Finalmente y luego de algunas discusiones dentro del grupo de investigación, los autores decidieron por estudiar la relación entre derecho y cambio climático, decisión que les impuso todo un reto. El Grupo de Investigación en Derecho del Medio del Medio Ambiente de la Universidad Externado de Colombia asumió esta tarea desde finales del año 2009, y hoy, gracias al apoyo decidido de autoridades ambientales, institutos de investigación, catedráticos de prestigiosas universidades europeas y expertos locales, entre otros, se puede presentar el libro Derecho y cambio climático, que tiene como objetivo estudiar el tema del cambio climático desde la perspectiva jurídica, sin dejar de lado asuntos extrajurídicos necesarios para lograr la integralidad de la investigación. Nació en 1769, casi veinte años antes de que John Watts inventara el motor a vapor e inaugurara la primera fase de la revolución industrial. A su muerte, acaecida en 1859, la abrupta industrialización en Europa no solo había transformado de manera irreversible la sociedad y la cultura en las que vivió el naturalista alemán, sino que empezaba a devastar los recursos naturales y los ecosistemas que estudió en sus expediciones. Un indicador de ese rápido proceso de deterioro ambiental se puede encontrar en el incremento de las emisiones de gases de efecto invernadero como el dióxido de carbono (CO2) y el metano (CH4) a lo largo de la vida de Humboldt. Mientras en 1769 la concentración atmosférica de CO2 era de 279 partes por millón de volumen (ppmv), para 1859 era de aproximadamente 289 ppmv, lo cual equivale a un crecimiento de diez puntos durante los noventa años de vida de Humboldt (Steffen et al., 2011). Para poner estas cifras en perspectiva, piénsese que mientras en el año 1000 d. C. las concentraciones atmosféricas de CO2 eran de 279 ppmv, en 1800 d. C. alcanzaron 283 (un crecimiento de apenas cuatro puntos en ochocientos años) (ibid.). Como puede observarse, en la época de Humboldt las 18 Everaldo Lamprea Montealegre emisiones de gases de efecto invernadero daban sus primeros pero seguros pasos hacia "la gran aceleración" de la segunda mitad del siglo xx(Chakrabarty, 2009b), periodo durante el cual la temperatura del planeta empezó a elevarse vertiginosamente. Aunque hoy el legado de Humboldt es menos conocido que el de otros científicos de su tiempo —Charles Darwin, para citar el caso más obvio1—, sin saberlo o reconocerlo vivimos en un mundo humboldtiano. En este sentido, no es exagerado afirmar que una de las paradojas de la vida de Humboldt es que sus ideas llegaron a ser tan influyentes y ubicuas que terminaron por volverse casi invisibles.

Book excerpt: Payments for Environmental Services (PES) are being considered worldwide with great interest and expectation. Proposals to create agreements in which beneficiaries of environmental services pay landowners directly for the provision or protection of these services are innovative and promising. But what real PES experiences are actually out there? This work assesses a range of PES or PES-type experiences in one country, Bolivia, in the fields of carbon sequestration, protection of watershed services, biodiversity and aesthetic landscape values. The report concludes that while none of the generally young initiatives adhere fully to the principle of PES as developed in the theoretical literature, many experiment with some of the relevant PES mechanisms. Protection of watersheds and landscape values are the most common types, though the implementing intermediaries often have underlying biodiversity-protection goals. Main obstacles to PES implementation include ideological resistance against the PES concept, the difficulty of building trust between buyers and sellers, and limited willingness to pay on behalf of service users. During their relatively short lifetime, basically all initiatives had been successful in making service sellers (PES recipients) better off in economic terms, while the effectiveness in achieving environmental objectives and securing positive social impacts so far remained more variable. In some cases, redesigning these initiatives to bring them closer to the full PES principles could also enable them to more effectively achieve positive environmental and livelihood outcomes.
