Book excerpt: The sixth edition of this definitive work, last revised in 2011, gives detailed attention to all legislative, regulatory and judicial developments that have arisen under European Union (EU) and World Trade Organization (WTO) law on trade defence instruments up to February 2019, including the amended 2018 EU anti-dumping regulation. As trade law practitioners and scholars have come to expect from the trade law team of the Brussels law firm Van Bael & Bellis, the book continues to provide comprehensive, up-to-date analysis and critical commentary on EU instruments dealing with anti-dumping, countervailing, safeguard and trade barrier measures. The emphasis throughout is on the practical application of the rules. The book covers every issue likely to arise in any trade defence matter, including all of the following and more: determining the dumping and injury margins; rules for the determination of permissible adjustments; clarification of the terms ‘significant distortions’ and ‘distortions on raw materials’; determining the subsidy margin; determining the causal link between dumping or subsidy and injury; determining if ‘Union interest’ calls for intervention; examining the differences between anti-dumping and anti-subsidy legislation; procedural rules applicable to complaints, initiation of proceedings, investigations, protective measures, reviews and refunds; conditions for accepting an undertaking; measures that may be taken to prevent ‘circumvention’ of anti-dumping or countervailing measures; rules governing the standing of various interested parties before the European Courts; allocation and administration of quantitative quotas; and surveillance measures. As a detailed and practical commentary on the relevant aspects of the EU trade defence instruments as actually applied by the EU institutions in the light of WTO law, this book is the pre-eminent work in the field which remains without peer as a guide to EU trade defence law.

Available in PDF, EPUB and Kindle. Book excerpt: The European Union is one of the most outward-oriented economies in the world, and free trade is one of its founding principles. As such, instruments intended to ensure that international trade is conducted on a level playing field have been part of the EU’s policy toolbox since the beginning of European integration. Adapting to the current changes in international trade, these instruments have since undergone major reforms. This work provides an overview of the EU’s legal framework on the use of its trade defence instruments, in particular measures under the Trade Barriers Regulation, the Basic Anti-Dumping Regulation and the Basic-Anti Subsidy Regulation. The book shares valuable insights into how EU institutions currently apply these instruments and places their application in the broader political context in which international trade takes place, which has been shaped e.g. by developments related to the United Kingdom’s withdrawal from the EU and the ongoing blockade of the WTO Appellate Body.

Book excerpt: Limits to Free Trade ranges over a wide diversity of relevant issues ranging from international agreements, to regional trade policies, to import trade barriers, to movements for trade reforms. Informed, informative, and strongly recommended for academic library reference and resource collections, Limits to Free Trade is a model of detailed and articulate scholarship. The Midwest Book Review This book explores the growing list of non-tariff trade barriers raised by the US, EU and Japan and assesses the prospects for significant trade liberalization. The author examines the liability of global free trade through a review of the complaints that these three countries raised about each other over a five-year period. He concludes that free trade may be increasingly hampered as barriers are created more rapidly than can be resolved, and that the prospects for significantly strengthening safeguards are limited. These issues are analyzed in the contexts of the major WTO trade agreements and the political economy of decision-making in the US, EU and Japan. The author concludes that the growing problems are endemic to the system and are not amenable to easy remedy. He tackles topics including international agreements, the trade policy processes in the three regions, issues concerning trade practices, import trade barriers in the EU, and prospects for reform. Scholars, students and practitioners in business economics, international business, and international economics will find much of interest in this book.

Book excerpt: The author, a lawyer in Brussels and lecturer at the College of Europe in Natolin, places international trade law within an economic, political, and sociological context, focusing on the US and the European Union. Contending that, despite globalization, societies organize themselves differently and have diverse expectations of their governments and market actors, he explores how these differences affect the trading partners' policies in an age when nearly everything can be considered a matter of commerce. He also examines how domestic structures affect trade policy when the external world has a strong impact on the domestic sphere. Distributed by ISBS. c. Book News Inc.

Available in PDF, EPUB and Kindle. Book excerpt: The EU has pursued many trade pacts across the world. This is part of its foreign policy: as the third largest economy in the world and lacking hard power, the EU relies on trade agreements to project its interests. These are often complex and far-reaching initiatives that have the potential to shape not only economic but also political and social life in the EU and its trading partners. In Standardizing the World, Francesco Duina and Crina Viju-Miljusevic have gathered a group of leading experts to present an unprecedented assessment of the EU's efforts to standardize a wide array of economic, political, and social aspects of life through its trade agreements across the globe. Drawing on economic sociology and constructivist strands in international political economy, the volume examines what is being standardized, the extent to which the EU has been able to project its worldviews, and what explains the observable patterns of standardization across policy areas and geographies. Ten leading scholars from across the world offer as many chapters on EU agreements with all major trading partners and cover efforts in social and labor rights, the environment, investments, rule of law and anti-corruption, agriculture and food quality, services, public procurement, sustainable development, and more. Their findings paint a picture of a dynamic EU capable of projecting its worldviews across the globe that is nonetheless not always consistent or successful. Standardizing the World provides a wide-ranging and rigorous understanding of standardization in trade agreement as well as the EU's abilities to project its power and worldviews across the globe.

This book was released on 2021 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the Commission's first consolidated report on trade implementation and enforcement actions. It follows the appointment of the first Chief Trade Enforcement Officer in the Commission on 24 July 2020, to oversee and direct the effective implementation and enforcement of EU trade agreements and arrangements, with an explicit mandate to report to the European Parliament as well as to the Council of the European Union and the public. This report, which will be published annually, is the main instrument for doing so. The report consolidates the former yearly report on the implementation of EU trade agreements and its staff working document, as well as the former yearly trade and investment barriers report, into one. It contains information on activities undertaken by the Commission in partnership with Member States under the strategy to improve market access and help SMEs make the most of EU trade agreements, and demonstrates how the Commission works with civil society. It also reports on trade enforcement actions taken by the Commission under the dispute settlement mechanisms of the World Trade Organization (WTO), under bilateral trade agreements and under the EU's Trade Barriers Regulation. Finally, the report provides statistical data on trade and investment for the 37 main EU trade agreements from 2020 (on goods) and 2019 (on services) and covers significant developments up to the end of the second quarter of 2021. As the EU-UK Trade and Cooperation Agreement only entered into force on 1 May 2021 (provisionally applied as of 1 January), it will be covered by the 2022 edition of this report.

Available in PDF, EPUB and Kindle. Book excerpt: Government health, safety, and environmental standards have, in the past two decades, often created barriers to international trade. These non-tariff barriers have become the focus of trade disputes, negotiations, and agreements. This book explains the dynamics of conflict and cooperation over consumer and environmental regulation between the European Union and the United States. It explores the most celebrated cases of transatlantic conflicts over regulatory standards—the EU's beef hormone and legtrap bans, and America's fuel economy regulations—as well as the successes of the two partners in coordinating rules for chemical and drug testing, animal inspection, and the reduction of ozone-depleting chemicals. David Vogel argues that transatlantic regulatory conflict has less to do with protectionism and more to do with deeply rooted differences in cultural values and political priorities in Europe and the United States. These differences, he explains, constitute a fundamental and ongoing source of trade conflict between the EU and the U.S. The pattern of EU-U.S. regulatory relations has important implications, not only for the United States and Western Europe, but for the entire global economy. Whatever regulatory standards both adopt become de facto global standards. According to Vogel, the most important challenge for the U.S. and the EU is to promote and strengthen international regulatory cooperation. Each needs to pay more attention to their common interests in promoting international trade and improving global standards than to their often heated differences over particular consumer and environmental policies.
