The recommendations to introduce such a scheme would create a new legal tool, enabling landowners to protect land in order to conserve and restore our natural and built environment. Conservation covenants would allow landowners voluntarily to create binding obligations on their own land to meet a conservation objective, such as preserving woodland, cultivating a particular species of plant or protecting a habitat for an animal, or farming land in a certain way. The proposed statutory scheme would give individual landowners the opportunity, using private agreements, to contribute to conservation efforts being made across England and Wales. The scheme will create a versatile, simple and cost-effective legal tool capable of: unlocking currently missed conservation opportunities by overcoming the legal difficulties faced when creating binding obligations; facilitating better ways to deliver existing conservation objectives; and providing assurance of long-term conservation benefits. The report includes a draft Conservation Covenants Bill, which would introduce the conservation covenant scheme into the law of England and Wales.

Book excerpt: Increasing demand for residential land in Colorado highlights a need for private land conservation throughout the state. Limited market transaction data and shortages of qualified appraisers, among other challenges, has made valuing a conservation easement and its associated development rights difficult in Colorado. Extending on Mellinger’s (2012) propensity score matching approach, we explore whether this approach can be used to target and value potential conservation easements using publicly available assessors’ data across the state’s distinct land markets. We compare county-specific propensity score matching models of three different land markets to a statewide model using three counties combined as a proxy for the state. The approach estimates a development value along with a propensity for development (i.e., a propensity score) to determine the risk of development on agricultural parcels. We calculate differences between estimated propensity scores and matched development values, along with ranked biased overlap statistics, to compare easement targeting and valuation across models. Results suggest that county-specific and statewide models lead to meaningfully different policy guidance in terms of which parcels have the highest risk for development and should be targeted, and what value should be attributed to development rights on those specific agricultural parcels. Our results also imply that county or land-market-specific models may be necessary for accurately assessing development risk and easement values due to the unique characteristics driving conversion to residential across different land markets.

Little is known on how determinants of conservation easements interact with one another and affect the choice of conservation approaches. The study objective was to analyze conservation easement trends and examine underlying choice determinants in the United States. Panel data models were employed to assess determinants of easement acres and contracts from 1995 to 2015. Findings revealed that the northern United States has the most percentage of land area under conservation easements. The growth in conservation easements was positively related to gross state products, land market values, air quality, and land use, while it was negatively related to state population density, conservation spending, easement duration and endangered species. Public policymakers would use these findings to integrate easement efforts into local planning to meet conservation and land-use objectives.
