors, and demand interaction with their peers in various corners of the globe. The Middle East is no exception here. Legal clinics can be found in most countries of the region, though there is scant literature on legal education in the area, particularly with regards to clinical legal education. This book fills this gap, and offers comparative cases that will benefit legal educators and justice practitioners in the Middle East and beyond. The region needs reform in all dimensions, including the political, economic, social, religious, legal, and educational. Legal education lies at the heart of securing such long awaited reforms. The book examines legal education within selected locations in the region, underscoring successful pedagogical models from various parts of the world. This peer-reviewed book focuses on practical legal education, where learning is student-centered, particularly clinical legal education, field work, street law, pro bono service, legal advice, simulations, placements/internships, moot courts and mock trials, problem-based learning, case analysis, group work, role-play, and brainstorming. The book brings together 28 chapters written by leading legal scholars from across the globe, all concerned with the advancement of legal education, with making it more interactive, and contributing to bridging the gap between powerful and powerless communities.

Book excerpt: The essays in this volume reflect the exciting new directions in which legal history in the settler colonies of the British Empire has developed. The contributors show how local life and culture in selected settlements influenced, and was influenced by, the ideology of the rule of law that accompanied the British colonial project. Exploring themes of legal translation, local understandings, judicial biography, and "law at the boundaries," they examine the legal cultures of dominions in Canada, Australia, and New Zealand to provide a contextual and comparative account of the "incomplete implementation of the British constitution" in these colonies.

Available in PDF, EPUB and Kindle. Book excerpt: Socrates knew all that was known by his contemporaries. But already in the Middle Ages it was becoming difficult for a single man to have a truly encyclopedic view of all human knowledge. It is true that Pico della Mirandola, Pius II, Leonardo da Vinci, and several other great minds were thoroughly in possession of considerable know ledge, and knew all that one could know, except no doubt for some techniques. The encyclopedists of the 18th century had to be content with an admirable survey: they could not go into details, and their work is a collective one, the specialized science of each collaborator compensating for the insufficiencies of the others. We know very well that our science of today is a science of specialists. Not only is it impossible for anyone person to assimilate the totality of human knowledge, it is impossible even to know ones own discipline perfectly thoroughly. Each year the presses of science pro duce a frightening quantity of printed paper. Even in very limited fields, new journals are created every day, devoted to extremely specialized, often very narrowly defined subjects. It is indeed evident that in a field whose scope extends well beyond astronomical or astrophysical research, it is materially impossible to be informed of everything, even with the richest of libraries at hand.

Book excerpt: The general purpose with which this book has been written is sufficiently indicated by its title. I have selected a number of the 'classical' experiments of Experimental Psychology, and have tried to present them in such a way that their performance shall have a real disciplinary value for the undergraduate student. Within this general purpose, my aim has been two-fold. I have sought to show, in the first place, that psychology is above the laboratory: that we employ our instruments of precision not for their own sake, but solely because they help us to a refined and more accurate introspection. And secondly, just as in my Outline of Psychology and Primer of Psychology I gave the results of experimentation a prominent place in the psychological system, so here I have treated the selected experiments not as separate exercises, but as points of departure for systematic discussion. Book excerpt: Experiments in Criminology and Law: A Research Revolution illustrates how experimental methods, particularly laboratory experiments, can be useful for researchers studying crime, deviance, and law. Scholars in these areas have typically relied on data from surveys, ethnographies, and government records. While such research has produced evidence regarding correlations, it has not been as successful at increasing our understanding of the mechanisms responsible for those correlations. This book makes the case that laboratory experiments can help. Their strengths complement those of traditional methods and field experiments.
