Nonetheless, the efforts and resources devoted to regulatory quality in the sector, including the enforcement of rules, have not always been commensurate. This report identifies the gaps, barriers, implementation flaws and inefficiencies in the regulatory framework of the mining sector in Brazil. It takes stock of the recent reforms in the mining sector in Brazil, identifies areas that pose the greatest challenges for effective regulation in mining. It also describes the reforms that created the National Mining Agency of Brazil, its governance arrangements and its current regulatory practices. These are assessed against OECD principles in regulatory policy and mining regulation, as well as against country experiences from Australia, Chile, and Mexico. Finally, recommendations are provided to support further reform efforts.

Monde ancien, fragmenté, hétérogène et contrasté tout en ayant de forts éléments d'unité, cette région est à la fois un centre de diffusion culturelle, et un lieu de passage, de contact, et d'échanges économiques depuis la plus haute Antiquité. Située au cœur de l'Eurasie, traversée par les routes les plus anciennes, son rayonnement culturel a souvent dépassé les frontières des pays qui la composent aujourd'hui. Confronté à la "modernité" depuis environ deux siècles, le monde turco-iranien a abordé cette nouvelle étape de son histoire en empruntant des voies différentes: certains pays se sont inspirés de l'exemple occidental, d'autres ont été marqués par la colonisation russe, l'expérience soviétique voir chinoise. Paradoxalement, alors qu'une partie des pays de la région ont effectué les expériences de laïcité les plus poussées (Turquie et républiques ex-soviétiques en particulier), d'autres ont exploré la voie de l'islam politique le plus radical (Iran et Afghanistan). Dans cette perspective, ces contrées ont été en quelque sorte le laboratoire du monde musulman dans son ensemble. Cet ouvrage est issu d'un colloque organisé en novembre 2005 à l'Institut universitaire d'études du développement (IUED) de Genève en l'honneur de Mohammad-Reza Djalili. Les articles rassemblés dans ce volume offrent une réflexion critique sur la pertinence heuristique du concept de "monde turco-iranien", sur ses confins et sur ses spécificités. Ils adoptent tour à tour une perspective historique, politologique et anthropologique et abordent des thématiques telles que l'évolution historique de ces régions, la formation des Etats, les tensions de sociétés en transition à l'heure de la globalisation et des replis identitaires.

Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups

During four days seventeen leading scholars of Europe and America presented their contributions to debate the different problematiques of the remarkable phenomenon represented by the OECD Programme for International Student Assessment or PISA. PISA is not merely an educational event. It is also a media circus which involves the public rehearsal for reasons for failure or success; and even, in some cases, public and political and academic explanations about why 'failure' was not really that, and why 'success' was not really that either. At the centre of all these indications, we find the growing influence of international agencies on education and schooling which is decisively contributing to a marketisation of the field of education, in the context of an increasingly multilevel and fragmented arena for educational governance based on the formulation, the regulation and the transnational coordination and convergence of policies, buttressed at the same time by the diffusion of persuasive discursive practice. L’augmentation de la population en âge de travailler en Afrique subsaharienne constitue une réelle chance d’accroître la prospérité collective. Les pays de la région ont investi massivement dans le développement des compétences†‰; les dépenses publiques consacrées à l’éducation ont été multipliées par sept au cours des 30 dernières années, et le nombre d’enfants scolarisés est aujourd’hui plus élevé que jamais. Pourtant, les systèmes d’éducation de cette population n’ont pas donné les résultats escomptés, et ces insuffisances entravent considérablement les perspectives économiques. Dans la moitié des pays, moins de deux enfants sur trois terminent l’école primaire, et encore moins atteignent des niveaux supérieurs d’enseignement et obtiennent un diplôme. Les acquis d’apprentissage demeurent faibles, ce qui entraîne des lacunes dans les compétences cognitives de base telles que la lecture, l’écriture et le calcul, aussi bien chez les enfants, les jeunes que les adultes. Le taux d’alphabétisation de la population adulte est inférieur à 50 % dans de nombreux pays†‰; la part des adultes sachant lire, écrire et compter de manière fonctionnelle est encore plus faible. Une réforme du système est nécessaire pour réaliser des progrès significatifs. De multiples agences aux niveaux national et local sont impliquées dans les stratégies de développement des compétences, faisant des compétences «†‰le problème de tous, mais la responsabilité de personne†‰». Les politiques et les réformes doivent permettre de renforcer les capacités des politiques qui ont fait leurs preuves et d’instaurer des mesures incitatives visant à faire converger le comportement de tous les acteurs dans la poursuite des objectifs de développement des compétences au niveau national. Le développement des compétences en Afrique subsaharienne, un exercice d’équilibre. Investir dans les compétences pour la productivité, l’inclusion et l’adaptabilité présente des données qui éclaireront les choix stratégiques des pays en matière d’investissements dans les compétences. Chaque chapitre aborde un ensemble de questions spécifiques, en s’appuyant sur une analyse originale et sur une synthèse des travaux existants pour explorer les domaines principaux : • comment les compétences appropriées à chaque étape du cycle de vie sont-elles acquises et quelles défaillances du marché et des institutions affectent le développement des compétences†‰; • quels systèmes sont nécessaires pour que les individus aient accès à ces compétences, notamment les investissements consentis par les familles, les institutions du secteur privé, les écoles et autres programmes publics†‰; • comment ces systèmes peuvent-ils être renforcés†‰; • comment les personnes les plus vulnérables, à savoir celles qui ne font pas partie des systèmes standards et qui n’ont pas réussi à acquérir des compétences essentielles, peuvent-elles être soutenues. Les pays de la région seront souvent confrontés à des arbitrages difficiles qui auront des effets distributifs et influeront sur leur trajectoire de développement. Des dirigeants engagés, des efforts conjoints de réforme et des politiques bien coordonnées sont essentiels pour aborder le délicat exercice d’équilibre que représente le développement des compétences en Afrique subsaharienne.
