Between 376 and 476 the Roman Empire in western Europe was dismantled by aggressive outsiders, "barbarians" as the Romans labelled them. Chief among these were the Visigoths, a new force of previously separate Gothic and other groups from south-west France, initially settled by the Romans but subsequently, from the middle of the fifth century, achieving total independence from the failing Roman Empire, and extending their power from the Loire to the Straits of Gibraltar. These studies draw on literary and archaeological evidence to address important questions thrown up by the history of the Visigoths and of the kingdom they generated: the historical processes which led to their initial creation; the emergence of the Visigothic kingdom in the fifth century; and the government, society, culture and economy of the "mature" kingdom of the sixth and seventh centuries. Book excerpt: Text and Textuality in Early Medieval Iberia is a study of the functions and conceptions of writing and reading, documentation and archives, and the role of literate authorities in the Christian kingdoms of the northern Iberian Peninsula between the Muslim conquest of 711 and the fall of the Islamic caliphate at Córdoba in 1031. Based on the first complete survey of the over 4,000 surviving Latin charters from the period, it is an essay in the archaeology and biography of text: part one concerns materiality, tracing the lifecycle of charters from initiation and composition to preservation and reuse, while part two addresses connectivity, delineating a network of texts through painstaking identification of more than 2,000 citations of other charters, secular and canon law, the Bible, liturgy, and monastic rules. Few may have been able to read or write, yet the extent of textuality was broad and deep, in the authority conferred upon text and the arrangements made to use it. Via charter and scribe, society and social arrangements came increasingly to be influenced by norms originating from a network of texts. By profiling the intersection and interaction of text with society and culture, Graham Barrett reconstructs textuality, how the authority of the written and the structures to access it framed and constrained actions and cultural norms, and proposes a new model of early medieval reading. As they cited other texts, charters circulated fragments of those texts; we must rethink the relationship of sources and audiences to reflect fragmentary transmission, in a textuality of imperfect knowledge.

Book excerpt: This book discusses civil litigation at the supreme courts of nine jurisdictions – Argentina, Austria, Croatia, England and Wales, France, Germany, Italy, Spain and the United States – and focuses on the available instruments used to keep the caseload of these courts within acceptable limits. Such instruments are necessary in order to allow supreme courts to fulfil their main duties, that is, the administration of justice in individual cases (private function) and providing for the uniformity and development of the law within their respective jurisdictions (public function). If the number of cases at the supreme court level is too high, the result is undue delays, which are mainly problematic with regard to the private function. It may also put the quality of the court’s judgments under pressure, which can affect its public and private function alike. Thus, measures aimed at avoiding excessive caseloads need to take both functions into account. Increasing the capacity of the court to handle larger numbers of cases may result in the court being unable to adequately fulfil its public function, since large numbers of court decisions make it difficult to guarantee the uniformity of the law and its development. Therefore, a balanced approach is needed to safeguard capacity and quality. As shown by the contributions gathered here, the nature of reform in this area is not the same everywhere. There are a variety of reasons for this heterogeneity, ranging from different understandings of the caseload problem itself, local conceptions regarding the purpose of the Supreme Court, and strong entitlements concerning the right to appeal to budgetary restrictions and extremely rigid legislation. The book also shows that the implementation of similar solutions to case overload, such as access filters, may have different effects in different jurisdictions. The conclusion might well be that the problem of overburdened courts is multifactorial and context-dependent, and that easy, one-size-fits-all solutions are hard to find and perhaps even harder to implement.

Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.
